HomeMy WebLinkAboutC82-045 MOU White River National ForestS MEMORANDUM OF UNDERSTANDING Between WHITE RIVER NATIONAL FOREST and EAGLE COUNTY Colorado State Statute 43-4-207 This Memorandum of Understanding, made and entered into by and between Eagle County, State of Colorado, hereinafter called the "COUNTY", and the United States Department of Agriculture, Forest Service, Rocky Mountain Region, herein- after called the "FOREST SERVICE", sets forth the responsi- bilities of each party with respect to the development and operation of those roads that are part of both the Forest Development and County road systems. WITNESSETH: WHEREAS, the COUNTY is vitally interested in providing and operating a road system to provide adequate vehicular access for residents and commercial enterprises both for intra-and `•►' inter -county travel; and WHEREAS, the FOREST SERVICE is vitally interested in pro- viding and operating a road system for vehicular access that will integrate with other transportation systems and facilities and which provides access for the use and enjoyment of National Forest resources; and WHEREAS, many of these planned and existing roads, both adjoining and within the National Forests, will benefit and provide for the needs of the COUNTY and the FOREST SERVICE; and WHEREAS, it is mutually beneficial to set down the responsibilities of each Agency for those roads that are part of both the COUNTY and FOREST SERVICE road systems (hereinafter called the "Joint System"); and WHEREAS, the COUNTY and the FOREST SERVICE recognize that the setting down of development and operation responsibilities will minimize costly and unnecessary differences through �,• advance coordination and full understanding; and WHEREAS, nothing in this Memorandum is to be construed as conflicting with existing laws, regulations, and prescribed responsibilities; 1 NOW, THEREFORE, inconsideration of the above premises, the parties hereto agree as follows: DEFINITIONS: For the purposes of this Memorandum of Understanding, the following terms are defined: 1. Con'struct'ion. The supervising, inspecting, actual building, and all expense incidental to the con- struction or reconstruction of a Forest development transportation facility, including locating, surveying, and mapping (including the establishment of tempor- ary and permanent geodetic markers in accordance with the specifications of the National Oceanic and Atmos- pheric in the -Department of Commerce), rights -of -way (survey, design, appraisal, negotiation, and title processing), and elimination of hazards. 2. County System Road. A public way, meeting the statutory requirements for a County road, and properly registered with the State. A'legal instrument is available in the County Records describing the rights of the County to the subject road. 3. Environmental Assessment (EA). A concise public document, prepared by the Forest Service pursuant to Forest Service Manual 1950, which serves to briefly provide sufficient evidence and analysis for determining whether to provide an Environmental Impact Statement or Finding of No Significant Impact. 4. Environmental Impact Statement (EIS). A detailed written statement -as required by Section 102 (c) of the National Environmental Policy Act of 1969. 5. Forest Development Road and Trail. A Forest road or trail under the jurisdiction of the FOREST SERVICE (23 USC 101 (a)) . 6. Forest Road.or Trail. A road or trail wholly or partly within, or adjacent to, and serving the National Forest System and which is necessary for the protection, administration, and utilization of the National Forest System and the use and development of its resources (23 USC 101 (a)) . Ma 7. Joint Road System Plan. A multiyear plan facili- tating an organized program of construction and �.•� maintenance on local public roads and Forest Develop- ment roads serving the National Forests which are of mutual interest to both parties. This will consist of a map and a listing identifying road name, number, termini, etc. 8. Joint System. Those roads declared to be both a County System road and a Forest road. 9. Jurisdiction. The legal right to control and regulate all use of a transportation facility. 10. Law Enforcement: The act of policing and citing violators of laws or regulations. 11. Maintenance. The upkeep of the entire transportation facility including surface and shoulders, parking and side areas, structures, and such traffic control devices as are necessary for its safe and efficient utilization. 12. Responsibil1ty. Ultimate accountability for a prescribed action. 13. Public Road. Any road or street under the jurisdiction of and maintained by a non -Federal public authority and open to public travel (Title 23 USC 101). 14. Structure. A bridge, culvert, retaining wall, cattle - guard, ford, or other structural improvement intended for carrying vehicular travel or built to support the roadbed. 