• WHEREAS John V. Hyrup is desirous of obtaining the license and ease-
ment hereinafter mentioned, and has agreed, as consideration therefor,to
furnish the following: the use of a suitable bulldozer, together with the
operator, for a period of one week of five days, in work on the road
along which the pipeline is to be installed, such equipment to be furnish-
ed at the convenience of our Board,
NOW THEREFORE BE IT RESOLVED, that said John V. Hyrup, hereinafter
referred to as the grantee, be granted a perpetual license and easement
to construct, install, maintain and repair a steel pipeline not exceeding
8 inches in diameter in and along the borrow pit of the county road on a
course and in a location in Eagle County, Colorado, described as follows:
Beginning at a point (hereinafter referred to as the point
of beginning) whence A. P. No. 4 of Tract 47, Township 8 South,
Range 86 West of the 6th P. M. bears S. 59° 18' W. 5139.70
. feet; thence S. 70° 38' W. 129.91 feet ; thence S. 66° 18' W.
491.94 feet; thence S. 65° 40 ' W. 38.63 feet; thence S. 76°
54' W. 691.67 feet; thence N. 84°03 ' W. 282.58 feet ; thence
N. 89°56' W. 229.94 feet; thence S. 81° 36 ' W. 299.07 feet;
thence S. 89° 41' W. 125.15 feet; thence N. 74° 41 ' W. 256.76
feet ; thence N. 85° 48' 4. 160.0 feet; thence S. 77' 16 ' W.
110.78 feet; thence S. 50° 59' W. 224.39 feet ; thence S. 30°
32 ' W. 200.73 feet ; thence S. 40° 00 ' W. 300.00 feet.
Also, beginning at the point of beginning as above described ;
thence N. 84° 07' E. 147.33 feet; thence S. 82' 33 ' E. 110.71
feet; thence S. 73° 38' E. 32.48 feet.
said pipeline to be installed and maintained at a depth and in such a man-
ner that it will not interfere with the upkeep and maintenance of said
county road, and upon condition that the said Grantee shall agree to con—
struct and maintain said pipeline in a good and workmanlike manner and
indemnify and save harmless the County on account of any claims for damages
because of construction and maintenance of said pipeline, and
• BE IT FURTHER RESOLVED that the Chairman of this Board be, and he
hereby is, authorized to execute an Easement and Right-of-way Conveyance
evidencing our action, same to be attested by the Clerk of our Board under
the official seal of our County.
