TRANSPORTATION, hereinafter referred to as the State or CDOT, and EAGLE COUNTY, STATE of COLORADO, P.O. Box 179, Eagle, CO 81631, FEIN: 846000762, hereinafter referred to as the Local Agency, or the contractor. FACTUAL RECITALS, 1. Authority exists in the law and funds have been budgeted, appropriated and otherwise made available and a sufficient unencumbered balance thereof remains available for payment of project and Local Agency costs in Fund Number 400, Appropriation Code 010, Organization Number 9991; Program 2000, Function 3301, Object 2312 1P, Phase C, Reporting Category 3420, Contract Encumbrance Number 12455, (Contract Encumbrance Amount: $88,000.00). 2. Required approval, clearance and coordination has been accomplished from and with appropriate agencies. 3. Pursuant to Title I, Subtitle A, Section 1108 of the Transportation Equity Act for the 21 st Century of 1998 (TEA-21) and to applicable provisions of Title 23 of the United States Code and implementing regulations at Title 23 of the Code of Federal Regulations; as may be amended, (collectively referred to hereinafter as "the federal provisions"), certain Federal funds have been and will in the future be, allocated for highway projects requested by Local Agencies and eligible under the Surface Transportation Program that has been proposed by the State and approved by the Federal Highway Administration (FHWA), hereinafter referred to as the program. 4. Pursuant to ยง 43-1-223, C.R.S. and to applicable portions of the federal provisions, the State is responsible for the general administration and supervision of performance of projects in the program, -1- t EAGLE BOARD OF COUNTY COMMISSIONERS AGENDA REQUEST & STAFF RECOMMENDATION FORM TITLE: Contract with Colorado Department of Transportation for $88,000 of ISTEA Enhancement funds for the Eagle River Pedestrian/Bicycle Bridge in Edwards LOCATION: Edwards between Riverwalk and The Reserve STAFF CONTACT/PRESENTER: Ellie Caryl, Trails Program Coordinator DEPARTMENT: Eagle County Regional Transportation Authority REQUESTED HEARING DATE: Tuesday, July 6, 1999 CONSENT CALENDAR: Yes LENGTH OF TIME REQUESTEDIREQUIRED: n/a HAVE THE DOCUMENTS TO BE SIGNED BEEN REVIEWED & APPROVED BY THE COUNTY ATTORNEY? Yes IF THIS IS A CONTRACT OR OTHER ITEM REQUIRING AN EXPENDITURE, IS THE FULL AMOUNT TO COVER THIS REQUEST IN THE CURRENT APPROVED BUDGET? Yes PROJECTICONTRACT DESCRIPTION: CDOT has selected the Edwards Pedestrian bridge as a project eligible to receive ISTEA Enhancement funds. $88,000 has been pledged by CDOT towards the bridge costs. The 200' long bridge will cost an estimated $160,000. The balance of the bridge costs will be paid for with contributions made by adjacent developments (i.e. River Pines and The- Reserve). STAFF RECOMMENDATION: Approval BASIS FOR RECOMMENDATION: There is considerable competition for ISTEA Enhancement funds. This project received high marks because it. is ready to move forward and CDOT is sympathetic to the pedestrian and CDOT bicycle safety issues on Highway 6 and the I-70 Spur Road. Given the limited availability of ISTEA Enhancement funds, this opportunity should be taken. PROPOSED MOTION: I move that the Chairman be authorized to sign the Contract with the Colorado Department of Transportation for the $88,000 of ISTEA Enhancement Funds.
