RESOLUTION FOR VACATION OF ROADS IN

",� �a The next matter to come before the Commissioners was a request by
Columbine Cattle & Land Co. for a vacation of the roads in Ruedi Shores Sub-
division, Block 2, Eagle County, Colorado. The request was presented by Mr. Jean
C. Ingham, President of that corporation. Mr. Ingham stated to the meeting that
the dedication made to the County was in the first amended subdivision plat which
was filed in Book 218 at Page 265 of the records of Eagle County, Colorado. He
stated that Columbine had never intended to dedicate the roads to the County, but
due to an error in the preparation of the amended plat, for some reason a dedica-
tion of the County was inserted. Mr. Ingham pointed out that the corporation had
IIIalso developed Ruedi Shores Subdivision, Block 1, and had retained ownership of
the roads and streets in that subdivision for the use and benefit of the lot
owners in the subdivision, their grantees, heirs, assigns and invitees and that
he had at all times intended to do the same with Block 2 of Ruedi Shores Sub-
division. He pointed out that the subdivision is located adjacent to Ruedi
Reservoir in what could be considered a remote portion of the County. He did not
believe that it was the desire of the Eagle County Commissioners to undertake
maintenance of the roads in the subdivision, and that it had been his intent to
have the roads in private ownership in all likelihood owned by the Homeowners '
Association which would regulate the subdivision.
And the Commissioners, after fully discussing the matter, and having heard
the comments of all parties pertaining to such vacation, on motion duly made and
ioseconded, unanimously adopted the following resolution:

WHEREAS, a request hasn'been ma e for the vacation of all streets and
roads located in Ruedi Shores Subdivision, Block 2, as set forth in that cer-
tain first amended subdivision plat to Ruedi Shores Subdivision recorded in
Book 218 at Page 265 of the records of Eagle County, Colorado, and
WHEREAS,-it.,has been determined that suc,h vacation would not deprive
any person of access to his property; that the : iortion thereof hereinafter
` vacated will not be required for public use, and that the same should be vacated,
THEREFORE BE IT RESOLVED THAT the Board of County Commissioners of Eagle
County, Colorado, do hereby declare vacated all roads within Ruedi Shores Sub-
division, Block 2, as more fully set forth in the first plat to Ruedi Shores Sub-
division, Block 2, recorded in Book 218 at Page 265 of the records of Eagle County,
• Colorado.
