COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION # 85- H6
APPROVAL OF SPECIAL USE PERMIT - Spraddle Creek Ranch
FILE NO: - ZS- 220 -85
WHEREAS, Marc Wentworth did file an application
with the Eagle County Department of Community Development
on or about April 15, 1985, within the Resource Zone District;
and
WHEREAS, a public hearing was held by the Board
of County Commissioners of the County of Eagle, State of
Colorado, on May 15, 1985; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of
Eagle County, comments of the Eagle County Department of
Community Development, comments of public officials and
agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State
of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations.
3. That the proposed land use will be compatible
with existing uses in the area.
4. That for the above - stated and other reasons,
the proposed zoning is in the best interest of the health,
safety, morals, convenience, order, prosperity and welfare
of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of the County of Eagle, State of
Colorado:
That the application of Spraddle Creek Ranch
File No: ZS- 220 -85, for approval of a special use of
Livery Stable /Chuck Wagon within the Resource Zone District
in the following described unincorporated area of Eagle
County be approved:

ATTACHED
THAT the following conditions shall be placed up-
on this approval and that violation of any condition shall be
the basis for revocation of the permit:
1. If the Town of Vail does not approve the sub-
division adjacent to and east of the present
livery stable, then this permit expires.
2. The access road will be improved by Vail Assoc.,
Inc. with the appropriate turnouts for cross -
traffic.
3. The County shall not be asked to maintain the
access road from the U. S. Interstate 70 exit
to the livery stable.
THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of
this Resolution to the applicant.
