HomeMy WebLinkAboutC23-176 RA Nelson_amendmentCONSTRUCTION SERVICES AMENDMENT FOR THE EAGLE COUNTY OLD COURTHOUSE 2ND FLOOR REMODEL This Amendment dated the 2nd day of May in the year 2023, is incorporated into the accompanying Preconstruction and Construction Services Agreement for the Eagle County Old Courthouse 2nd Floor Remodel, form of agreement between the Owner and Contractor where the basis of payment is the Cost of the Work plus a Fee with a Guaranteed Maximum Price dated 03/24/2023 (the “Agreement”) For the following PROJECT: Eagle County OCH Office 551 Broadway, Eagle, Colorado 81631 The OWNER: Eagle County Government PO Box 850, Eagle, Colorado 81631 The CONTRACTOR: RA Nelson LLC PO Drawer 5400, Avon, Colorado 81620 A.1. CONTRACT DOCUMENTS The Contract Documents consist of this Amendment, the Agreement, Plans, Specifications, other documents listed in the Amendment, and Modifications issued after the execution of this Amendment. The Order of precedence of the Contract Documents shall be as follows: 1. Changes issued after the date of this Agreement. 2. Exhibit B – Basis of GMP (Qualifications & Clarifications) 3. Other Exhibits to this Contract 4. This Amendment dated May 2, 2023 5. The Agreement dated March 4, 2023 6. Submittals once reviewed by the Architect 7. The drawings and specifications A.2. CONTRACT SUM A2.1. The Owner shall pay the Contractor the Contract Sum in current funds for the Contractor’s performance of the Contract. The Contractor’s Fee: The Contractor’s Fee is a Stipulated Sum of $220,722.00 subject to adjustments as outlined in 1.3 A2.3. The method of adjustment of the Contractor’s Fee for changes in the Work: Additive change orders shall increase the Contract Sum and Guaranteed Maximum Price by the Cost of Wor k, plus a 11.90% Fee, inclusive of GC overhead & profit, Payment and Performance Bond Premiums, Builders Risk Insurance Premiums, and General Liability Insurance Premiums; plus Contingency and General Conditions to be determined on a case by case basis, subject to the Change Order “Fee Free Zone” as outlined in Article 5.4.2 of the Agreement. Deductive change orders shall reduce the Guaranteed Maximum Price only by the Cost of Work associated with the reduction in scope of the work for the deductive change order. For deductive changes no GC overhead & profit, Payment and Performance Bond Premiums, Builders Risk Insurance Premiums, General Liability Insurance Premiums, Contingency or General Conditions shall be included in calculating the reduction of the Guaranteed Maximum Price. A.3. GUARANTEED MAXIMUM PRICE A.3.1. Pursuant to Section 5.6 of the Agreement, the Owner and Contractor hereby amend the Agreement to establish a Guaranteed Maximum Price. The Guaranteed Maximum Price is an amount that the Contract Sum shall not exceed. A3.2. The Contract Sum is guaranteed by the Contractor not to exceed One Million, Eight Hundred Eighty Thousand, Two Hundred Eighty Seven Dollars and Zero Cents ($1,880,287.00), subject to additions and deductions by Change Order as provided in the Contract Documents. A3.3. The Guaranteed Maximum Price is based upon the following other documents and information: Exhibit A – List of Plans & Specs Exhibit B – Basis of GMP (Qualifications & Clarifications) Exhibit C – Schedule of Values Exhibit D – Equipment Rates Exhibit E – Schedule Exhibit F – List of Allowances Exhibit G – Summary of RFI’s A.4. DATE OF COMMENCEMENT AND SUBSTANTIAL COMPLETION A4.1. The date of commencement of the Work shall be 10 calendar days following receipt of a written notice to proceed with the Work, issued by the Owner in conjunction with the full building permit an the “Approved for Construction” drawings and specifications. The written Notice to Proceed with the Work, building permit and Approved Construction plans shall be delivered by the Owner to the Contractor no later than May 31, 2023. Unless otherwise provided, the Contract Time is the period of time, including authorized adjustments, allotted in the Contract Documents for Substantial Completion of the Work. The Contract Time shall be measured from the date of commencement of the Work. A4.3. Subject to adjustments of the Contract Time as provided in the Contract Documents, the Construction Manager shall achieve Substantial Completion of the entire Work, not later than 201 calendar days from the date of commencement of the Work. A4.4. If the Contractor fails to achieve Substantial Completion as provided in this Section A.4, liquidated damages shall be assessed as set forth in Section 4.1 of the Agreement. The Owner and Contractor have agreed to a 21 calendar day Liquidated Damages grace period, for payment ($300/day) associated with delays beyond the substantial completion date. RA Nelson will provide coordination of testing as part of the GMP agreement. 2) Building permit and plan review fees are paid for by the Owner. 