This being a scheduled Public Hearing,the following items were presented to the Board of County
Commissioners for their consideration:
Constituent Input
Chairman Chandler-Henry opened and closed constituent input, as there was none.
Commissioner Updates
Commissioner McQueeney took an opportunity to talk about the start of the legislative session. There
would be a retreat this week with Colorado Counties and Commissioners Acting Together(CCAT)where they
would be looking for feedback. This was the public's opportunity to bring forward any issues that could use a
legislative fix.
Commissioner Scherr believed it was good to be back from vacation but was disappointed to have missed
the Fair and Rodeo.
Chairman Chandler-Henry recognized everyone involved in making the Fair and Rodeo happen. The rodeo
sold out all four nights,which was a first. The Junior Livestock sales auction netted around$950,000 this year for
150 animals.
County Manager Updates
Kelley Collier, Chief Operations Officer reminded everyone that there were some small wildfires
happening now and encouraged folks to sign up for EC Alerts at ECEmergency.org.

3. Approval of the Minutes for the Board of County Commissioner Meetings for June 6, June 13,June 20,and

Teak Simonton, Eagle County Treasurer,highlighted the Treasurer's Quarterly report. The county had
accrued a significant amount of interest revenue and had met the budget. She hoped that the board would see
their way to sending a little money to the trail's needs. She also reviewed the Public Trustee 2nd Quarter report
and stated that things were fairly slow as there were not a lot of foreclosures this year.
Chairman Chandler-Henry asked about her office expenses being lower.
Ms. Simnonton stated that her office expenses were lower than last year due to allocation of expenses and
less time being needed to process releases.
Commissioner McQueeney moved to approve the Consent Agenda for August 1,2023 as presented.
Commissioner Scherr seconded the motion. The vote was declared unanimous.
Business Item
1. Resolution 2023-047 Eagle County Affordable Housing Guidelines Update, Commercial Mitigation
Clarification
Tori Franks and Kim Bell Williams,Resiliency/Housing
Executive Summary: Staff will present an update and clarification to the Commercial Mitigation section of the
Housing Guidelines for the BoCC's consideration of approval. Additionally for informational purposes only, staff
will provide an overview of the annual Housing Guidelines Administrative Procedures.
Tori Franks, Eagle County Resiliency Director, explained that this was the formal follow-up from a work
session held on June 27th and would clarify and update the housing guidelines document. The policy document
was used to weight housing mitigation against land use applications. The majority of changes and clarifications
were focused on the commercial mitigation side. The commercial mitigation would change from a square footage
calculation to a job generation analysis. Commercial developments that created three or more jobs would trigger
the housing guidelines. The last piece would clarify the language of commercial mitigation or commercial
development to non-residential. The language better represented the type of development. The definitions were
not changing. She also reviewed the updates to the Administrative Procedures document. Chapter 8 was updated
annually. It provided the affordable rental rates, affordable sales prices,payment in lieu calculations,mortgage
rates. etc. The big driver in this one was the AMI,"Area Median Income." The AMI came down from the
Housing and Urban Development(HUD)every year and was based on the area. For Eagle County,the AMI for a
four person household went from$111,800 to $118,300,a 5.8%change. This number would generate an increase
in initial affordable sales prices,rental rates, and fees in lieu.
Chairman Chandler-Henry believed the tables provided in the report were helpful
Ms.Franks stated that the documents would be available on the county website.
Commissioner Scherr moved to approve the resolution approving the 2023 Eagle County Affordable
Housing Guidelines.
Commissioner McQueeney seconded the motion. The vote was declared unanimous.

reconvene as the Eagle County Housing and Development Authority.

Eagle County Housing and Development Authority
1. Property Management Agreement between Colorado Mountain College and Eagle County Housing and
Development Authority

Executive Summary: ECHDA is partnering with Colorado Mountain College("CMC")to provide property
management services to a new 36 unit building on the Edwards campus that is expected to start occupancy in
August 2023. This building will serve the students, staff, and faculty of CMC Edwards with 2 bedroom and studio
units.
Brenda Camunez,Property Manager with Housing, spoke about the partnership with Colorado Mountain
College(CMC). The Housing Authority would be providing property management services for the new building
on the CMC Edwards campus. The building would have 36 total rental units with 12 two bedrooms and 24 studios
and serve CMC students. The rental rates for students was $1,175 per month for a studio and$1600 per month for
the 2 bedroom units. Priority was given to the students.
Commissioner Scherr moved to approve the agreement between Colorado Mountain College and Eagle
County Housing and Development Authority.
Commissioner McQueeney seconded the motion. The vote was unanimous.
2. Riverview Apartments Preservation,LP-Rent Schedule Low Rent Housing and accompanying Automatic
OCAF Rent Increase

