BOARD OF COUNTY COMMISSIONERS
EAGLE COUNTY
WHEREAS, in 1943, the General Assembly of the State of
Colorado passed a re-classification bill known as Senate Bill
390 for an increase in salary for certain Eagle and other county
officials; and
'.7HEREA3, a question has been raised as to the legal
effect of said legislation with respect to office holders elected
or appointed prior to the passage of said legislation under the
. provisions of the Con6titution of the State of Colorado; and
WHEREAS, litigation has been instituted for the pur. •
pose of detorminiri the effect of said legislation; and
'IMEREAS, the following vouchers, making claim for
increase in salaries, since the passage of said legislation and
its effective date under the Constitution, provided for under
said re-classification bill, commonly known as Senate Bill '390,
were presented to this Board:

W. M. Wilson, Sheriff 50.00
Forrest W. Cave, Treasurer 37.50
Ray Anrel, Assessor 37.50
Kathleen O'Rourke, Supt. of Schools 45.83
Wayne T. Jones, Commissioner 25.00
Alfred M. Sloss, Commissioner 25.00
Ralph Manuel, Commissioner 25.00
Charles S. Merrill 50.00

• NOW, T1TREFORE, 9E IT RESOLVED:
That the vouchers making claim for additional salary
under :3aid legislation be and the same hereby are disallowed,
subject, however, to re-consideration in the event that the
litigation referred to shall, in a lawful ruling, be determined
that said officials are entitled to said salary.
BE IT FURTHER RESOLVED:
That this action shall be applicable to all future
months and that it shall not be necessary for said officials
to file monthly vouchers for additional salary until a judicial
ruling be had on said legislation, and further that it shall be
considered by the Board that such vouchers were actually filed.
Read; considered, passed and approved at a regular
meeting of the Board of County Commissioners of Eagle County,
Colorado, this 3rd day of December A. D. 1945.
