BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 88- 1,33

RESOLUTION AUTHORIZING THE EXPENDITURE FROM
THE CONTINGENCY FUND FOR THE PAYMENT OF
UNANTICIPATED CONTINGENCIES
WHEREAS, pursuant to Section 30 -10 -512, 30 -10 -513, and 23 -30-
203, C.R.S., respectively, the County Sheriff shall act as a fire
warden, be in charge of forest or prairie fires, and has the duty
to report the fires to the Board of County Commissioners of the
County of Eagle, State of Colorado (hereinafter the "Board ") or its
authorized agent; and
WHEREAS, pursuant to Resolution No. 88 -74, the Board
established fire equipment use rates for bills submitted by any
person or organization called upon by the Eagle County Sheriff to
fight a forest or prairie fire who would not otherwise be obligated
to fight such fire; and
WHEREAS, the Board is in receipt of unanticipated fire
fighting bills due to various fires in Eagle County, submitted by
the Eagle Volunteer Fire Department (hereinafter the "Fire
District "); and
WHEREAS, the Board desires to appropriate money from the
Contingency Fund to pay for professional services rendered by the
Fire District, as indicated in Exhibit A in the amount of Eight
Hundred Fifteen and 50/100 Dollars ($815.50); and
WHEREAS, the Board has determined that payment of professional
services of the aforementioned fires require the expenditure of
funds from the County's Contingency Fund to cover such anticipated
expenses; and
WHEREAS, the Board finds, determines and declares that such
expenditures could not have been reasonably foreseen and have
unduly burdened the budgets of the Board of County Commissioners
and the Sheriff's Office to the extent that with other anticipated
expenditures it is not possible for said budgets to absorb the
costs of the aforementioned expenditures; and
WHEREAS, the Board established the Contingency Fund, and
budgeted and appropriated funds therein, to provide for
expenditures caused by an act of God, or the public enemy, or some
contingency that could not have been reasonably foreseen at the
time of the adoption of the budget; and
WHEREAS, the Board further finds, determines and declares that
the aforementioned expenditures comply with the intent of the
Contingency Fund and the provisions of Section 29 -1 -114, 29 -1 -115,
and 30 -25 -107, respectively, C.R.S.; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby authorizes the expenditure in the
amount of Eight Hundred Fifteen and 50/100 Dollars ($815.50) from
the County Contingency Fund for the payment of the expenses
specified herein.
THAT, pursuant to Section 29 -1 -114, 29 -1 -115 and 30 -25 -107
respectively, C.R.S., this Resolution, as proposed, has been
published in full one time in a newspaper having general
circulation within the territorial limits of the County of Eagle,
State of Colorado.
THAT, the Eagle County Budget Officer is hereby requested and
directed to immediately transmit an original or certified copy of
this Resolution to the affected spending agencies and the officer
or employee of the County of Eagle whose duty it is to draw
warrants or orders for the payment of money.
THAT, the Eagle County Budget officer is hereby further
requested and directed to file an original or certified copy of
this Resolution with the Division of Local Governments in the
Department of Local Affairs.
THAT, the Board finds, determines and declares that this
Resolution is necessary for the public health, safety and welfare
of the citizens of the County of Eagle, State of Colorado.
