Commissioner Updates Commissioner Scherr wished Commissioner McQueeney a"Happy Birthday!" Commissioner McQueeney wished Commissioners Scherr a"Happy Birthday!" Chairman Chandler-Henry wished everyone a"Happy Birthday" and stated that she was fortunate to work with both commissioners. County Manager Updates Jeff Shroll thanked all the Eagle County folks who helped with the Fair and Rodeo. It was a great event and he was proud to see all the employees work together. Approval of the MOU Between the Eagle County Clerk&Recorder and the Board of County Commissioners Concerning the November 7, 2023 Coordinated Election Regina O'Brien, Clerk&Recorder's Office 5. Letter to Colorado Department of Public Health and Environment for Solid Waste and Recycling Financial Assurance Jesse Masten, Solid Waste&Recycling Rickie Davies, Eagle County Staff Engineer,presented an update on the Hillcrest Roundabout project and reviewed the IGA. The roundabout was in west Edwards by the water treatment plant. The total cost of the project was estimated to be $3,866,223.20. Funding for the project would come from the Capital Improvement Fund and Off Site Road Improvement Funds. Construction would begin April 1, 2024 and completion was expected to be near November 1, 2024. Commissioner Scherr moved to approve the Consent Agenda for August 8,2023 as presented. Commissioner McQueeney seconded the motion. The vote was declared unanimous. Business Item(s) 1. Resolution 2023-050 Concerning A Reappointment to the Minturn Cemetery District Board of Directors Dani Moore,Administration Executive Summary: The Minturn Cemetery District will be reappointing John Sheehan to the board of directors for an additional six(6)year term. John Sheehan spoke. He believed the Minturn Cemetery was a beautiful place. He spoke about their goal to obtain additional land and efforts to keep the cemetery affordable for Minturn residents. Commissioner McQueeney moved to approve the Resolution Concerning A Reappointment to the Minturn Cemetery District Board of Directors. Commissioner Scherr seconded the motion. The vote was unanimous. 2. Resolution 2023-051 Designating August 2023 as Child Support Services Month Guadalupe Ontiveros,Human Services Executive Summary: Resolution Designating August 2023 as Child Support Services Month Guadalupe Ontiveros, Integrated Support Services with Human Services,thanked the board for their support. The goal of the program was to insure that all children have the financial support needed to thrive. Currently her office was working with about 600 families and had collected about$1 million dollars. Commissioner Scherr moved to approve the Resolution Designating August 2023 as Child Support Services Month. Commissioner McQueeney seconded the motion. The vote was unanimous. 2 08/08/2023 Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Liquor Licensing Authority. Commissioner Scherr seconded the motion. The vote was unanimous. Eagle County Liquor Licensing Authority 1. Application for New Hotel&Restaurant Liquor License-Five Senses Hospitality Management LLC DBA The Hoffman Hotel Kathy Scriver, Clerk&Recorder's Office APPLICANT: Five Senses Hospitality Management LLC TRADE NAME: The Hoffman Hotel REPRESENTATIVE: Kevin Coates, of the law firm of Dill Dill Can Stonbraker&Hutchings Chris Manley, Five Senses Hospitality Management LOCATION: 401 Tree Farm Drive, El Jebel CO 81623 REQUEST: Application for NEW Hotel&Restaurant liquor license DESCRIPTION: The application for a new Hotel & Restaurant liquor license was received June 8, 2023. The Hoffman Hotel is located at 401 Tree Farm Drive in El Jebel. The hotel is a 4-story property on a 1.8-acre site, part of the mixed-use development known as the Tree Farm. ESTABLISH NEIGHBORHOOD: The first order of business is to establish the neighborhood for petitioning purposes. Staff recommended that the neighborhood consist of a two(2)mile radius from the proposed location-401 Tree Farm Drive. FIRST MOTION-Establishing the Neighborhood: Commissioner Scherr moved that the Local Liquor Licensing Authority establish the neighborhood to include the area within a two (2)mile radius surrounding the proposed location-401 Tree Farm Dr.,El Jebel. Commissioner McQueeney seconded the motion. The vote was unanimous. NEEDS AND DESIRES OF THE NEIGHBORHOOD: 1. The Local Licensing Authority shall consider the reasonable requirements of the neighborhood,the desires of the adult inhabitants of the neighborhood and whether the existing licenses are adequate to meet these needs and desires,per the Colorado Liquor Code, Section 44-3-301 (2)(a). 2. A petition was circulated by LiquorPros, a Colorado company specializing in need & desires surveys and petitions. 3 08/08/2023 • 111 Signatures Favoring Issuance • 4 Signatures Opposing Issuance OTHER LOCAL AUTHORITY CONSIDERATIONS: 1. Whether the applicants possess and maintain possession of the premises for which the license is issued by ownership, lease,rental, or other arrangement for possession of such premises. 2. Whether the premises are within 500 feet of any public or parochial school or the campus of any college, university,or seminary. 3. Whether the fees have been paid. 4. Whether the applicants are of good moral character. STAFF FINDINGS: 1. The applicant has submitted a complete application and the appropriate fees have been paid. 2. The applicants are all over 21 years of age and reported to be of good moral character based on their CBI background reports. 3. Public notice has been given by the posting of a notice in public view on the premises July 27, 2023 and by publication in the Vail Daily and Aspen Times on July 20th and July 27th of 2023. 4. The proposed location is not within 500 feet of any public or parochial school or the campus of any college, university,or seminary. 5. The applicant has provided an alcohol management plan per the requirements of the Local Licensing Authority and proof of server training will be provided upon issuance of the license. CONCLUSION: The applicant has met all the necessary requirements for a NEW Hotel&Restaurant Liquor License. SECOND MOTION-Approval of the Application: Commissioner McQueeney move that the Local Liquor Licensing Authority find that there is a reasonable requirement and desire for the issuance of this license and therefore approve the application for a Hotel & Restaurant liquor license for Five Senses Hospitality Management LLC DBA The Hoffman Hotel based on the testimony, petitions, and incorporating staff's findings contingent upon the Certificate of Occupancy and/or recommendations by staff. Commissioner Scherr seconded the motion. The vote was unanimous. Chris Manley, Five Senses Hospitality Management requested that the license be issued prior to the final Certificate of Occupancy. Chairman Chandler-Henry believed the motion covered staff's recommendations. 4 08/08/2023 Commissioner Scherr moved to adjourn as the Eagle County Liquor Licensing Authority and reconvene as the Eagle County Board of County Commissioners. Commissioner McQueeney seconded the motion. The vote was unanimous.
