RESOLUTION OF THE BOARD OF COUNTY COMMISSIONERS
OF THE COUNTY OF EAGLE IN THE STATE OF COLORADO
• WHEREAS, the following described real property, to-wit:
Lots numbered 15 and 16, in Block
lettered "A", in the Town of Gypsum
situated in the County of Eagle and State of Colorado, was subject to taxation
for the years 1892 and 1894,
AND WHEREAS, the taxes assessed upon said real property for the years
aforesaid having remained due and unpaid and Tax Sale having been held, Tax
Sale Certificate No. 573, Sale of 1895 covering said property was issued to
said Eagle County on November 16, 1895,
AND WHEREAS, a Treasurer's Deed dated the 9th day of May, A. D. 1899 and
based on said Tax Sale Certificate, was issued by the then Treasurer of said
Eagle County conveying said real property, to "Eagle County and Assigns"; said
deed being recorded in Book 56 at Page 42 of the records in the office of the
. County Clerk and Recorder of said County,
AND WHEREAS, for some reasons not now known, said Tax Sale Certificate
No. 573, Sale of 1895, was, on the 20th day of November, A. D. 1900, assigned
to Edward Slaughter, by the then Treasurer of said County,
AND WHEREAS, a Treasurer's Deed dated the 23rd day of November, A. D. 1900
and based on said Tax Sale Certificate, was issued by the then Treasurer of said
Eagle County, conveying said real property to said Edward Slaughter; said deed
being recorded in Book 66 at Page 424 of aforesaid records,
AND WHEREAS, said Treasurer's Deed so issued to said Edward Slaughter is
one of the sources of title of Oscar A. Nelson and Edith N. Shaw, the present
owners of said real property,
AND WHEREAS, the predecessors in interest of the present owners and
occupants of said property, have paid all taxes assessed against said property
• for a period of more than sixty years, and said deed issued to said "Eagle County
and Assigns", recorded in Book 56 at Page 42 of aforesaid records, constitutes a
cloud on the title of the present owners and occupants of said property, which
should, as a matter of right, justice and equity, be removed.
NOW THEREFORE BE IT RESOLVED, that a Quit Claim Deed shall issue in behalf
of the said County of Eagle, conveying all right, title and interest of said County
• of Eagle, of, in and to said real property, to said Oscar A. Nelson and Edith N.
Shaw, not in tenancy in common but in joint tenancy, said deed to be executed by
each member of the Board of County Commissioners of the County of Eagle in the
State of Colorado, and attested by the signature of the County Clerk and Recorder
and official seal of Eagle County.
READ, CONSIDERED, PASSED AND ADOPTED at a regular meeting held this 2nd
day of March, 1970.
