COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION N0. 88-
APPROVAL OF SPECIAL USE PERMIT - Mountain Built Log Homes
FILE NO. - ZS- 270 -88
WHEREAS, Mark Becker did file an application with the
Eagle County Department of Community Development on or about
June 3, 1988 within the Resource Zone District; and
WHEREAS, based on the evidence, testimony, exhibits, study of the
Master Plan for the unincorporated areas of Eagle County and the Eagle
County Airport sub -area plan, comments of public officials and agencies,
the recommendation of the Eagle County Planning Commission, and comments
from all interested parties, the Board of County Commissioners of the
County of Eagle, State of Colorado, finds as follows:
1. That proper publication and public notice was provided as
required by law for the hearing before the Planning Commission
and the Board of County Commissioners.
2. That the proposed special use conforms to the requirements of
Section 2.09 of the Eagle County Land Use Regulations.
3. That the proposed land use will be compatible with existing
uses in the area.
4. That for the above - stated and all other reasons, the proposed
zoning is in the best interest of the health, safety, morals,
convenience, order, prosperity and welfare of the citizens
of Eagle County.
NOW, THEREFORE, BE IT RESOLVED, by the Board of County Commissioners
of the County of Eagle, State of Colorado:

That the application of Mark Becker , File No. ZS- 270 -88 ,
for approval of a special use of contractors yard within the
Resource Zone District in the following described unincorpor-
ated area of Eagle County be approved:
The SE-14 NE-4 of Section 9, Township 5 South, Range 85 West of the
6th Principal Meridian, according to the Survey under which patent
issued, said land being described according to the Resurvey as follows:
A tract of land situate in Tract 60 of Sections 9 and 10,
Township 5 South, Range 85 West of the 6th Principal Meridian being
more particularly described as follows:
Beginning at Angle Point 6 of said Tract 60, thence South 00001'38"
E. 1322.33 feet to Angle Point 7 of said Tract 60, thence South 89044'25"
E. 1318.58 feet to Angle Point 8 of said Tract 60, thence N. 00013'20" E.
1324.59 feet along the easterly line of said Tract 60, thence N. 89050'20"
W. 1324.34 feet to Angle Point 6 of Tract 60 the point of beginning.
Together with a road and utility easement 40 feet in width lying
immediately adjacent to and westerly of the easterly line of said
Tract 60, extending southerly from the apparent centerline of a county
road as built and in place to the northern line of the above described
tract, being approximately 1325.56 feet in length.
COUNTY OF EAGLE, STATE OF COLORADO.
THAT the following conditions shall be placed upon this approval
and that violation of any condition shall be the basis for revocation
of the permit:
1. Spring Creek Road must be improved in accordance with the
"Off -site Improvements and Landscaping Agreement" before
any non - residential building permits will be issued.
2. The landscaping plan must be collateralized in the amount
of $2,470.00
3. This special use permit is limited to the North Eastern
', of the property which is approximately 10 acres.

THAT the Board of County Commissioners directs the Department of
Community Development to provide a copy of this Resolution to the applicant.
MOVED, READ, AND ADOPTED by the Board of County Commissioners of
the County of Eagle, State of Colorado, at its meeting held the
