Commissioner Updates Commissioner McQueeney had no updates. Commissioner Scherr reminded everyone that ballots would be mailed soon, and if folks wished to track their ballots they could sign up for BallotTrax at govotecolorado.gov. Chairman Chandler-Henry gave a shout out to all of the first responders who were honored at the"Night of Excellence"on Saturday night. Many first responders throughout the county were honored for their work. County Manager Updates Jeff Shroll stated that Eagle County has been nominated for the"Mountain States Circuit Finals"for the medium size rodeo of the year. He thanked the Fair&Rodeo Board,Facilities,Road&Bridge and the countless others that helped out with the rodeo. Consent Agenda 1. Resolution 2023-062 Approving the Consolidated Special Use Permit for Cottonwood Pass Guest House Eagle County File No. ZS-009325-2023 Janet Aluise, Community Development 2. September 2023 Payment Report Christina Andrews,Finance Commissioner Scherr moved to approve the Consent Agenda for October 10, 2023 as presented. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Airport Terminal Board. Commissioner Scherr seconded the motion. The vote was unanimous. Eagle County Airport Terminal (ECAT) Board 1. Eagle County Regional Airport Terminal Use Permit-United Airlines David Reid,Airport Executive Summary: At the January 3, 2023 Board of Commissioners Meeting, Resolution 2023-002 was passed updating/establishing the Schedule of Airline Rates and Charges For EGE. In conjunction with these rates, each airline is required to sign the Terminal Use Permit to operate into EGE, or pay'non-signatory'rates. The attached permit has been signed by the United Airlines'representative, Mike Yost, and requires ECAT approval and signature as well. Jeff Shroll stated that United was ready to sign,and it was time to proceed with their terminal use permit. Commissioner Scherr moved to approve the Eagle County Regional Airport Terminal Use Permit for United Airlines. Jeff Shroll seconded the motion. The vote was unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Airport Terminal Board and reconvene as the Eagle County Board of County Commissioners. Commissioner Scherr seconded the motion. The vote was unanimous. Work Session - Eagle County Room 1. State Land Board Update and Potential Water Partnership Discussion Kallie Rand,Eagle County Open Space and Natural Resources Executive Summary: Eagle County Conservation District is a land conservation partner with Eagle County. The Eagle County Conservation District was established to: • Represent Landowners and Water Rights Holders and connect them to conservation practices and natural resource management. • Offer technical/financial assistance through programs, education and outreach. • Advocate legislatively and policy-wise for our land stewards. 2 10/10/2023 The Conservation District will present their annual review and discuss their vision and plans for the future. Site Tour - Edwards 1. PDS-009273-2022: Margaux PUD Site Visit The purpose of the Eagle County Board of County Commissioners site visit is for orientation purposes only. The site visit is open to the public. However,members of the public should refrain from asking questions concerning the merits of the application,reserving those for the public hearing. PDS-009273-2022: The Margaux PUD- Sketch Plan for Planned Unit Development Karl Barton, Community Development Executive Summary: Construction of 32 rental multifamily dwelling units(16 2-bedroom units and 16 1-bedroom units in two buildings)in west Edwards. Project Name: The Margaux PUD File No.: PDS-009273-2022 Location: 32415 Highway 6,Edwards area(Parcel no. 2105-062-00-004) Owners/Applicants: Ryan Brown, Curreri Family Ventures, LLC Representative: Tambi Katieb,AICP,Land Planning Collaborative Staff Planner: Karl Barton,AICP,Contract Planner Staff Engineer: Ben Gerdes,P.E. County Engineer County Attorney: Beth Oliver,Deputy County Attorney Eagle County has received an application from Ryan Brown,Curreri Family Ventures LLC,represented by Tambi Kaiteb-Land Planning Collaborative (the"Applicant"), for a Sketch Plan for Planned Unit Development(or PUD Sketch Plan)to allow for a multi-family residential development consisting of 32 proposed dwelling units on 1.7 acres(the"Application"or Margaux PUD). The subject property is identified as parcel number 2105-062-00-004, addressed as 32415 Highway 6 in Edwards, and is located east of the Stillwater PUD and west of the Eagle River Village Mobile Home Park(the"Property"). The Eagle River forms the northern boundary of the site,Highway 6 the southern boundary. See the vicinity map at right. The Property is currently vacant but previously was used as a contractor's storage yard. The Application proposes a total of 32 dwelling units in two four story buildings and is to include 8 one-bedroom units and the remaining 2 bedroom units. The total site area is 