of the following Resolution-
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 85 -- :W
RESOLUTION DIRECTING THE COUNTY
TREASURER TO PAY OVER TO THE ROARING
FORK SCHOOL DISTRICT RE -1 CERTAIN
SCHOOL LAND DEDICATION FUNDS
WHEREAS. the Board of County Commissioners of the
County of Eagle, State of Colorado (hereinafter referred to as
the "Board "), is holding certain moneys pursuant to the
provisions of §30- 28- 133(4)(a)(II), C.R.S., and §2.18.01 of the
Eagle County Land Use Regulations, received in lieu of school
land dedication from subdividers, and
WHEREAS, Roaring Fork School District RE -1 has made a
formal request for such funds to be used for major capital
improvements during its present building program which the
School District feels is reasonably necessary; and
WHEREAS, state statute authorized that the fund
received in lieu of land be used for capital outlay purposes;
and
WHEREAS, the County Treasurer has determined that the
school land dedication funds received from subdivision within
the borders of Roaring Fork School District RE -1 total
$6,135.44 as of April 17, 1985, and those funds have earned
interest also being held by the County Treasurer in the amount
of $4,519.49 for a total of $10,654.93; and
WHEREAS, the Board of County Commissioners wishes to
transfer said funds previously received in lieu of school land
dedication to Roaring Fork School District RE -1.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:

THAT, the Board directs the Eagle County Treasurer to
pay over to Roaring Fork School District RE -1 the sum of
$10,654.93 from the funds being held by the Board pursuant to
§30- 28- 133(4)(a), C.R.S., said $10,654.93 representing all
money being held by the Board in lieu of school land dedication
from subdivisions within the borders of District RE -1 and the
interest earned on those funds while it has been held by the
Board.
