BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 88- 33
CONCERNING A PETITION FOR THE FORMATION
OF THE EAGLE COUNTY PEST CONTROL DISTRICT
WHEREAS, on April 4, 1988, the Board of County
Commissioners of the County of Eagle, State of Colorado (the
"Board "), accepted for filing a petition for the formation of a
pest control district, pursuant to Section 35 -5 -101, et seq.,
C.R.S.; and
WHEREAS, the Board has examined said petition to ensure
that it is in order and properly signed by at least twenty -five
percent of resident landowners and resident lessees as those
terms are defined at Sections 35 -5- 101(12) and (12.1), C.R.S.,
respectively; and
WHEREAS, the term "landowner" is defined at Section
35 -5- 101(7), C.R.S., as a person, firm, corporation or associa-
tion owning five or more acres of land within the boundaries of
the proposed district; and
WHEREAS, the term "lessee" is defined at Section 35-
5- 101(7.1), C.R.S., as a person, firm, corporation or association
leasing five or more acres of state -owned land controlled by the
state board of land commissioners within the boundaries of the
proposed district; and
WHEREAS, in accordance with Section 35- 5- 101(12),
C.R.S., the term "resident landowner" means a person, firm,
corporation or association who owns five or more acres of land
and who has legal residence within the boundaries of the proposed
district; and
WHEREAS, in accordance with 35 -5 -101 (12.1), C.R.S.,
"resident lessee" is a person, firm, corporation or association
leasing five or more acres of state -owned land controlled by the
state board of land commissioners and who has legal residence
within the boundaries of the proposed district.
THE BOARD FINDS:
That the petition is in order and has been properly
signed by twenty -five percent of the resident landowners and
resident lessees within the proposed district, and in all other

respects complies with the applicable provisions of Part 1,
Article 5, Title 35 of the Colorado Revised Statutes.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board designates the Eagle County Clerk and
Recorder to mail ballots in the form attached hereto as Exhibit A
on April 19, 1988, as required by Section 35-5-104(3), C.R.S., to
all landowners and lessees within the proposed district to the
addresses as shown by the Eagle County Assessor and the State
Board of Land Commissioners, stating that the ballots are to be
returned to the office of the Board within ten days from the date
of mailing, i.e., on or before April 29, 1988.
THAT, the Clerk and Recorder is further designated to
receive and tally the ballots and to deliver the results to the
Board at its regular public meeting of May 9, 1988.
THAT, the Departments of the County Attorney and Data
Processing are directed to provide assistance to the Clerk in
performing the above tasks.
MOVED, READ AND ADOPTED by the Board of County
Commissioners of the county of Eagle, State of Colorado, at its
regular meeting day of 1988.

in the box be established pursuant to the provisions of
of choice. Article 5 of Title 35 of the Colorado Revised
Statutes in all of Eagle County, Colorado, except-
ing that property within the municipal boundaries
Yes of the Town of Avon, the Town of Basalt, the Town
of Eagle, the Town of Gypsum, the Town of Minturn,
the Town of Red Cliff, and the Town of Vail, to
protect against Leafy Spurge, Musk Thistle, White
No Top, Canada Thistle, Russian Knap Weed, and Yellow
Toad Flax.
THIS BALLOT TO BE RETURNED TO THE OFFICE OF THE BOARD OF COUNTY
COMMISSIONERS BY APRIL 29 , 1988 .