1.72 acres,but approximately 0.4 acres of the site are 3 10/10/2023 located within the Eagle River. Therefore,the gross density of the site is 18.6 dwelling units/acre. 100%of the units are to have a"Resident Occupied"deed restriction,thereby exceeding the Eagle County Affordable Housing Guidelines minimum recommended mitigation of 25%of the total residential units in the project. The final housing plan, including deed restricted unit counts and deed restriction types,will be further reviewed/approved during Preliminary Plan for PUD (Preliminary Plan)review which is also considered by the Eagle County Planning Commission(the"Commission")and Board of County Commissioners(the"BoCC") . Generally,the site design can be described as having the two buildings located along the north and east sides of the site, forming an"L" shape. Open space is provided along the north edge adjacent to the Eagle River. This open space will provide a recreational amenity for residents and per Condition#1 will be subject to a Riparian Area Management Plan,which staff will review in detail during the Preliminary Plan process. Parking is provided within the L shape. A single access point is provided and the site has been designed to accommodate a future anticipated roundabout along Highway 6. Karl Barton, Contract Planner for Eagle County,presented. The proposal was for 32 dwelling units on 1.7 acres. The applicant was represented by Tambi Katieb with AICP,Land Planning Collaborative. The project went through two referral processes and no public comment had been received. The biggest change through the review process was the unit mix and parking provisions. The Planning Commission recommended approval. Further review of the project would determine whether any wetland mitigation was needed. The Planning Commissioner provided some comments with regards to affordable housing, location of the balconies on the south and west elevations,building heights,parking reduction, accessible units, and roundabout on Hwy 6. Generally,the applicant responded and agreed to work with staff. Tambi Katieb,Landing Planning Collaborative introduced the Property Owner,Ryan Brown,the Architect, Bill Nutkins, the Civil Engineer,Mason Talkington,the Traffic Engineer,Craig MacPhee, Transportation Engineer and Daiva Katieb,Environmentalist. Ryan Brown provided some background and reviewed the timeline. He and his family had been visitors to the Valley for over 40 years. His family owned multi-family rentals in Colorado and Maryland. His team was aiming to create a multi-family housing project that would solve some of the local housing needs. Mr. Katieb stated that the plan included 32 rental dwelling units, split between two buildings, sixteen(16) 2-bedroom and sixteen(16) 1-bedrooms. The goal had been to have the units be resident only for local and long term. The Margaux development included two buildings with different orientations. The development was near county transit and passes would be available for residents. There would be a management team onsite to manage the parking plan and amenities. The development area was divided into plan areas A and B. The wetlands area was delineated and there was a 75 ft. stream setback at the back of building B. There would be no disturbance to the wetlands and the riparian areas. Building B was a three story building. Landscaping and riparian plantings would improve riverside areas and provide residents with a backyard amenity. Residents could access the river but a trail would minimize their impact. He reviewed the proposed conditions and noted that they had no issues with the landscaping plan,riparian plan,but they wished to discuss some of the language. Since the original submission, they removed 8 bedrooms from building B reducing size and footprint and height. They believe that the height was comparable with surrounding residential land uses and allowances, and meets the county criteria. The applicant believed the public benefit was that they were able to double the housing requirement. He showed a visual slide that demonstrated the architecture, size,and elevation of the buildings. Bill Nutkins stated that they considered the architectural detailing and wanted to develop something that looked nice and keep the project financially viable. Mr. Katieb believed that a lot of the topics would be addressed in detail at the Preliminary Plan. Mr. Barton reviewed the requested variations but noted that they would not be approved until the Preliminary Plan. The variations included off street parking standards,parking space size,building heights, stream setback and uses, side yard setback,building lot coverage,maximum floor area ratio and open space. At the sketch plan there were a lot of details to work out. Commissioner McQueeney asked about the number of parking spaces. Mr. Barton stated that there would be 72 parking spaces. 