RESOLUTION
OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 85
APPROVAL OF SPECIAL USE PERMIT - Don Boyer
FILE NO: - ZS- 217 -85
WHEREAS, Don Boyer did file an application with the
Eagle County Department of Community Development on or
about January 22 1985, within the Resource Zone
District; and
WHEREAS, a public hearing was held by the Board
of County Commissioners of the County of Eagle, State of
Colorado, on March 12, 1985; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas
of Eagle County, comments of the Eagle County Department
of Community Development, comments of public officials
and agencies, the recommendation of the Eagle County
Planning Commission, and comments from all interested
parties, the Board of County Commissioners of the County
of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was
provided as required by law for the hearing before the
Planning Commission and the Board of County Commissioners.
2. That the proposed special use conforms to the
requirements of Section 2.09 of the Eagle County Land
Use Regulations.
3. That the proposed land use will be compatible
with existing uses in the area.

4. That for the above - stated and other reasons,
the proposed zoning is in the best interest of the health,
safety, morals, convenience, order, prosperity and welfare
of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of the County of Eagle, State of
Colorado:
That the application of Don Boyer, File No: Zs- 217 -85,
for approval of a special use of an historical Log House
within the Resource Zone District in the following described
unincorporated area of Eagle County be approved:
SEE ATTACHED LEGAL DESCRIPTION
THAT the following conditions shall be placed upon
this approval and that violation of any condition shall
be the basis for revocation of the permit:
1.
That
the
cabin
not
be sold separately.
2.
That
the
cabin
be
maintained in a reasonable
manner to sustain its historical appearance.
THAT the Board of County Commissioners directs the
Department of Community Development to provide a copy of
this Resolution to the applicant.

Commissioners of the County of Eagle, State of Colorado,

County of Eagle and State of Colorado;
A parcel of land situated in tract No. 47 of Section 2, Township 8 South,
Range 87 West of the 6th P. M., lying Northerly of a fence constructed
and in place, said Parcel of land is described as follows: Beginning at
a trxe location of Angle Point No. 6 of said Tract No. 47 whence a Witness
Cornsr marked with a rebar a8d cap set in the ground bears : S. 89048'58"
E. 15.35 feet; thence N. 00 39'39" W. 350.00 feet; thence-a. 89048158" E.
311 feet; thence S. o0039'39" E. 350.00 feet to a,point in said fence;
thence N. 89 48'58" W, 311.00 feet along said fence to Angle Point No.
6 of said Tract No. 47, the point of beginning. The above described
parcel of land contains 2.50 acres, more or less.
