. RESOLUTION.
RESOLVED, That Holy Cross Electric Association,Inc. ,
a domestic electric light and power company, authorized to do
business under the laws of the State of Colorado, be, and is
hereby authorized and permitted to construct , maintain and
operate electric transmission and electric distribution lines
along, across, upon and under any public highway within Eagle
County, Colorado, provided, however, that such lines shall
be so constructed and maintained as not to obstruct or hinder
the usual travel on such highways , and that nothing herein
shall be construed so as to interfere with any privilege
heretofore granted to any person or corporation to use said
highways for any purpose whatsoever.

Gentlemen :
I herewith enclose four copies of a proposed resolution,
two of which have attached thereto a certificate to be
executed by the County Clerk of your County.
As you know, Holy Cross Electric Association,Inc. is a
not-for-profit co-operative organization which seeks to
erect an electric transmission line which will serve many
of those in the rural sections of your county. It will
be necessary that the transmission line cross several
roads and highways in your county. It is for the purpose
of obtaining your permission to construct the line across
such roads and highways that I address this letter to you.
The resolution has been drafted directly from the statutes
found on page 365 of the 1939 Colorado Session Laws. I
believe that a brief examination of this statute, and of the
sections referred to, will convince you that you have the
authority to pass the resolution I propose. I am quite
anxious that this matter be settled at your first meeting
411 in April, 1941.
It is my intention that one of the officers or directors
of the Holy Cross Association will be present in person to
request passage of this resolution and to give you any information
which he has and which you might desire. However, it may not
be possible for anyone to be present at your meeting. In that
case, I would appreciate your passing the resolution anyway, unless
you-feel that further information or investigation would be essential
before you could take such action.
