HomeMy WebLinkAboutC99-093 Roaring Fork ConvervancyC19- �3 - � a EAGLE COUNTY ROAD ADOPTION AGREEMENT WHEREAS, the Roaring Fork Conservancy, a Colorado not for profit corporation, has expressed a desire to adopt a portion of Eagle County Road 104, also known as the Frying Pan River Road, from the confluence of the Roaring Fork River and Frying Pan River to Ruedi Reservoir, a distance of 14 miles; and WHEREAS, Eagle County is willing, should certain conditions be met, to allow the Roaring Fork Conservancy to adopt said road. The Roaring Fork Conservancy agrees as follows: 1. The Roaring Fork Conservancy members shall abide by all rules and safety regulations of the program. 2. All participating group members will have attended a safety meeting in which all members will have viewed the Spruce Up Colorado Volunteer Safety video prior to any planned clean up. It is the responsibility of the Conservancy to designate a coordinator for the program who shall serve as liaison between the County and the Conservancy. It is the responsibility of the Conservancy to set up a meeting and showing of the Spruce Up Colorado program (video). 3. While engaged in a clean up, all participants should wear an orange vest. Eagle County agrees to provide the orange vests. The Conservancy agrees to restrict program activities to the area of the right of way off the traveled portion of the road. 4. The Conservancy agrees to limit its clean up activities to the period from one hour after sunrise to one hour before sunset not during inclement weather. 5. The Conservancy shall engage (when engaged) in a project, will inform all its volunteers of the potential dangers of working close to the road including high speed traffic, potentially noxious plants, broken glass, hazardous materials, strip metal and potentially harmful wildlife including skunks and snakes. 6. The Conservancy agrees to insure the method, manner, and appearance of the participants will not in any way distract, disrupt, or adversely affect traffic. Participants may not display messages, carry banners, or advertise the;Y business affiliation or cause. V 7. Participants are prohibited from the possession, consumption or being under the influence of drugs while performing work or liter pick up on the Frying Pan Road. 8. The Conservancy shall provide one adult supervisor for every eight participants between 13 and 17 years of age. No one under age 6 shall be allowed to participate. 9. All program participants shall wear an orange vest while engaged in pick up activities. 10. The County reserves the right to request names and legal addresses of all participating members of the group. 11. Eagle County will provide the orange safety vests and trash bags for program participants upon reasonable notice. Work shall be done only after advance notice has been given. 12. This agreement may be terminated by either parry upon written notice. 13. Eagle County shall install and maintain signs if requested by the group. The County shall remove and dispose of filled trash bags. 14. The parties acknowledge that program participants are volunteers and not employees of the County and that activities are conducted solely at their own risks.
