INTERGOVERNMENTAL AGREEMENT
TO ESTABLISHA TASK FORCE EXPLORING RECREATION
USES OF THE MT. SOPRIS TREE FARM
THIS RGOVERNMENTAL AGREEMENT (the "Agreement),
made thisZj y of -.1 v 0 (�' 1999, by and between the Board
of County Commissioners of Pitkin County, Colorado, whose address is 530
East Main Street, Aspen, Colorado ("Pitkin"), the Board of County
Commissioners of Eagle County, Colorado, whose address is 500 Broadway,
Eagle, Colorado ('Eagle"), and the Town of Basalt Board of Trustees, whose
address is 101 Midland Avenue, Basalt, Colorado ('Basalt"). Pitkin, Eagle
and Basalt are sometimes collectively referred to as the "Governments."
RECITALS
WHEREAS, this Agreement is entered into pursuant to, inter alia,
C.R.S. Section 291-1-201, et. seq. and Article XIV, Section 18 of the
Colorado Constitution; and
WHEREAS, the Governments are duly constituted governmental
entities, governed by Boards elected by qualified electors of the Counties
and Town mentioned above, all of whom are located in Colorado; and
WHEREAS, the purpose of this Agreement is to establish a citizen
task force to advise the Governments with respect to. recreation uses on
land known as the Mt. Sopris Tree Farm; and
WHEREAS, the Governments are authorized to enter into this
Agreement and have determined it is in the best interest of the citizens of
Pitkin, Eagle and Basalt to enter into this agreement; and
WHEREAS, the property known as the Mt. Sopris Tree Farm was
granted to the governments of Eagle and Pitkin by the United States Forest
Service, pursuant to Public Law 103-255 on May 19, 1994, in exchange
for several wilderness mining claims; and
WHEREAS, the governments of Eagle and Pitkin, pursuant to the
Mt. Sopris Tree Nursery Acquisition Agreement dated March 31, 1988,
agreed that the long-term management of the property shall be for
recreational, park, open space, and government -related purposes; and
WHEREAS, the Mt. Sopris Tree Farm property is located at State
Highway 82 and Valley Road in EI Jebel and is owned and maintained by
Eagle pursuant to the Mt. Sopris Tree Farm Agreement with Pitkin; and
WHEREAS, the Mt. Sopris Tree Farm Master Plan, adopted by Eagle
on January 17, 1996, incorporates such uses as being contemplated by the
Governments; and
WI -AREAS, Basalt contributed approximately $30,000 to develop a
Tree Farm Recreation Plan; and
WHEREAS, many mid -valley residents and groups with interest in
the recreational development of the tree farm, including Soccer, Baseball and
TreePac groups have spent considerable time and money developing the Tree
Farm Recreational Plan;
NOW THEREFORE, the Governments make the following
agreement:
AGREEMENT
1. Task Force, The Task Force shall consist of seven (7)
members. Eagle, Pitkin and Basalt, through a public process, shall each
appoint two (2) members to the Task Force. One member, who shall be a
Garfield County resident, shall be selected by Eagle and appointed to the
Task Force upon the approval of the Governments. The Task Force shall
operate for one (1) year commencing on July 1, 1999.
2. Task Force Resnonsibilities. The Task Force shall advise the
Governments regarding the following items:
a. Recommendation of long-term management of the Mt. Sopris
Tree Farm property (the "Property") on issues related to recreation, park
and open space.
b. Recommendation of priorities for recreational, park and open
space community needs on the Property.
c. Development of a plan for the formation of a recreation
district to serve the residents of the mid -valley areas of Pitkin, Eagle and
Basalt.
d. Identification of funding sources for the support of a
recreation district.
e. Recommendation of grant opportunities* for interim or long
range development and operation of recreation, park and open space on the
Property.
f. Development of appropriate lease options which comply with
the master plan for the property.
3. Reporting Obli atio is. The Committee shall report its

findings on the above -referenced items to the Governments on a monthly
basis.
4. Current Year Obligations,_The parties acknowledge and agree
that any payments provided for hereunder or requirements for future
appropriations shall constitute only currently budgeted expenditures of the
parties.* The parties ob)-.gations under this agreement are subject to each
individual party's annual right to budget and appropriate the sums
necessary to provide the services set forth herein. No provision of this
agreement shall be construed or interpreted as creating a multiple fiscal
year direct or indirect debt or other financial obligation of either or both
parties within the meaning of any constitutional or statutory debt
limitation.
5. Funding. The Governments agree to equally fund the Task
Force by providing cash contributions not to exceed $2,500 per entity. The
Task Force shall submit their budget to the Governments by August 1,
1999, identifying the exact cash contribution required.
6. Staffing. Eagle shall provide staff support to the Task Force.
This contribution shall be in addition to Eagle's required cash contribution.
7. Modification, This Agreement may be changed or modified
only in writing only by an agreement approved by the respective Boards of
Governments and signed by authorized officers of each party.
8. Severabilft
,y, Should any one or more sections or provisions
of this Agreement be judicially adjudged invalid or unenforceable, such
judgment shall not affect, impair, or invalidate the remaining provisions of
this Agreement, the intention being that various sections and provisions
hereof are severable.
9. Notices, Any notice required or permitted under this
Agreement shall be in writing and shall be hand delivered by registered
mail, postage pre -paid to the addresses of the parties as follows. Any party
by notice sent under this paragraph may change the address to which
further notices should be sent.
