COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 88 -
APPROVAL OF NCGRADY ACRES MINOR PUD - William Nottingham, Susan
Nottingham, Randy Nottingham Estate
FILE NO. - PD-274-88 S/P
WHEREAS, George Petre for William Nottingham, Susan Nottingham,
and the Randy Nottingham Estate, Drawer 400 Glenwood Springs,
Colorado, 81801 did file an application with Eagle County
Department of Community Development on or about July 21, 1988
and;
Whereas, based on the evidence, testimony exhibits, study
of the Master Plan for the unincorporated areas of Eagle County,
comments of the public officials and agencies, the recommendation
of the Eagle County Planning Commission, and the comments of all
interested parties the Board of County Commissioners of the
County of Eagle, State of Colorado, finds as follows:
i. That proper publication and public notice was
provided as required by law for the hearing before
the Planning Commission and the Board of County
Commissioners.
2, That the proposed Minor PUD and Zone Change conforms
to the requirements of the Eagle County Land Use
Regulations.
a. The required minimum of 25 percent has been
provided.
b. The density is appropriate and is consistent:
with the Master Plan.
C. The church site is appropriate for the area.

d. The appropriate mix of land uses has been
provided.
E. The parcel exceeds the minimum 5 acre
requirement.
f. A PUCE '.wide has been established and .a home
owners association will maintain the cor(imon
facilities and open space; in addition adequate
parking has been provided.
J. That the proposed land use wi l 1 he compatible with
existing uses in the area.
4. That for i:he above-stated and other reasons, the
proposed Minor POD is in the best interest of the
health, safety, morals, convenience, order,
prosperity and welfare rare of the citizens of E,ag I
County.
NOW, THEREFORE, be it resolved, by The Board d of County
Commissioner:_ of the County of Eagle, State of Colorado;
That the application of Bi l I and Susan Nottingham and the
Randy Nottingham Estate, File # PG - 274-08 for a Minor POO for
the following described parcel of land located in the South IN
of Section 7, and in the SW 1/4, Stn/ 1%4 of = ection 8, all in
Township 5 South, Range 81 West ( see attached legal
descr iption)in the unincorporated area of eagle, County, be
approved;

2. The subdivision improvements must be col l ater<al ized

of the project.

3. The setback distance shall be the top ol' the bank ur,

6. A sufficiency rating is required for the Nottingham
Bridge before the Final Plat will be approved.

lots. Final design is to be submitted with the

occupancy.
7. A safety and visual fence (5 feet of woven wire with

along the railroad right-ok-way.

A parcel of land located in the S 1/2 of Section 7, and in the SW 1/4 SW
1/4 of Section 8, all in Township 5 South, Range 81 West of the 6th
Principal Meridian, lying southerly of the Denver and Rio Grande Western
Railroad right -of -way, easterly of Eaglebend Subdivision, and northerly
of Eagle -Vail Subdivision Filing 2, in Eagle County, Colorado, more
