HomeMy WebLinkAboutR88-072 Approval of PUD for Mid Valley Commercial CenterCommissioner moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 88- -7,Q IN RE THE MATTER OF THE REQUEST FOR APPROVAL OF THE PLANNED UNIT DEVELOPMENT SKETCH PLAN FOR MID-VALLEY COMMERCIAL CENTER FILE NO. PD-273-88-3 WHEREAS, on or about March 30, 1988, the County of Eagle, State of Colorado accepted for filing an application submitted by Gene Orange and Steve Isom (hereinafter "Applicant") for approval of the Planned Unit Development sketch plan for Mid - Valley Commercial Center, at the northern intersection of Willits Lane and Highway 82, in El Jebel, Colorado, File No. PD-273-88-5; and WHEREAS, the Applicant requested the approval of a Planned Unit Development (PUD), sketch Dian which would allow for the development of a large retail, commercial and office center. The site is designed with a major retail grocery store of 30,000 scare feet, anchoring adjoining retail uses of up to 55,200 sqare feet. Also, proposed is 28,800 scare feet of office space along the southern boundary of the parcel; and WHEREAS, notice of the sketch plan wras given to all proper agencies and departments as required by Eagle County Land Use Regulations, Section 2.17.02(1); and WHEREAS, at its public hearing held may 18, 1988, the Planning commission, based upon its findings, recommended approval of the proposed PUD sketch Dian; and WHEREAS, at its regular hearing of May 24, 1988, the Eagle County Board of Commissioners (hereinafter "Board"), considered the PUD sketch plan, associated plans, and the statements and concerns of the Applicant and the Eagle County Staff. Based on the evidence before it, THE BOARD FINDS AS FOLLOWS: 1. The proposed sketch Dian is in conformance with the Master Plan, policies, guidelines, zoning and other applicable regulations. 2. The land included in the proposed sketch plan is suitable for subdivision. 3. Comments and recommendations from the agencies listed in Eagle County Land Use Regualtions, Section 2.17.02(1) have been considered. 4. Evidence shows that the parcel of land proposed for subdivision has access to the state highway system capable of servicing the development. NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application for approval of the Planned Unit Development sketch plan for Mid - Valley Commercial Center be and is hereby granted subject to the following conditions: 1. That the Environmental Impact Report be waived. 2. That preliminary plan submittal include a market analysis study, and that the issue of employee housing be fully addressed. These items shall be in addition to the standard preliminary plan requirements. The Board finds, determines, and declares that this Resolution is necessary for the health, safety, and welfare of the inhabitants of the County of Eagle, State of Colorado.
