Home My WebLink AboutC82-043 Town of VailAGREEMENT THIS AGREEMENT entered into this 21st day of September , 1982, by and between the County of Eagle, a body corporate and politic, by and through its Board of County Commissioners, hereinafter referred to as the "County". and the Town of Vail, a municipal corporation, hereinafter called "Vail". WHEREAS, at the time of annexation of West Vail into the Town of Vail the County was in possession of certain bonds warranting road cuts in County roads; and WHEREAS, with the annexation of West Vail those roads became Town roads outside the authority or responsibility of the County; and WHEREAS, the Town of Vail has noted deficiencies or defects in a number of those road cuts and wishes to forfeit a number of those bonds; a list of those bonds and permits marked Exhibit "A" is attached hereto and made a part hereof by reference thereto. The Town of Vail makes no claim as to any of the other County road cut permits or accompanying bonds. THE PARTIES THEREFORE AGREE AS FOLLOWS: 1. The County will turn over to Vail the bonds ``"V received for Permits # 434, 405, 379, 365, 334 and 305. 2. In case of any action for the refund of the bonds specified in the above paragraph, Vail agrees to provide legal defense in such action and further to pay any judgement or settlement in any such action including all court costs. 3. Vail agrees they have no objection to the return of any other County road cut bonds for the annexed West Vail area to those who gave the bonds, the warrant/period having already run.
