COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 88-la?
AMENDMENT OF RESOLUTION 86 -39, INCREASING
TRANSIENT TIE -DOWN FEES AT THE EAGLE COUNTY AIRPORT
WHEREAS, the County of Eagle, State of Colorado, by and through
its Board of County Commissioners, hereinafter referred to as the
"Board ", is the owner of an airport known as the Eagle County
Airport situate in the County of Eagle, State of Colorado,
hereinafter referred to as the "Airport "; and
WHEREAS, the Board pursuant to §§ 30 -11 -107 (1) (j), 41 -4 -101,
41 -4 -106, and 41 -4 -112, respectively, C.R.S., has the authority with
respect to the operation of said airport to lease and /or rent spaces
to individuals and /or entities and to exact and require fees
therefor; and
WHEREAS, on or about May 5, 1986, pursuant to Resolution 86 -39,
the Board duly adopted a revised form transient tie -down space lease
agreement to reflect certain fee schedule amendments relative to the
use of tie -down spaces; and
WHEREAS, the Board is desirous of further revising and amending
its Airport transient tie -down fees, and hereby defines (1)
transient aircraft as aircraft which has not been entered into a
Tie -Down Lease agreements, and (2) aircraft weights and
classifications for tie -down fee purposes, as shown in Exhibit A.
WHEREAS, the Board wishes to modify and amend Resolution Nos.
86 -39, and 83 -27, thereby changing Airport transient tie -down fees;
and Resolution No. 82 -87, Rules and Regulations of the Eagle County
Airport.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby adopts the amended fees for lease of
transient tie -down spaces at the Eagle County Airport, as the same
is set forth in Exhibit "A" attached hereto.
THAT, Resolution Nos. 86 -39 and 83 -37, respectively, hereby
are amended and the aforementioned transient tie -down fees are
adopted; Resolution No. 82 -87, Rules and Regulations of the Eagle
County Airport, is amended to reflect the described changes.
THAT, any portions of any prior resolutions, including
Resolution Nos. 86 -39, 83 -37, and 82 -87, which are in conflict with
these provisions, are hereby repealed.
THAT, if any one or more sections or parts of this Resolution
shall be adjudged unenforceable or invalid, such judgment shall not
affect, impair or invalidate the remaining provisions of this
Resolution, it being the intention that the various provisions
hereof are severable.
THAT, the provisions of this Resolution shall be effective
immediately.
THAT, the Board finds, determines and declares that this
Resolution is necessary for the public health, safety and welfare of
the citizens of the County of Eagle, State of Colorado.
MOVED, READ AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its regular meeting held
