HomeMy WebLinkAboutR1959-02 Junior College Tuition Fund RESOLUTION
WHEREAS, the 43rd General Assembly of the State of Colorado passed House Bill
Number 360 whereby non. listrict students'home counties are to be assessed the
equivalent of 000,CO per year per student for Delta County students attending
Junior Colleges in Colorado; and
• WHEREAS, Governor McNichols approved said House Bill 360 on April 7, 1961, and
Ur EAS, Delta County contributes to the support of all State four•byear colleges
in Colorado, and
WHEREAS, there are sufficient State four-year colleges in Colorado for Delta
County students to receive their higher education, and
WHEREAS, the State four-year colleges provide an equivalent or superior higher
education than a Junior College, and
WHEREAS, the Board of County Commissioners of Delta County believes that said
tax imposed by House Bill Number 360 is unconstitutional, and
WHEREAS, the cost of county government is increasing annually, and
WHEREAS, it is the duty of the County Commissioners to levy taxes for county
functions, and maintain a watchful eye over the expenditures of the county,
• NOW, THEREFORE, BE IT RESOLVED:
That the Board of County Commissioners of the County of Delta deny legal
responsibility for and therefore refuse to pay any and all assessments for Delta
County students attending a Junior College in the State of Colorado; that a copy
of this Resolution be sent to all Superintendents of Schools in Delta County to
inform them that Delta County will not authorize any Delta County students to attend
a Junior College in the State of Colorado, and that if a student desires to attend
a Junior College, that said student must take personal arrangements for payment
of the additional assessment from his own resources; that a copy of this Resolution
be forwarded, by certified mail, to the Registrar and President of every Junior
College in Colorado so that each Junior College will be informed that Delta County
will not pay the $500.00 assessment per student per year and that if such Junior
College registers a Delta County student that they do so at their own risk. That
a copy of this Resolution be forwarded to the Colorado State Treasurer, as custodiant
of the Junior College Tuition Fund, to notify him that Delta County denies liability
for such assessment; and that a copy of said Resolution be sent to such other State
and County officials as may be designated.