Executive Summary: Each year HUD puts out an updated Rent Schedule outlining the approved Housing
Assistance Payments from HUD. These documents set the rental rate that HUD will pay Riverview for each unit
less the calculated amount each tenant must pay for their unit. The formal notice is to be signed by the ECHDA
Board and then returned to the Colorado Housing and Finance Authority to countersign and return to HUD. The
new amount reflects a 3.8%revenue increase to the property.
Kim Bell Williams, Eagle County Housing Director, explained that HUD provided the rent schedule for the
Housing Assistance Program. The tenants would continue to pay based on their income.
Commissioner McQueeney moved to approve the Riverview Apartments Preservation, LP-Rent Schedule
Low Rent Housing and accompanying Automatic OCAF Rent Increase.
Commissioner Scherr seconded the motion. The vote was unanimous.
Commissioner Scherr moved to adjourn as the Eagle County Housing and Development Authority and
reconvene as the Eagle County Airport Terminal Corporation.
Commissioner McQueeney seconded the motion. The vote was unanimous.

Eagle County Airport Terminal (ECAT) Board
1. Eagle County Airport Terminal(ECAT)Agreement with ArtLifting PBC-Artwork Rental Agreement

Executive Summary: Artwork Rental Agreement
Josh Miller,Deputy Director of Aviation, stated that the agreement was a four year agreement. The cost
totaled$38,048 over the life of the contract. The program was introduced by a consultant they had been working
with. The ArtLifting program supported artists nationwide. He hoped to expand the program and work with local
artists.The historical artwork at the west end of the terminal would not be relocated.
Jill Klosterman moved to approve the Eagle County Airport Terminal(ECAT)Agreement with ArtLifting
PBC -Artwork Rental Agreement.
Commissioner Scherr seconded the motion. The vote was unanimous.
Commissioner McQueeney moved to adjourn as the Eagle County Airport Terminal Board and reconvene
as the Eagle County Board of Equalization.
Commissioner Scherr seconded the motion. The vote was unanimous.
Eagle County Board of Equalization
1. Resolution 2023-048 Regarding Petitions to the Eagle County Board of Equalization
Rhea Silverkorn, Administration
Executive Summary: This County Board of Equalization(CBOE)resolution is for the Board to consider and
approve the CBOE hearing officers recommendations.
Ms. Silverkorn, Eagle County Executive Coordinator, explained that the resolution was approving the
decisions by the hearing officers and stipulation agreements that were entered between petitioners and the
appraisers from last week. As of Friday,there were 895 schedule numbers/properties that had been heard by hearing
officers; of those,48%had a reduction in value. The average decrease in value for those properties had been 14%.
Commissioner Scherr moved to approve the Resolution Regarding Petitions to the Eagle County Board of
Equalization.
Commissioner McQueeney seconded the motion. The vote was unanimous.
Commissioner McQueeney moved to adjourn as the Eagle County Board of Equalization and reconvene
as the Eagle County Board of County Commissioner.
Commissioner Scherr seconded the motion. The vote was unanimous.
Planning File - Eagle County Room
1. Tabling Request: Twin Acres Riding Stable and Boarding Stable ZS-009260-2022

Executive Summary: Request for Consolidated Special Use Permit approval for development and operation of a
25-stall horse boarding stable and a 100 x 200 foot covered riding stable,proposed to be commercial operations and
open to the public on a reservation basis as space allows to accommodate horse boarding&horse riding,training
and lessons.
Vince Hooper,Eagle County Staff Planner, stated that the applicant had not been able to secure the
necessary documentation for the water rights from the water court to date. They anticipated being able to do this in
the near future. They requested that the board table the public hearing until November 14,2023.
Matt Peterson,Assistant Eagle County Attorney, advised the board that they had the discretion to consider
the tabling request for good cause shown.
Commissioner Scherr moved to table Twin Acres Riding Stable and Boarding Stable file no.
ZS-009260-2022 until November 14,2023.
Commissioner McQueeney seconded the motion. The vote was unanimous.
