HomeMy WebLinkAboutR89-106 creation of eagle county transit commissionCommissioner LJ Z��.� moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 89 - ,1 6 CONCERNING THE EAGLE COUNTY TRANSIT COMMISSION WHEREAS, the Eagle County is authorized to develop, maintain, and operate mass transportation systems either individually or jointly with any government or political subdivision, pursuant to the authority granted by Title II of Article 30, Colorado Revised Statutes, as amended; and WHEREAS, the County desires to operate a people service transportation system in order to provide access to recreational facilities for visitors and to provide access to employment centers for County residents pursuant to Title 1.1 of Article 40 of the Colorado Revised Statutes, as amended; and WHEREAS, the County is a body corporate and politic, and as such is empowered to make all contracts and do all other acts in relation to the property and concerns of the County necessary to the exercise of its corporate or administrative powers, pursuant to Title II of Article 30, Section 101(d), Colorado Revised Statutes, as amended; NOW, THEREFORE, be it resolved by the Board of County Commissioners, County of Eagle, State of Colorado (the "Board "): THAT, the Board does hereby create an advisory body to the Board to be known as the Eagle County Transit Commission (the "Commission "). The Commission shall operate and manage the Eagle County Express transit system. The system shall be limited to those services contracted for and established by the Board. The Commission shall have no authority to expand services beyond the scope of such contract(s). The Commission may also recommend the entry into certain contracts by the Board, but the Commission, having no power to contract, will itself not enter into any contract. THAT, the Commission shall have the authority and the responsibility to administer all contracts entered into by the County relating to the operation and funding of the system; THAT, the Commission shall review and make recommendations on all claims made against the County that are related to the system; THAT, the Commission, at least twice per month, shall meet and review the operation of the system including specifically, but not exclusively, (i) The performance of monthly critiques of the service being provided; (ii) Administering the scheduling of buses; (iii) Approval of uniforms and review of any personnel matters that affect the quality of service; (iv) Review and approval of vehicle maintenance records; (v) Review of monthly ridership statistics; (vi) Approval of payment of all invoices presented. THAT, the Board does determine that the Commission shall consist of three regular voting members. The members shall be a delegate of the Avon Town Council, a representative of the Beaver Creek Resort Company, and a delegate of the Eagle County Board of Commissioners. The term of membership for all seats shall be through the first regular meeting of the Board scheduled in January, 1991. THAT, the Commission is authorized to adopt such by -laws and /or procedures as it deems expedient to carry out its responsibilities. Any policies, by -laws or procedures shall be approved by the Board before becoming effective.
