OF THE
BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION No. 85- ( %
DENIAL OF SPECIAL USE PERMIT - Old Electric
File No, ZS- 230 -85
WHEREAS, John Connor for Old Electric did file an
application with the Eagle County Department of Community Develop-
ment on or about July 17. 1985 for approval of a
Special Use of contractor's storage yard within the Resource
Zone District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on November 12, 1985 ; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendations of the Eagle County Planning Commission, and
cormmrents from all interested parties, the Board of County Com-
missioners of the County of Eagle, State of Colorado, finds as
follows:
1, That proper publication and public notice was
provided as required by law for the hearing before the Planning
Commission and the Board of County Commissioners.
(POSSIBLE FINDINGS)
2, That the proposed special use does not conform to
the requirements of Section 2,09 of the Eagle County Land Use
Regulation.
3. That the physical arrangement of the site is in-
appropriate because it cannot comply with the Eagle County
industrial performance standards required at Section 2.07.07
of the Eagle County Land Use Regulations.
4. That for the above stated and other reasons, the
proposed zoning is not in the best interest of the health, safety,
convenience, order, prosperity and welfare of the citizens of
Eagle County,
NOW, THEREFORE, BE IT RESOLVED, that the petition of
Old Electric for approval of a special use of contractor's
storage yard within the Resource Zone District in the following
described unincorporated area of Eagle County be disapproved:

MOVED, READ, AND ADOPTED by the Board of County Com-
missioners of the County of Eagle, State of Colorado, at its
