Amending the lot lines and building envelope on Lot 18. WHEREAS, notice of the proposed amendment was mailed to all owners of property located within and adjacent to the PUD and was duly published in a newspaper of general circulation throughout the County concerning the subject matter of the application and setting forth the dates and times of hearings for consideration of the application by the Eagle County Planning Commission and the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board "); and WHEREAS, at its public meetings held July 5, 1989 and July 19, 1989, the Planning Commission, based upon its findings, recommended approval of the proposed PUD amendment; and WHEREAS, at its regular meeting held July 11, 1989 and August 22, 1989, the Board considered the PUD amendment application, associated plans and the statements and concerns of the Applicant and the Eagle County staff. I Lr r^, WHEREAS, on or about May 15, 1989, the County of Eagle, U 6i State of Colorado, accepted for filing an application submitted by 0 0 of i -plan, inc. (hereinafter "Applicant ") for amendment of the Pilgrim o Downs Planned Unit Development, Edwards, Colorado (hereinafter the "PUD "), File No: PD- 152 -89 -A9 and; WHEREAS, the Applicant requested the amendment of the PUD cI 9 for the purposes of x S 1. I Lr r^, Based on the evidence before it, THE BOARD FINDS AS FOLLOWS: 1. That the proposed amendment to the Pilgrim Downs Planned Unit Development is consistent with the efficient development and preservation of the entire PUD. 2. The proposed amendment does not affect in a substantially adverse manner either the enjoyment of the land abutting upon or across the street from the PUD or the public interest. 3. Granting of the proposed amendment would not confer a special benefit on any person. 4. The proposed change in land use designation from single family to primary /secondary is necessary because the area for proposed designation is changing to such a degree that it is in the public interest to encourage a new use or density. 5. A change in land use designation to primary /secondary is consistent with the Master Plan and possesses the geological, physical, and other environmental conditions compatible with the characteristics of the use requested. 6. The advantages of the proposed change in land use designation outweigh the disadvantages. 7. Conceptual evidence that the affected land has access OD n and can be serviced with water and sewage disposal C; systems appropriate for the land use designation being - - - - -- - -- - sought -has- been--- prov-ide d NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the application submitted by i -plan, inc. for amendment of the Pilgrim Downs Planned Unit Development be and is hereby granted. 411666 B - 515 R -492 10/13/89 16:51 PG 2 OF 3 The Board finds, determines, and declares that this Resolution is necessary for the health, safety, and welfare of the inhabitants of the County of Eagle, State of Colorado.
