RESOLUTION NO. 88- J O d,
RESOLUTION APPOINTING THE EAGLE COUNTY DIVISION OF ANIMAL
REGULATIONS OFFICERS AS HEALTH OFFICERS FOR ENFORCEMENT OF RABIES
CONTROL PROVISIONS.
WHEREAS, The Eagle County Board of Health enacted an
order pursuant to 25-4-6-71, C.R.S., requirl vaccination of cats
against rabies on the day of and
WHEREAS, the Board of Health wishes to provide for a
means of enforcement of its Order requiring rabies vaccination; and
WHEREAS, the Board of County Commissioners of Eagle
County, on November 25, 1985, passed "A Resolution For The Control
and Licensing of Dogs," which provides for the control and
licensing of dogs in the unincorporated areas of Eagle County, and
whereas aforementioned Resolution is retained; and
WHEREAS, the County of Eagle, Colorado, has established
a Division of Animal Regulation charged with enforcing county
enactments concerning animals;
WHEREAS, 25 -1 -505 C.R.S. provides for appointment by the
Public Health Administrator of personnel required by the
department;
PLOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Public Health Administrator is hereby directed
to designate the Eagle County Division of Animal Control Officers
as health officers for the purposes of enforcing the Board's Order
concerning vaccination of animals for rabies, and the provisions
of Colorado Revised Statutes, Part 6, Article 4, Title 25.
THAT, the Board intends that these special purpose health
officers be empowered to take any actions a health officer is
permitted to take by 25 -4 -601 et seq. C.R.S., and to enjoy the
immunities provided by 25 -4 -613 C.R.S.
THAT the appointment shall become effective upon the
approval of the Board of County Commissioners of Eagle County,
Colorado, allowing the Eagle County employees to assume the
additional duties and authority set forth above.

THAT the Eagle County Division of Animal Control Officers
are hereby authorized to accept designation as health officers by
the Eagle County Board of Health for the limited purpose of Part
6 of Article 4, Title 25, C.R.S. concerning rabies control.
THAT, the Board finds, determines and declares that this
Resolution is necessary for the public health, safety and welfare
of the citizens of the County of Eagle, State of Colorado.

ORDER REQUIRING INOCULATION OF CATS AGAINST RABIES.
WHEREAS, rabies is virtually 100 per cent fatal once
established in a human body;
WHEREAS, rabies has proven itself to be endemic in Eagle
County's wild animal populations;
WHEREAS, ?art 6 of Article 4 of Title 25, Colorado Revised
Statutes authorizes county boards of health to order certain
actions on part of cat owners to prevent the transmission of rabies
to man via these domestic pets:
NOW, THEREFORE, BE IT ORDERED BY THE BOARD OF HEALTH OF EAGLE
COUNTY, COLORADO:
THAT, all cats in -he unincorporated areas of the Countv of
Eagle, Colorado be vaccinated against rabies at the age of three
months and each year thereafter on an annual basis. Such
vaccination shall be performed by a licensed veterinarian at the
expense of the animal owner.
THAT, the Health Department is directed to establish a notice
and procedure for treatment and confinement by the owner of cats
suspected of having rabies, as required by 25 -4 -605, C.R.S.
THAT, it shall not be lawful for any owner of any cat which
has not been inoculated as required by this order to allow such
animal to run at large. The Eagle County Animal Control Officers
may capture and impound any such cat found running at large. The
department shall determine policy and procedures for confinement
and disposal of such animals.
THAT, as provided by statute, any person who refused to comply
with or who violates the provisions of this order or 25 -4 -601 et
seq., is guilty of a misdemeanor, and, upon conviction thereof,
shall be punished by a fine of not more than 5100 or by
imprisonment in the County jail for not more than 30 days for each
offense. Offenses may be prosecuted by the District Attorney,
acting within his discretion.
THAT, this order shall become effective 24 hours after
publication in an newspaper of general circulation in Eagle County.
