RESOLUTION OF THE BOiRD OF COUNTY COMMISSIONERS OF EAGLE COUNTY COLORADO
WHEREAS, the Board of County Commissioners of Eagle County
0 desire to convey to the United States the following described land,
to-wit :
Vesuvius & Lava Placers, U.S.M.S. No. 2163 and Monitor &
Merrimac Lode, U.S.M.S. No. 2164, in Section Four (4) Town-
ship Five (5) South, Range Eighty-six (86) West of the
Sixth Principal Meridian, and Section Thirty-three (33) ,
Township Four (4) South, Range Eighty-six (86) West of
the Sixth Principal Meridian, Colorado.
and;
WHEREAS, the United States under statutory authority as ,
provided for in Sub-section "a" of Sub-section 8 of the Taylor Grazing
Act of June 28, 1934 (48 Statutes 1272) , as amended by Section 3 of the
Act of June 26, 1936 (49 Statutes 1976 ; 43 USC Supplement, 315 g) wishes
to accept as a gift the above described land, and ;
WHEREAS, the County hereby makes an offer to convey the above
described land as provided for in Section 256.2 Title 43 Part 256 of
411 the Code of Federal Regulations of the United States of America, and
in compliance with Sections 256.1 to 256.4 inclusive of Title 43 Part
256 as above.
BE IT THEREFORE RESOLVED That the Board of County Commissioners
of the County of Eagle and State of Colorado, a quasi municipal corpor-
ation, hereby makesan offer to convey the following described property
to-wit :
Vesuvius & Lava Placers, U.S.M.S. No. 2163 and Monitor &
Merrimac Lode, U.S.M.S. No. 2164, in. Section Four (4) Town-
ship Five (5) South, and Section Thirty-three (33) , Township
Four (4) South, Range Eighty-six (86) West of the Sixth
Principal Meridian, Colorado.
and be it further resolved that the Board of County Commissioners of
Eagle County hereby name and make Hume S. White, Commissioner of Deeds
411 to make the conveyance of the above described property from the County
of Eagle to the United States.
BE IT FURTHER RESOLVED that the County of Eagle do convey
the above described property to the United States, reserving however,

all rights of way, public or private, through the above described
land and reserving further any future rights of way or right of way

over, across and through the above described property to be used as
and for public highways either by the United States of America, the
State of Colorado, or the County of Eagle , or jointly by the United
States, the State of Colorado and the County of Eagle.
Read, considered, passed and approved this 7th day of
August A. D. 1944.