3) Excluded are increases in scope of work dictated by any governmental entity (that is subsequently added as a requirement after the permit is released) including but not limited to, Building Department, Fire Department, DRB and any AHJ. 4) Contractors requested and submitted information shall be per the following: Requests for information and clarification shall be returned by the Design Team within 7 calendar days. Product Submittals shall be returned by the Design Team within 14 calendar days. 5) Pursuant to section 16.1. in the Agreement, the period of time of which the Owner, Architect, and Contractor shall inspect the work after receipt of the Contractor’s notice of completion of Work, shall change from (10) days to (2) days. 6) Design & Unforeseen Conditions is included as an Allowance. 7) It is assumed that existing on site power & water will be available for use during construction duration and paid for by Owner. 8) It is assumed that Internet WiFi or a hardline eithernet cable can be made available to the jobsite trailer for use by the Contractor. 9) The GMP pricing is inclusive of the Town of Eagle permit response comments, 3/22/23 answered RFI’s, the Revision 1 set dated 3/27/23, and the Scope Change & Value Engineering Log. 10) It is assumed any architectural digital backgrounds for construction will be provided to the General Contractor for distribution to subcontractors at no additional charge. 11) It’s assumed that the Contractor will be provided (12) parking spots for staging of the field trailer, dumpster, temp toilet and construction materials. These spots will be enclosed with a chain link fence. Division 2 – Site Work: 1) Asbestos testing & abatement is not included and shall be paid for by Owner. 2) If work is required in the vicinity of asbestos containing materials as identified in the initial AGW report dated April 12, 2023, RA Nelson will evaluate the need to abate materials after initial removal of the interior fixed finishes. 3) Work associated with demolition and removal of, and the handling of, hazardous materials is excluded. It is assumed that the initial demolition can be accomplished without disturbing or abating any potential asbestos containing materials. Division 3 – Concrete 1) All abandoned penetrations for MEP’s are assumed to be patched with concrete and is included in the GMP. 2) All new plumbing penetrations will be cored through the existing concrete pan deck floor system. Ground penetrating radar of slab is included and will be done before any cutting and/or coring of the slab. A total quantity of (5) penetrations are included within the cost of the core drilling and slab x-ray work. Division 4 – Masonry 1) Not applicable DocuSign Envelope ID: 8F171F6A-0E56-41BC-A796-388B046F4202 Division 5 – Steel 1) Not applicable Division 6 – Woods 1) All in-wall wood backing and blocking required for brackets and casework is included. In- wall backing for owner supplied items is excluded, unless noted on plans. 2) Fire treated wood is excluded for backing and blocking. 3) The existing wood baseboard in the elevator lobby is to be removed, salvaged and replaced. If in the event, the baseboard requires replacement, it will be done at Time and Materials. Division 7 – Thermal and Moisture Protection 1) Insulation at new metal framed interior walls is included as R11 unfaced batts. Existing interior insulation repair at exterior walls is included at locations disturbed by the Contractor. Insulation repairs and replacement will replace with similar or better. Submittals on repair work are excluded and will be documented with photos in daily logs. 2) We assumed that there is no applied fireproofing on the existing structure. Patch / repair or code upgrades to any applied fireproofing is excluded. 3) Fire caulking rated assemblies are included as fire caulking sealant only. Putty packs and specialty firestopping components are excluded. 4) Exterior flashings and sealants are excluded. Exterior modifications are not identified in project scope. Division 8 – Doors and Windows 1) Door frame, side lite and clerestory windows are included as hollow metal frames. The side lites and clerestory window frames will have integral glass stops with a glass bead on the opposing side and exposed screw fasteners. The hollow metal will be field painted to match existing frames. 2) Glass for door lites, side lites and clerestory windows are included as ¼” clear tempered. 3) Frosted film finish is included as Llumar Frost Series. Division 9 – Finishes 1) Drywall finish to be a level 4, to match existing. 2) Drywall walls consist of 3 5/8” and 6”, 20 gauge metal stud with 1 ¼” bottom track 3) Ceiling systems are inclusive of the following: • Cirrus Tegular ceiling tile with 15/16” white standard duty suspension system • Shadow molding at all ACT perimeters • 6” Axiom trim at all ACT to wood ceiling transitions • Barz + Brilliance baffle system included as 2” W x 6” D, 8” O.C., model B206008 in Oak Line S22 finish • Axiom trim at all transitions between Barz + Brilliance baffle system and drywall ceilings, and transitions between Barz + Brilliance baffle system and ACT ceilings • The Focal Point Diffusers in the Collaboration Area have been removed from the scope of work. Skimming of the entire perimeter wall is excluded. 5) A floor leveling and grinding is included as an Allowance. 