Also enclosed is a copy of our infiltrator calculations, and the design layout. The percolation tests were performed on May 31, 1997 in the vicinity of the proposed absorption field, refer to site plan. Three 6-inch diameter percolation test holes were dug to depths of approximately 30 inches. The approximate locations for the percolation test holes are shown on the site plan, refer to Figure No. 1. The test holes were filled with water 24 hours prior to the actual testing to allow the soils to inundate. The water levels were measured to a relative constant rate. The percolation rates varied from approximately 25.5 to 30 minutes per inch. Although the percolation test holes and profile pits were dug to obtain a reasonable accurate determination of the absorptionfield conditions, variations in the subsurface conditions are also possible. Variations that exist beneath the absorption field may become evident during the excavation. A representative from our office should observe the completed excavationto confirm that the soils encountered are as indicated by the soils profile hole. We used heavy plastic sheeting (8 mil) and several loads of topsoil over the sheeting. This has stopped any leakage until we get the new infiltration field and pump system installed. I went can vacation the second and third weeks of June, and Intermountain did not get the plans to me before I left. I am now in the process of getting bids from contractors on the county's approved list of contractors. I hope to have a contractor selected later this week. In response to a complaint, on January 20, 1997, the Eagle County, Colorado, Division of Environmental Health investigated the Individual Sewage Disposal System ("ISDS") serving the property.located at 0284 Eagle Crest Road, South Duplex, Lot 34, Lake Creek Meadows, Tax Parcel #2105-181-02-021, owned by Martin and Jacqueline Hijmans. The investigation showed that the system was failing, effluent was saturating the ground and seeping onto the surface of the ground, and the system was not functioning in compliance with Eagle County Land Use Regulations, Chapter 4. 2. After verbal notification, Mr. Hijmans made application for a repair of his system on January 22, 1997. 3. Written notice of "violation and notice of hearing pursuant to ECLUR 4.03.24, dated August 11, 1997, was mailed to Mr. Hijmans, receipt of which on August 20,1997 was acknowledged by him. The notice was also hand -delivered to Mr. Hijmans when he came into the Eagle County Community Development Office on August 11, 1997. The notice stated that the issuance of the ISDS repair permit was imminent pending your identification of a licensed septic installer. 4. A permit for the construction of new ISDS systems for the respective properties, per engineering drawings, was issued to Gophir Excavating, on behalf of Mr. Hijmans, on August 14, 1997. 5. The hearing was held on August 20, 1997, at 1:00 p.m. 6. The Individual Sewage Disposal System serving the south duplex on the property is not functioning in compliance with the ECLUR and Title 25, Article 10 of the Colorado Revised Statutes. 7. The Individual Sewage Disposal System serving the south duplex on the property has not been repaired. The system has not received timely repair as required by ECLUR paragraph 4.03.06. 8. The failure of the Individual Sewage Disposal System serving this property constitutes a nuisance or hazard to public health. 9. Written notice of this hearing was given to Mr. Hijmans more than 48 hours in advance of the hearing. THEREFORE, IT IS ORDERED, pursuant to Eagle County Land Use Regulations paragraph 4.03.25 and C.R.S. 25-10-106: 1. That Mr. and Mrs.. Laura informed Mr. Hijmans that the fees for the repair would be waived if the application was submitted within 2 days of the notification. He did come in the same day and filled out the application. 5. 2/3/97 Environmental Health received a letter from Mr. Hijmans stating Richard Ricks and Jim Gabriel from Inter -Mountain Engineering had done a site inspection of the failing septic, and that he was awaiting a proposal from them regarding the repair. He also indicated that his family had cut back on water usage to help minimize the problem. 6. 2/5/97 Laura spoke to Richard Ricks regarding the proposal, and he indicated he would be sending it to Mr. Hijmans within one week. 7. 3/17/97 Laura contacted Jacqueline Hijmans and told her we needed the proposal. 8. 3/18/97 Janet Kohl received a call from Larry Berman regarding the status of the situation. She contacted Jim Gabriel of Inter -Mountain Engineering to see if the proposal had been accepted by the Hijmans. Inter -Mountain had not heard back from the Hijmans regarding the proposal. 9. 3/26/07 Environmental Health received a copy of Inter -Mountain's proposal, dated 2/5/97, from Mr. Hijmans. 10. 5/5/97 Laura left messages for Mr. Hijmans at his home and his office requesting a design for the repair. 11. 5/6/97 Mr. Hijmans returned Laura's call and indicated that Inter -Mountain was holding up the process, and didn't have a design ready. He indicated that he might have to go with a different engineering company. 12. 5/15/97 Janet received a call from Mr. Berman regarding the status of the repair.. She again contacted Jim Gabriel of Inter -Mountain, and he said they still hadn't heard back from Mr. Hijmans. 13. 5/21/97 Laura contacted Richard Ricks of Inter -Mountain, and told him to submit a design for the repair by 5-30-97, or we would have to charge Mr. Hijmans $150 for the repair permit fee. She left a message for Mr. Hijmans indicating the same. 14. 5/28/97 Environmental Health received a call from Larry Berman stating that Inter -Mountain Engineering had gone out to the Hijmans, and that they were doing a temporary repair to the leach field. This was done without any notification to our office. 15. 5/31/97 Inter -Mountain Engineering performed a perc test at the Hijmans residence. Deadline for submittal of plans had passed. 16. 6/3/97 Environmental Health received the original design for the repair of the system. 17. 6/4/97 Laura reviewed plans and revisions needed with Richard Ricks. 18. 6/9/97 Revisions received and approved by Environmental Health. 19. 6/17/97 Laura spoke to Mr. Hijmans regarding the need for a licensed installer, and a current list of installers was sent to him. 20. 6/25/97 Laura spoke to Mr. Hijmans about the temporary repair of the system. She requested a letter indicating what had been done and what materials had been used. She also asked who would be installing the system. 21. 6/29/97 Environmental Health received the letter regarding the temporary repair. Still no indication of who installer would be. 22. 8/6/97 Notice of Violation, and Notice of Cease and Desist Hearing sent to Mr. and Mrs. Hijmans. 23. 8/11/97 Above notices returned to Environmental Health because of incorrect address.
