RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 85-t10
AMENDMENT TO AN EXISTING SPECIAL USE PERMIT - Jehovah's Witnesses
FILE No. ZS- 216 -85
WHEREAS, Robert Weeden for the Edwards Congregation - Jehovah's
Witness did file an application with the Eagle County Department of
Community Development on or about March 1, 1985, within the Resource
Zone District; and
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado, on April 23 ,
1985; and
WHEREAS, based on the evidence, testimony, exhibits, study of
the Master Plan for the unincorporated areas of Eagle County, comments
of the Eagle County Department of Community Development, comments of
public officials and agencies, the recommendation of the Eagle County
Planning Commission, and comments from all interested parties, the
Board of County Commissioners of the County of Eagle, State of Colorado,
finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearing before the Planning Commission and
the Board of County Commissioners,
2. That the proposed special use permit amendment conforms to
the requirements of Section 2.09 of the Eagle County Land Use Reg-
ulations.
3. That the proposed land use will be compatible with existing
uses in the area.
4. That for the above - stated and other reasons, the proposed
zoning is in the best interest of the health, safety, morals, con-
venience, order prosperity and welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commiss-
ioners of the County of Eagle, State of Colorado:
That the application of Edwards Congregation - Jehovah's Witnesses,
File No. ZS- 216 -85, for approval of an amendment to that Special Use
Permit, File No. ZS- 216 -85, approved February 121985, Resolution No.
85 -28, for a church within the Resource Zone District in the following
described unincorporated area of Eagle County be approved:

AND that the following amended conditions shall be placed upon
this approval and that violation of any condition shall be the basis
for revocation of the permit:
1. The requirement to connect to the Upper Eagle Valley Consol-
idated Sanitation District is deleted from the permit approval of
February 12, 1985, Resolution No. 85 -28.
2. The driveway must be paved at the time of construction of the
building. The driveway is to be 20 feet wide with 2 foot shoulders on
either side.
3. The parking lot must be paved within 18 months of the date of
amendment, that deadline being specifically October 23, 1986.
4. Snow must not be pushed from the lot onto Beard Creek Road.
5. All other conditions originally approved by the Board of
County Commissioners on February 12, 1985, and listed in Resolution
85 -28 remain intact.
That the Board of County Commissioners directs the Department of
Community Development to provide a copy of this resolution to the
applicant.
MOVED, READ, AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its meeting held the
