COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 88 -�
Authorizing Animal Shelter Staff to Sign
Animal Adoption Contracts
WHEREAS, the County of Eagle, State of Colorado, by and
through its Board of County Commissioners, hereinafter
referred to as the "Board," operates Eagle County Animal
Control and Animal Shelter, State of Colorado, hereinafter
referred to as "Animal Control" and "Shelter ", respectively;
and
WHEREAS, the Shelter is contracted to provide service to
Eagle County and operates in conjunction with Animal Control;
and
WHEREAS, the Board has previously executed adoption
contracts for animals acquired from the Shelter; and
WHEREAS, the Board desires to adopt a form adoption
agreement as set forth in Exhibit A attached hereto and
incorporated herein by this reference, for such adoption of
animals from the Eagle County Animal Shelter; and to designate
the Shelter's and Animal Control's personnel as the Board's
duly appointed representatives to execute the same.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby adopts the form adoption agreement
for adoption of animals from the Eagle County Animal Shelter,
as the same is set forth in Exhibit A attached hereto.
THAT, the Board hereby designates Animal Control's and
Shelter's personnel as its duly appointed representatives and
agents to execute said form adoption contracts on behalf of
the Board.
THAT, except for the filling in of required information
in the blank spaces provided therein, said form adoption
contract shall not be altered, modified, amended, and /or
changed prior and /or subsequent to the execution of same by
adopter, without the prior written consent of the Board.
THAT, such appointment of Animal Control's and Shelter's
personnel as the Board's designated representatives shall only
extend to those adoption contracts which have not whatsoever
been altered, modified, amended and /or changed prior to and /or
subsequent to the execution of same by the respective parties;
and the Board shall not be bound by the terms of any adoption
contract signed by Animal Control's and Shelter's personnel
which has been altered, modified, amended and /or changed
without prior written consent of the Board.
THAT, the Board hereby finds, determines and declares
that this Resolution is necessary for the public health,
safety and welfare of the County of Eagle, State of Colorado.
THAT, the provisions of this Resolution shall be effec-
tive immediately.
MOVED, READ AND ADOPTED by the Board of County Commis-
sioners of the County of Eagle, State of Colorado, at its
regular meeting held the day of March, 1988.

1. Eagle County, acting through its Animal Shelter, agrees as
follows:
a. To give the Adopter (or Adopters) possession of and
control of the animal described above, for so long as the
Adopter complies with the terms of this contract.
b. To refund any fees paid for adopting this animal, or to
exchange the animal, if the animal is found to be in poor
health (as defined in paragraph 2a below) and is returned to
the Shelter or dies of natural causes within 14 days of the
date of this contract. If any animal so taken on exchange
proves to be in poor health (as defined in paragraph 2a), the
Shelter agrees to allow a second animal exchange within 14 days
of the first exchange. No refund shall be given for any reason
after 14 days of the date of this contract.
2. In return, the Adopter (or Adopters) agrees to the following:
a. To take the animal to a veterinarian within three days for
a general check -up and any necessary vaccinations, worming
medications or other minor treatment, at the Adopter's expense.
If the animal proves to be in poor health and major treatment
is necessary, the Adopter may return the animal to the Shelter
for a refund. To obtain a refund, the Adopter understands that
the Adopter must obtain a written confirmation of the state of
the animal's health and of the necessity for major veterinarian
treatment, and present such confirmation to the Eagle County
Animal Shelter. The decision as to whether or not a treatment
is major shall be at the sole discretion of Eagle County.
b. To accept the animal as is and to assume all risks of
ownership. The Adopter releases the Shelter and it employees
from any liability associated with any illness of, or damage
caused by, the adopted animal. The Adopter is prepared to
assume financial responsibility for caring for the animal,
including, but not limited to, inoculations, veterinary care,
and boarding fees. If the Adopter returns the animal to the
Shelter or the Shelter demands the animal's return, the
Adopter will make no charge of any kind to the Shelter.
C. To obtain a license for the animal, as required by law,
and to have the animal vaccinated against rabies, and generally
to comply with all laws concerning the keeping of a pet animal.
d. To provide adequate food, water, shelter, exercise,
medical care, and generally to care for the animal in a devoted
and humane manner.
e. To return the animal to the Eagle County Animal Shelter if
the Adopter no longer desires or no longer is able to keep the
animal, and not to sell, trade, give away, or abandon the
animal. The Adopter agrees to pay to Eagle County the sum of
$500.00 should the Adopter return this animal to its former
owner. If the animal is lost, the Adopter shall make every
effort to recover it.
f. To have the animal spayed or neutered by a veterinarian of
the Adopter's choice not later than or
return the animal to the Eagle County Animal Shelter /Animal
Control upon demand. If for ANY reason whatsoever, this
animals is not neutered, the Adopter forfeits any fees paid to
the County.
