RESOLUTION OF
.THE BOARD OF COUNTY COMMISSIONERS OF THE
COUNTY OF EAGLE IN THE STATE OF COLORADO
•
WHEREAS, a Public Works Fund was established pursuant to and in accord-
ance with Chapter 36, Article 3, Section 3 of Colorado Revised Statutes
1953 and a Resolution of The Board of County Commissioners of the County
of Eagle and State of Colorado passed and approved the 5th day of October,
1964, for the construction of a Court House annex and necessary remodeling
of the County Court House at Eagle at an estimated cost of Seventy-five
Thousand (475,000.00) Dollars;
AND, WHEREAS, under date of the 1st day of November, 1967, Richard A,
Miller, Annette Miller, and Walter A. Miller, as Lessors, leased to The
County of Eagle, State of Colorado, as Lessee, Lots 13, 14, 15 and 16 in
Block 24, Mayer Addition to the Town of Eagle, Eagle County, Colorado, for
the term of five (5) years, commencing on the 1st day of November, 1967, at
411 a monthly rental, payable in advance, of Two Hundred and No/100 Dollars
(*200,00) per month, payable on the 1st Monday of each and every month
thereafter during the term of said lease;
AND, WHEREAS, said lease contained an option to purchase said premises
worded as follows: " As consideration for this agreement, Lessee shall have
the right and option at any time during the term of this Lease, or any ex-
tension or extensions thereof, to purchase the demised premises for the

sum of Eighteen/and No/100 Dollars ( 18,000.00) cash. There shall be deduct-
ed from said sum of Eighteen Thousand and No/100 Dollars (418,000.00) such
rental payments as have been made by Lessee as aforesaid set out, less
interest on the unpaid balance of Eighteen Thousand and No/100 Dollars
(418,000,00) , with interest at the rate of Six Percent (6%) per annum on
the unpaid balance from November 1, 1967, ";
• AND, WHEREAS, the County has used said demised premises for providing
quarters for its County Court and space for driver license examinations,
and has incurred considerable expense in remodeling the improvements thereon
to meet its purposes;
AND, WHEREAS, pursuant to the provisions of Chapter 36, Article 3,
Section 2, Subsection (4) Colorado Revised Statutes 1963, the Board of
County Commissioners of the County of Eagle in the State of Colorado, held
Oa public hearing on the 25th day of June, 1969 for the purpose of discussing
the advisability of said County exercising aforesaid Option to Purchase for
the purpose of providing permanent quarters for the County Court of the
County of Eagle, Colorado, and space for driver license examinations, and
paying for the purchase thereof out of aforesaid Public Works Fund; notice
of said public hearing having been given by posting and publication as
appears from the records of our Board;
AND, WHEREAS, as of June 25, 1969, the date when aforesaid public hearing
was held, the County of Eagle had made rental payments aggregating the sum
of Four Thousand Dollars (44,000,00) under said lease and option, of which
One Thousand Six Hundred Ninety-two and 29/100 Dollars (41,692.29) is
applicable to the interest mentioned in said option, and the remaining
iskTwo Thousand Three Hundred Seven and 71/100 Dollars (42,307.71) of which
can be applied by the County as a credit towards said purchase price of
Eighteen Thousand and No/100 Dollars (418,000.00), leaving the sum of
Fifteen Thousand Six Hundred Ninety-two and 29/100 Dollars (415,692.29)
as the amount required to be paid at this time to purchase said property
under said option to purchase;
AND, WHEREAS, no opposition to said proposal to exercise said option
to purchase said property and pay for the same out of said Public Works
Fund, was expressed at said public hearing held as aforesaid, and it is
the opinion and experience of the Board that said property is easily access-
ible to, and has alleviated to an appreciable extent the crowded congestion
in, the Court House proper, and in addition to providing quarters for the
County Court and space for driver license examinations, has also provided
•excellent accomodations for holding public hearings and over-flow conditions
in appearances before the Board of County Commissioners, that the price
required for the purchase of said property is very reasonable under prevail-
ing conditions, and that it is, and will be, in the best interests of the
County of Eagle to terminate said rental arrangement and to exercise said

option and purchase said property at this time;
NOW, THEREFORE, BE IT RESOLVED, AND IT IS HEREBY ORDERED, that afore-
said option to purchase said real property be, and hereby is, exercised,
IIIand that there be, and hereby is, appropriated out of and from said Public
Works Fund the sum of Fifteen Thousand Six Hundred Ninety-two and 29/100
Dollars ($15,692.29) required to complete the purchase of above described
real property; and
BE IT FURTHER RESOLVED, that a certified copy of this Resolution be
delivered to the Treasurer of said County of Eagle as his authority in
the premises
READ, CONSIDERED, PASSED AND APPROVED at a regular meeting of our
Board held at our office in the Court House, in the Town of Eagle, in the
County of Eagle and State of Colorado, this 7th day of July, 1969,
