COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION # 85- 3
APPROVAL OF SPECIAL USE PERMIT - Ted Seipel, Jr.
FILE NO.: - ZS- 218 -85
WHEREAS, Ted Seipel, Jr. did file an
- application with the Eagle County Department of Community
Development on or about February 5, 1985 , within the
Agricultural. Residential Zone District; and
WHEREAS, a public hearing was held by the Board
of County Commissioners of the County of Eagle, State of
Colorado, on March 26 , 1985 ; and
WHEREAS, based on the evidence, testimony, ex-
hibits, study of the Master Plan for the unincorporated
areas of Eagle County, comments of the Eagle County De-
partment of Community Development, comments of public
officials and agencies, the recommendation of the Eagle
County Planning Commission, and comments from all inter-
ested parties, the Board of County Commissioners of the
County of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice
was provided as required by law for the hearing before
the Planning Commission and the Board of County Commissioners.
2. That the proposed special use conforms to
the requirements of Section 2.09 of the Eagle County Land
Use Regulations.
3. That the proposed land use will be compatible
with existing uses in the area.

4. That for the above - stated and other reasons,
the proposed zoning is in the best interest of the health,
safety, morals, convenience, order, prosperity and welfare
of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of
County Commissioners of the County of Eagle, State of
Colorado:
That the application of Ted Seipel , File No:
ZS- 218 -85 , for the approval of a special use of
Cluster Subdivision within an Agricultural Residential
Zone District in the following described unincorporated
area of Eagle County be approved:
"Exhibit "A" attached
THAT the following conditions shall be placed
upon this approval and that violation of any condition
shall be the basis for revocation of the permit:
1. The density for the 20 acres shall be
one single family residence per lot.
2. No dwelling units on the five acres
to become part of the larger lot.
3. A 35' right -of -way from centerline on
Brush Creek Road.
THAT the Board of County Commissioners directs
the Department of Community Development to provide a copy
of this Resolution to the applicant.
MOVED, READ, AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado,
at its meeting held the 9_Lt� day of Z Pet_ 19 ,

CERTIFICATION OF DEDICATION AND OWNERSHIP
Know all men by these presents that the undersigned being sole owners in
fee simple of all that real property situated in Eagle County, Colorado,
described as follows;

A parcel", known-as Wts 1 and 8 of the "Mosher Subdivision" located in
Tract 73, section 24, Township 5 South, Range 84 West of the Sixth Principal
Meridian,.Eagle County, Colorado according to the Independent Resurvey of said
,.Township and Range as approved on June 20, 1922; said parcel being more
particularly described as follows:
Reginninq at the Southwest Corner of said Wt 1, a rebar and aluminum cap
stamped L.S. 20695, from which an iron pipe for Corner No. 3 of Tract 72, .

1233.30 feet to the Southeast Corner of said Wt 1, a point from which a rebar
and plastic cap marked L.S: 7972 bears N.89 °58'03 "W. 19.77 feet distant; thence
along the South line of said Wt 1, N.89 °58'03 "JW. 709.19 feet to the point of
beginning. EXCEPTING therefrom, however, easements and rights -of -way for
roads, ditches and utilities of record or as same exist.
and containing 20.019 acres, more or less; have by these presents laid out
platted and subdivided the same into lots and blocks as shown on this final
plat under the name and style of the Amended Final Plat of Seipel - Abrams
Parcels, a subdivision in the County of Eagle; and does hereby accept the
responsibility for the completion of required improvements; and does hereby
dedicate'and set apart all of the public roads and other public improvements
and places as shown on the accompanying plat to the use of the public forever;
and does hereby dedicate those portions of said real property which are
indicated as easement on the accompanying plat as easements for the purpose
