Colorado, by that certain Mortgage Deed, dated the 29th

fully served; for other good and valuable consider
NOW THEREFORE, In consideration of the premises, ands ar,
the receipt whereof is hereby acknowledged, the said Board of County Commissioners of Eagle

M O R T G A G E D E E D
THIS INDENTURE, Made this 29th day of April, 1981,
between WILLIAM M. HIGNETT, of the County of Pitkin and
State of Colorado, of the first part, and THE BOARD OF
COUNTY COMMISSIONERS OF EAGLE COUNTY, COLORADO, of the
second part, whose legal address is P.O. Box 850, Eagle,
Colorado 81631, WITNESSETH:
That the said party of the first part, for and in
consideration cf the sum of One Dollar and Other Good and
Valuable Considera Lion to him in hand paid by the said party
of the second part, the receipt whereof is hereby acknowl-
edged, does hereby grant, bargain, sell and convey unto the
said party of the second part, its successors and assigns,
the following described lots or parcels of land situate,
lying and being in the County of Eagle and State of Colo-
rado, to -wit:
Lots 1, 21 31 19, 20, 21, 22, 23, 44 and 45
BLUE CREEK RANCH SUBDIVISION
TO HAVE AND TO HOLD the same, together with all and
singular the privileges and appurtenances thereunto belong-
ing forever; Provided always, that if the said party of the
first part, his heirs, executors or administrators, shall
perform all of the obligations of the Subdivider set forth
in that certain Subdivision Improvements Agreement dated
April 29, 1981, between said party of the first part, as
"Subdivider", and said party of the second part, as "County",
in accordance with the terms, conditions and provisions -
contained therein, the value of such contractual performance
being evidenced by promissory note in the amount of $680,500.00
bearing even date herewith, then these presents shall be
null and void, otherwise to remain in full force and effect.
That the said party of the first part, for himself, his
heirs, successors and assigns, for the consideration afore-

said, covenants and agrees to and with the said party of the
second part, its successors and assigns, that he holds the

t said premises by title in fee simple; that the same are free
and clear of all liens and encumbrances except taxes for
1981, due in 1982; reservations and exceptions contained in
United States Patent; existing easements and rights -of -way,
and prior recorded reservations or exceptions of oil, gas
and other minerals; that he will pay in due season all taxes
and assessments levied on said premises, that he will pay
the costs and attorney's fees incurred by said party of the
second part, its successors and assigns, in any foreclosure
action, other suit or proceeding, by reason hereof; and that

upon default in -the performance of such Subdivision Improve-
ments Agreement and payment of said note or any part thereof,
or any of the interest thereon, or upon the breach of any of
the covenants or agreements herein contained; this mortgage
may be forthwith foreclosed.
IN WITNESS WHEREOF, the said party of the first part
has hereunto set his hand and seal the day and year first
above written.