6) LVT flooring is included as No Reservations Xpress Wood in a Brazen NR194 finish. Rubber base is included as Roppe 129 Dolphin. GMP includes painting the exposed HVAC ceiling above the acoustical baffle system flat black. 9) Patch & Repair of finished in adjacent unit for MEP relocations is included as an Allowance. 10) The acoustical wall panel at the waiting/reception area has been removed from the scope of work and is excluded. A drywall and paint finish is included in this area. Division 10 – Specialties 1) Not applicable Division 11 – Equipment 1) Existing lab refrigerator shall be removed, salvaged, and reinstalled upon project completion. 2) Refrigerator and microwave are included as the following: a. Unique Appliances UGP-275L b. Galanz GLCMKA07RDR-07 3) Existing owner furniture removal, off-site storage, and reinstallation is included as an Allowance. Division 12 Furnishings 1) All cabinetry and built-in casework is included as ¾”, edge banded melamine box construction. 2) Cabinet pulls are included as Emtek 5” Trinity 3) Window coverings are included as Mecho5 manual roller shades, in a thermoveil silver birch finish. Division 15 Mechanical 1) Modification to the existing fire sprinkler system is included. The existing system on the 2nd floor shall be drained and isolated to keep the 1st and 3rd levels operational. The complete sprinkler system shall be designed to meet NFPA 13, state and local codes, and will consist of concealed heads in center tile. Per AHJ, temporary fire protection is not needed during construction. Temporary heat detectors will be in place during construction; however the wet sprinkler system will be shut down during the duration of construction. 2) Plumbing system to consist of the following: • Remove existing plumbing fixtures including (1) WC, (1) lavatory and (4) lab sinks, disconnect associated water and sewer piping as necessary for future use. Remove 4” CHS & CHR and 3” HWs & HWR water riser to be relocated. Remove baseboard trim as needed when new wall location will interfere with trim. • Rough-in of new sinks and ice maker box for refrigerator (1) Kitchen (breakroom sink), (4) lab room sinks, connect new waste, water serving new fixtures to existing piping as per plans. Insulate domestic water piping as per specifications. • Provide & install Plumbing Fixtures as per schedule • Connect rerouted schedule 40 Victaulic 4” CHS&R, 3” HWS&R up through chase on 1 st level ceiling to 2nd level ceiling. Building will need to be shut down for this work and will require assistance from maintenance personnel for proper shutdown and fill and purge of system. An allowance is included for the drain down and fill and purge of both chilled and Heating system. Testing of existing fluid in both chilled and heating water system is recommended and should be done by owner. It is assumed that DocuSign Envelope ID: 8F171F6A-0E56-41BC-A796-388B046F4202 existing fluid can be reused. The GMP includes (2) 55 gallon Fernox ALPHI 11 glycol for any additional glycol needed. If water or glycol content is not at an acceptable level, additional measures will be needed to be addressed prior to this work, and additional costs could incur. • Pipe to (7) VAV heating only coils from existing mains to new VAV location. (5) VAV hot water piping is not shown, but will be tied into HW system assumed a like-for-like replacement (within 10’) of the existing VAVs. • Revised baseboard heater covers as necessary with new wall layout, provide additional trim for any adjustments that need to be made • Insulate new heating, chilled and domestic piping with fiberglass insulation 3) New VAV system shall include new ductwork and Trane equipment per spec. Trane company shall provide a modification to the existing Trane Tracer SC+ building automation system to accommodate new HVAC system. 4) Testing and balancing of the entire building HVAC system, in addition to the new HVAC system, is included. 5) Commissioning of the lighting control system, VAV HVAC system, hydronic baseboard system, and exhaust fan is excluded. Commissioning costs and coordination shall be by Owner. 6) Existing mechanical & plumbing systems, including exterior penetration vents and sewer lines are presumed to be in good working order and are to remain without modification. Division 16 Electrical 1) Electrical system includes all branch power, connections to mechanical equipment, and supply and install of specified light fixtures. All wiring is included as MC. 2) Alarm system modifications to accommodate new spaces is included. 3) Structured cabling system to include the following: a. (5) 2 (wall) cable locations. Each location to receive (2) CAT6 cables, (2) CAT6 jacks, and (1) 2-port faceplate b. (3) 2 cable WAP locations. Each location to receive (2) CAT6 cables, (2) CAT6 jacks, and (1) 2-port faceplate c. (4) 1 cable CCTV camera locations. Each location to receive (1) CAT6 cable, (1) CAT6 jack, and (1) 2-port faceplate 4) Owner to procure & provide equipment for wireless access points and cameras, GC to provide structured cabling and install of equipment.
