BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 85- -C��
DENIAL OF ZONE CHANGE AMENDMENT - Evans Village
File No. - ZC- 209 -84
WHEREAS, Harold Denton did file a
petition with the Eagle County Department of Community
Development on or about December 17 , 1984, to rezone
the herein described property in Eagle County from
Resource Zone District to Residential Suburban Low Density
Zone District; and
WHEREAS, a public hearing was held by the Board
Of County Commissioners of the County of Eagle, State of
Colorado, on February 12, 1985; and
WHEREAS, based on the evidence, testimony,
exhibits, study of the Master Plan for the unincorporated
areas of Eagle County, comments of the Eagle County
Department of Community Development, comments of public
officials and agencies, the recommendation of the Eagle
County Planning Commission, and comments from all interested
parties, the Board of County Commissioners of the County
of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice
was provided as required by law for the hearing before
the Planning Commission and the Board of County Commissioners.
2. That the disadvantages of the use requested
outweighs the advantages.
3. That changing conditions clearly do not
require an amendment to the Zone District designation
presently placed on the subject property.
4. That the proposed rezoning is not necessary in
order to provide land for a demonstrated community need.
5. That there is a need for reasonable stability
in zoning.
6. That for the above - stated and other reasons,
the proposed zoning is not in the best interest of the
health, safety, convenience, order, prosperity and welfare
of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED by the Board of
County Commissioners of the County of Eagle, State of
Colorado:
That the petition of Evans Village ,
File Number ZC- 209 -84 for a zoning amendment to change
from Resource Zone District to Residential Suburban Low
Density Zone District be and is hereby denied relative
to the following described property located in the
unincorporated territory of Eagle County:

A tract of land situate in.Tract 52, Township-8 South, Range 87 West of the
6th Principal Meridian being more particularly described as follows: -
Beginning at the intersection of the North line of said Tract 52 and the
westerly right -of -way line of Colorado State Highway No. 82 whence a brass
cap for angle point 1 of said Tract 52 bears S. 89° 48' 06" E. 712.55 feet;
thence S. 18' 47' 32" E. 851.41 feet along said westerly right -of -way line;
thence S. 13' 08' 55" E. 101.69 feet along said westerly right -of -way line;
.thence S. 18' 47' 32" E. 539.44 feet along said westerly right -of -way line;
thence N. 89° 44' 55" W. 2001.80 to the easterly line of a tract-of land
described in Book 131 at page 314 of the records of the Clark and Recorder
of Eagle County, Colorado; thence along said easterly line the following

feet; thence S. 89' 37' 40" 14. 20.00 feet to the easterly bank of the Roaring

1411.53 feet along said west line to a No. 5 rebar set for angle point 2
of said Tract 52; thence S. 89' 49' 10" C. 1319.25 feet along the north
line of said Tract 52 to a' No. 5 rebar with aluminum cap set for angle point
3 of Tract 53 of said Township and Range; thence S. 89' 48" 06" E. 596.86
feet along said north line of Tract 52 to the point of beginning, containing
67.71 acres more or less.