15. USDA Easement. A written instrument, issued pursuant to 16 USC 533 or other specific Federal statute, authorizing the construction and use according to its terms of roads or highways over National Forest lands. A. PLANNING AND COORDINATION FOR THE JOINT ROAD SYSTEM The COUNTY and FOREST SERVICE shall: 1. Develop a COUNTY -FOREST SERVICE joint road system plan to serve lands on and adjacent to National Forests. Planning shall include public involvement continuously through the plan development. - 3- 2. Meet annually to: a. Discuss development programs of interest to both Agencies. Special emphasis will be given .to programs involving the joint system and needed rights -of -way by each Agency for roads to be included in the joint system. b. Review the responsibilities for operation of the existing joint system for possible modifications, additions, or deletions. C. Discuss feasibility and enter into joint system project agreements in upcoming year. 3. Keep each other currently informed, through letters or meetings, regarding any modification of items agreed to at the joint meeting. B. CONSTRUCTION OF' JQINT ROAD SYSTEM 1. Over Federally Owned Rights -of -Way. `..r a. Construction solely by the COUNTY. (1) The COUNTY shall: (a) Make a written application for a Special Use Permit to FOREST SERVICE for survey of planned work when it is in the conceptual stage. (b) Using decisions and other information from the approved EA or EIS, pre- pare preliminary plans and specifi- cations which sufficiently define the physical limits and location of the road on the ground. Review location on the ground with FOREST SERVICE and make written application for a USDA Easement to allow occupancy of the National Forest lands necessary to the project. (c) Prepare detailed project design and specifications using standards developed in the EA or EIS. -4- (2) The FOREST SERVICE shall: (a) When advised of the planned project, prepare an EA or EIS and transmit stipulations and standards to COUNTY. (b) Issue a Special Use Permit to the COUNTY for survey purposes to develop a design and a right-of-way plat. (c) In a continuing on -the -ground review of developing design, define final project requirements in concert with the approved EA or EIS and the prep- aration of detailed project plans by COUNTY. (d) Issue a Special Use Permit authorizing occupancy of National Forest lands for construction purposes. b. Construction by both Agencies (1) The COUNTY and FOREST SERVICE shall enter into a project agreement which will stipu- late the responsibilities of each Agency. Any such agreement shall be in accord with and subordinate to this Memorandum. (2) The FOREST SERVICE shall prepare an EA or EIS which will provide the basic land management controls for the final plans and specifications. (3) When indicated, the FOREST SERVICE and COUNTY shall amend the project agreement to include stiuplations required to control the work. Any such amendment shall be attached to and made a part of the project agreement. See Chapter 71.27, FSH 1509.11. (4) When COUNTY is to assume jurisdiction, it shall promptly make application for USDA Easement. The FOREST SERVICE will issue the USDA Easement. -5- C. Construction solely by the FOREST SERVICE �Bpw (1). The FOREST SERVICE shall: (a) Keep COUNTY advised of current plans and programmed projects. (b) Prepare the necessary Environmen- tal Assessment or Environmental Impact Statement, and plans and specifications. (c) Review project on the ground with COUNTY; modify as necessary. (2) The COUNTY shall: (a) Review plans and specifications, including need for detours and traffic through area during construc- tion. Suggest modifications as needed. (b) Consent to planned reconstruction. If the joint road system plan shows that.the COUNTY is to assume juris- diction following construction, COUNTY shall make application for an Easement. FOREST SERVICE to issue on USDA Easement 2. On COUNTY -owned Rights -of -Way a. Construction solely by COUNTY (1) The COUNTY shall: (a) Advise the FOREST SERVICE of planned construction activities as early as possible. (b) When work is programmed, request an EA or EIS from the FOREST SERVICE concerning the effect of the proposal on National Forest and adjacent lands. (c) Modify plans to extent possible to include EA or EIS recommendations. (2) The FOREST SERVICE shall: (a) Keep advised of planned COUNTY activities. (b) Provide EA or EIS when requested. b. Construction by both Agencies (1) The COUNTY and FOREST SERVICE shall enter into a project agreement which will stipulate the responsibilities of each Agency. The FOREST SERVICE is not authorized to transfer or pay funds to the COUNTY under the terms of this Project Agreement. Any such project agreement shall be in accord with and subordinate to this Memorandum of Understanding. (2) The FOREST SERVICE shall prepare an EA or EIS which will recommend basic land manage- ment controls for the final plans and specifications. (3) The FOREST SERVICE and COUNTY shall amend the project agreement to include appropri- ate stipulations recommended by the Envi- ronmental Assessment or EIS. Any such amendment shall be attached to and made a part of the project agreement. C. Construction solely by FOREST SERVICE (1) The FOREST SERVICE shall: (a) Keep COUNTY advised of current plans and programmed projects. (b) Request written approval to proceed with planned construction. (c) Prepare an Environmental Assessment or Environmental Impact Statement, and plans and specifications considering on -site effects as well as impacts on adjacent lands. - 7- lv� `..d (d) Review project on ground with COUNTY. Modify as necessary. (2) The COUNTY shall: (a) Review and approve construction plans. Suggest modifications as necessary. (b) Provide writeen approval for FOREST SERVICE to construct road. (c) Retain the option to inspect project during construction for conformance with COUNTY requirements. 