FIRST AMENDMENT TO CONTRACT
This First Amendment To Contract is entered into this day of April, 1999, by and
between Eagle County, Colorado by and through its Board of County Commissioners ("Owner")
and Evans -Mendel -Allison Construction, Inc. ("Contractor").
This is an amendment to the contract entered into between Owner and Contractor dated
November 9, 1998, for the Eagle County Grandstands project ("Original Contract").
The purpose of this amendment is to clarify the Owner's representatives' authority with
respect to Construction Change Directives, described at Section 7.3 of the General Conditions of
the Original Contract, in order to avoid delay arising from the processing of Construction Change
Directives by Owner.
For valuable consideration, including the respective promises set forth in the Original
Contract and herein, the parties agree:
1. The Original Contract is amended to add Article 6.5 to Article 6 "Changes in the
Work" as follows:
6.5 Owner's representative with authority to bind Owner to
Construction Change Directives involving additions to the Contract
Sum up to a total of $10,000.00 for the work included in any given
Construction Change Directive is the Director of the County's
Facilities Management Department. Owner's representative with
authority to bind Owner to Construction Change Directives
involving additions to the Contract Sum up to a total of $25,000.00
for the work included in any given Construction Change Directive
is the Eagle County Administrator. An addition of Work shall not
be broken into subparts for the purpose of fitting into one or
another of these authorities. Any Construction Change Directive
increasing the amount of the Contract Sum must contain the written
assurance that the addition is covered by lawful appropriations as
required by Paragraph 6.a. of the Supplemental Conditions of the
Original Contract.
2. The term "Contract" as used in the Original Contract and this amendment hereafter
shall mean the Original Contract as hereby amended.
3. Except as expressly amended hereby, all other terms and conditions of the
Contract shall remain in full :brce and effect.
