RESOLUTION NO. 88- �lq
APPROVAL OF AMENDMENT TO SPECIAL USE
PERMIT FOR FLOYD CRAWFORD AND TAMMY CROUCH
FILE NO. ZS- 200 -87 -A
WHEREAS, Floyd Crawford and Tammy Crouch did file an
application for amendment with the Eagle County Department of
Community Development on or about October 2, 1987, within the
Commercial General Zone District; and
WHEREAS, a public hearing was held by the Board of County
Commissioners of the County of Eagle, State of Colorado on November
10, 1987; and
WHEREAS, based on the evidence, testimony, exhibits, study
of the Master Plan for the unincorporated areas of Eagle County,
comments of the Eagle County Department of Community Development,
comments of public officials and agencies, the recommendation of
the Eagle County Planning Commission, and comments from all
interested parties, the Board of County Commissioners of the County
of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided
as required by law for the hearing before the Planning Commission
and Board of County Commissioners.
2. That the proposed special use amendment conforms to the
requirements of Section 2.09 of the Eagle County Land Use
Regulations as follows:
a. That utilities adequate to provide water and
sanitation services based upon accepted engineering standards and
approved by the County Environmental Health Officer and the
Colorado State Department of Health are either in place or to be
constructed in conjunction with the proposed special use.
b. That street improvements adequate to accommodate
traffic volume generated by the proposed use and to provide safe,
convenient access to the use are either in place or to be
constructed in conjunction with the proposed use, as approved by
the County Engineer.

C. That the proposed special use will not be
detrimental to the character of the neighborhood and is consistent
with the Master Plan.
d. That the proposed land use will be compatible with
existing uses in the area.
4. That the special use already exists on the property and
any additional sewage output is insignificant.
5. That for the above stated and other reasons, the proposed
zoning is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens of Eagle
County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County
Commissioners of the County of Eagle, State of Colorado:
THAT, the application of Floyd Crawford and Tammy Crouch,
File No. ZS- 200 -87 -A for approval of an amendment to allow a Day
Care Center within the Commercial General Zone District in the
following described unincorporated area of Eagle County be
approved:
Beginning at a point located 1650 feet north on the
intersection of Highway 82 and E1 Jebel Roads on the western edge
of the right -of -way, then proceeding 200 feet west, then 200 feet
north, then 200 feet east, then 200 feet south to the point of
beginning, containing approximately one acre.
THAT, the following conditions shall be placed upon this
approval and that violation of any condition shall be basis for
revocation of the permit:
1. The landscape plan as depicted on the current site plan
must be implemented by June 30, 1988.
THAT, the Board of County Commissioners directs the
Department of Community Development to provide a copy of this
resolution to the applicant.