3. On roads over which neither the COUNTY nor FOREST SERVICE has all needed Rights -of -Way a. Where the developed road system is planned for COUNTY jurisdiction but will serve as public access to National Forest lands. (1) The COUNTY shall: (a) Advise the FOREST SERVICE of planned development activities as soon as possible. (b) Request an Environmental Assessment from the FOREST SERVICE. (c) Modify plans, where possible, to include EA or EIS recommendations. (d) Request a USDA Easement from the FOREST SERVICE for those portions covered by assignable easements. (2) The FOREST SERVICE shall: (a) Keep advised of planned COUNTY activities. (b) Provide Environmental assessment when requested. (c) When needed rights -of -way are not available and'COUNTY is to acquire Easements, the FOREST SERVICE may assist by providing survey,. design, appraisals, or negotiations to the point where a deed is signed in favor of the COUNTY. (d) Issue the COUNTY a USDA Easement. . b. Where the developed road system is planned for FOREST SERVICE jurisdiction but will serve as public access to properties normally served by a COUNTY road. (1) The COUNTY shall: (a) Keep advised of planned FOREST SERVICE activities. (b) Provide input to an EA or EIS, when requested. (c) When needed rights -of -way are not available and FOREST SERVICE is to acquire Easements, the COUNTY may assist in providing survey, design, appraisals, etc., to the point where a deed is signed in favor of the FOREST SERVICE. (2) The FOREST SERVICE shall: (a) Advise the COUNTY of planned development activities as soon as possible. (b) Promptly request input and assistance from COUNTY where appropriate and needed. C. ROAD OPERATION Management of road operation is necessary for the protection of the public investment and environmental values, coordin- ation of multiple -use activities, safety for all users, and for reasonable access for all types of public traffic. Road `%00� operation includes all activities dealing with mainten- ance, signing, and control of road use. The various road operation responsibilities and juris- diction for each road on the joint system are itemized in Schedule A (attached to and made part of this Memo- randum). Schedule A will be reviewed in the annual meeting, and modified as necessary. State traffic codes apply to all roads under COUNTY jurisdiction. For those roads under FOREST SERVICE jurisdiction, it must be so stated in Schedule A that the roads are open to the public (unrestricted). State traffic codes will then apply. The COUNTY is responsible for law enforcement and traffic accident investigation on all public roads regardless of jurisdiction. The FOREST SERVICE is responsible for enforcement of rules in addition to or conflicting with State laws on roads designed as "restricted use" in Schedule A. The responsible Agency is in no way committed to a fixed policing and patrol schedule by this Memorandum. The FOREST SERVICE may designate roads under its juris- diction as "restricted use" to close the road or regulate use. The FOREST SERVICE may designate any roads under its jurisdiction as "Cost Sharing" under 36 CFR 212.11 for purposes of requiring users to share in the costs of construction and maintenance. The COUNTY and FOREST SERVICE shall, within their authority, control vehicle weights below legal or posted limits. The FOREST SERVICE and the COUNTY, whichever is assigned signing responsibility on Schedule A, shall undertake a program of providing and maintaining adequate signs meeting current Manual or Uniform Traffic Control Devices Standards. The Agency assuming jurisdiction shall erect route markers indicating the route number. D. CONCLUSION ``.1. This Memorandum may be amended or supplemented by mutual agreement in writing by the signers or their -10- successors in office. This Memorandum may be terminated by either the COUNTY or the FOREST SERVICE through 90-day advanced written notice by either party to the other. Schedule A may be modified at any time by mutual written consent. 2. Where applicable, any contract, agreement or under- standing entered into pursuant to this Memorandum providing for work or actions to be performed shall include the requirements of Federal laws, Executive Orders and Regulations, and State Statutes. 3. Nothing herein contained shall be construed to obligate the FOREST SERVICE or COUNTY beyond the extent of available funds allocated or programmed for road development or operation, or contrary to applicable laws, rules, and regulations. 4. No Member of or Delegate to Congress, or Resident Commissioners, shall be admitted to any share or part of this Project Agreement, or to any benefit that may arise therefrom; but this provision shall lft� not be construed to extend to this Agreement if made with a corporation for its general benefit. `%Wrl 5. It is understood that those roads solely part of the COUNTY system, or those roads solely a part of the FOREST SERVICE system, are not considered as part of this Memorandum. 6. A map showing the joint system is attached and made part of this Memorandum. 7. We have read the foregoing and agree to accept and abide by the procedures herein.
