HomeMy WebLinkAboutR88-044 Western Eagle County Ambulance District Service PlanCommissioner S7'j4 o J moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 88. -9y CONCERNING SERVICE PLAN FOR THE WESTERN EAGLE COUNTY AMBULANCE DISTRICT EAGLE, COUNTY, COLORADO WHEREAS, a Service Plan, supporting documents and a processing fee in the amount of $200.00 have been filed relating to the proposed Western Eagle County Ambulance District, in Eagle County, Colorado (hereinafter "District "); and WHEREAS, the provisions of Part 2 of the Special District Act require that a public hearing be called and held within thirty (30) days concerning the adequacy of the Service Plan. NOW, THEREFORE BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: Section 1. That the Board of County Commissioners hereby acknowledges that the District filed the Service Plan on April 22, 1988. Section 2. That a public hearing on the Service Plan for the proposed Western Eagle County Ambulance District be and the same is hereby set for 11:00 o'clock a.m., at Commissioners' Hearing Room, the regular meeting place of the Board of County Commissioners, on Monday, the 23rd day of May, 1988. Section 3. That the Clerk of this Board is hereby directed to cause the Notice of Hearing to be published in the Eagle Valley Enterprise, a newspaper of general circulation within the County, once a week for a period of three successive weeks, by three publications, the first of which shall be at least twenty (20) days prior to the date of the public hearing. Section 4. That the Clerk is hereby further directed to provide written notice of the hearing to the petitioners and to the governing body of any existing municipality or special district which has levied an ad valorem tax within the next preceding tax year and which has boundaries within a radius of three (3) miles of the proposed district. Section 5. That said Notice of Hearing shall be in substantially the following form: • NOTICE OF HEARI n i� PUBLIC NOTICE IS HEREBY GIVEN that there were filed with County Clerk and Recorder of Eagle County, Colorado (the "County "), a Service Plan and related documents for the proposed Western Eagle County Ambulance District (the "District "). The Service Plan and related documents are now on file in the office of the County Clerk and Recorder and are available for public inspection. NOTICE IS FURTHER GIVEN that, by order of the Board of County Commissioners of Eagle County, Colorado, a public hearing on said Service Plan and related documents will be held at the McDonald Building, 551 Broadway, in Eagle, Colorado, at 11:00 a.m., on Monday, the 23rd of May, 1988. The purpose of the hearing shall be to consider the adequacy of the Service Plan of the proposed District and to form a basis for adopting a resolution approving, conditionally approving, or disapproving the Service Plan. The proposed District is located entirely within the County and generally includes all of that portion of Eagle County West of State highway 131 except for that portion of Eagle County served by the Roaring Fork, Pitkin County RE1J School District. The District is more particularly described as follows: BOUNDARIES OF WESTERN EAGLE COUNTY AMBULANCE DISTRICT Beginning at a point on the County line between Eagle County and Routt County, which is also the Northwest corner of Section 6, Township 2 South, Range 83 West of the 6th Principal Meridian; Thence South along the West line of Range 83 West to the Northwest corner of Section 6, Township 5 South, Range 83 West of the 6th Principal Meridian; Thence East along the North line of Township 5 South to the Northwest corner of Section 3, Township 5 South, Range 83 West of the 6th Principal Meridian; Thence South along the Section lines to the Southwest corner of Section 34, Township 5 South, Range 83 West of the 6th Principal Meridian; Thence East along the North line of Township 6 South to the Southwest corner of Section 35, Township 5 South, Range 82 West of the 6th Principal Meridian; Thence South along the Section lines extended for approximately 9 miles, to a point approximately 5 miles northerly of the County line between Eagle and Pitkin Counties; Thence West in unsurveyed territory for 15 miles, more or less, to a point due south of the East line of Section 31, Township 6 South, Range 84 West of the 6th Principal Meridian; Thence due -2- • • north for 3 miles, more or less, to the Southeast corner of said Section 31, Township 6 South, Range 84 West of the 6th Principal Meridian; Thence West for 10 miles, more or less, to the Southwest Corner of Section 33, Township 6 South, Range 86 West of the 6th Principal Meridian; Thence North along the West line of Range 86 West, 906.18 feet, more or less, to the Southeast corner of Section 36, Township 6 South, Range 87 West of the 6th Principal Meridian; Thence West along the South line of Township 6 South for 2.5 miles, more or less, to the South 1/4 corner of Section 34, Township 6 South, Range 87 West of the 6th Principal Meridian; Thence North for 1/2 mile, more or less, to the center of said section 34, Township 6 South, Range 87 West of the 6th Principal Meridian; Thence West for 1 mile, more or less, to a point on the West boundary line of Eagle County; Thence North along the West boundary line of Eagle County for 28 miles, more or less, to the Northwest Corner of Eagle County; Thence East along the North boundary line of Eagle County for 19 miles, more or less, to the point of beginning. Pursuant to Section 32 -1 -204 (3.5), C.R.S., as amended, any person owning property in the proposed District may file a request that his property in the proposed District may file a request that his property be excluded from the proposed District prior to approval of the Service Plan. Such a request must be submitted to the Board of County Commissioners no later than ten (10) days prior to the day fixed for the public hearing on the Service Plan. That the Clerk is hereby further directed to deliver a copy of the Service Plan to the County Planning Commission, with the direction that the Commission shall study the Service Plan and that a representative thereof shall present its recommendations to the Board of County Commissioners. Section 8. That the Board of County Commissioners of Eagle County, Colorado, does hereby waive the requirement of the Special District Act providing at least ten (10) days prior to the regular meeting of the Board of County Commissioners. Section 9. That all resolutions or parts thereof in conflict with the provisions hereof be and the same are hereby repealed. Section 10. That this Resolution, immediately upon its passage, shall be recorded in the Book of Resolutions of the County kept for that purpose and shall be authenticated by the signatures of the Chairman of the Board of County Commissioners and the County Clerk and Recorder.
