RESOLUTION NO. 84 --_p( _
CONVERTING MANDATORY EMPLOYEE RETIREMENT
CONTRIBUTIONS TO A TAX DEFERRED PLAN
WHEREAS, the
County of Eagle, State
in its capacity as the
State of Colorado, has
Officials and Employee
and
Board of County Commissioners of the
of Colorado (hereinafter the "Board "),
Governing Body of the County of Eagle,
previously adopted the Colorado County
s Retirement Association ( COERA) Plan;
WHEREAS, the COERA Plan has been amended pursuant to
H.B. 1217 (1984 Session) and Internal Revenue Code Section
414(h)(2) to provide that a county, municipality, or special
district employer may elect to pick up the contributions of
employee or elected official participants required by the Plan
(Section 3.4, as amended).
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the County of Eagle, State of Colorado, will,
as of January 1, 1985, pay the mandatory employee contributions
to the COERA Plan and reduce the employees' gross incomes by
such amount as permitted under Section 414(h) of the Internal
Revenue Code.
THAT, said contributions, although designated as
participant contributions, are being paid by the County of
Eagle, State of Colorado, in lieu of contributions by the
participant, and that the participant does not have the option
of choosing to receive the contributed amounts directly instead
of having them paid by the employer to the COERA Plan.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the County of Eagle, State of Colorado, at its
regular meeting held the day of