4 10/10/2023 Mr. Barton reviewed the project standards and indicated that the application met the standards, Eagle County Comprehensive Plan, and Edwards Community Plan. With regards to some of the conditions, staff believed they could work with the applicant prior to the Preliminary Plan and evaluate what the applicant was proposing. Commissioner McQueeney wondered what would trigger the need for a round-a-bout to be built. Julie Pranger, Eagle County Staff Engineer, stated that there was currently a West Edwards Transit Plan which included construction of three round-a-bouts. At this time there was no funding in place. The developer had provided space and allowance for the county to construct a round-a-bout in the future. Commissioner Scherr asked about the proposed path. Mr. Barton stated that the path would be a soft service path and required minimal grading. Mr. Katieb believed it was important to note that all uses permitted by the Floodplain Development Permit process were permitted in the stream set back. Commissioner Scherr asked about conditions 2 and 3 and wondered if it would be more appropriate to delete the conditions and simply weigh in with his opinions. Mr.Barton stated that the idea behind the conditions was to make sure when the application is re-submitted for Preliminary Plan, that certain elements in the sketch plan are carried over and were addressed. Beth Oliver,Deputy Eagle County Attorney, added that the purpose of the conditions would be to bring the application into conformance with standards which are the same for Preliminary Plan. Chairman Chandler-Henry asked about the 50 ft. height limitation and wondered what the height of the Fox Hollow buildings were. Mr. Katieb stated that they were 48 ft. Mr.Barton stated that the condition was in response to the West Edwards Area Character Plan specific to the frontage along the river. Commissioner McQueeney asked about the setbacks and wondered if a variance was being requested. Mr. Barton stated that staff believed the best approach at Sketch Plan was to evaluate the uses that may occur within the stream set back. Ms. Oliver agreed with Mr. Barton's response. It wouldn't be a variance to uses, it would be a variance to the dimensional limitation. Staff would still be analyzing what uses would be allowed in the 75 ft. stream set back. The variance requested by the applicant would be analyzed under the county PUD standards used to analyze requests for variations. Chairman Chandler-Henry asked the applicant if they were relying on any off-street parking. Mr. Brown stated that there would be 42 spaces onsite and parking would be strictly monitored. Chairman Chandler-Henry opened and closed public comment,as there was none. Commissioner Scherr stated that his greatest concern was water quality in the riparian area. He was comfortable with the reduced parking. With regards to public benefit,he was unsure that the Resident Occupied (RO)units were adequate. Commissioner McQueeney believed this was something she could approve as a Sketch Plan but had some concern with the building height of the building but believed it could be mitigated with the architectural details shown. She wondered about the public benefit, for her, it wasn't the housing component. Chairman Chandler-Henry stated that she had concerts with Condition number 3. Based on Commissioner McQueeney's comments,the board was looking for density and affordability. She would like to remove Condition 3 knowing that it would be a challenge for the applicant to show how this meets the Edwards Area Community Plan. The board would like to focus on affordable housing. Commissioner McQueeney suggested removing the last bullet in Condition 1,as it seemed to be an odd statement. Mr. Barton stated that the statement was added at the Planning Commission hearing. Mr. Katieb stated that the building height would affect the feasibility of the project. Commissioner McQueeney reiterated that RO did not influence the affordability. Mr.Barton reviewed the proposed conditions. 5 10/10/2023 Beth Oliver suggested striking Condition 3 and removing two words from Condition 2,revised and increased. 2.The Applicant shall include in any Preliminary Plan for PUD application,revised architectural elevations that provide increased architectural interest on those building facades facing the parking lot and adjacent properties.Elements that increase architectural interest can include,but not be limited to,widows,breaks in the facade plane,material changes,dormers, parapets,or artistic embellishment. Commissioner McQueeney moved to approve File No. PDS-009273-2022, incorporating staff's findings and recommended conditions as adjusted,because this application,as conditioned,is conceptually consistent with the standards for approval of a Sketch Plan for PUD application found in Section 5-240.F.3.e of the Eagle County Land Use Regulations. Commissioner Scherr seconded the motion. The vote was unanimous.
