BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 89- Qq
FILE NO: ZC- 234 -89
WHEREAS, Randy & Wendy Glassier did file a petition with
the Eagle County Department of Community Development on or about
June 1, 1989, to rezone the herein described property in Eagle
County from Resource Zone District to Agricultural Limited Zone
District; and
WHEREAS, a public hearing was held by the Board of
County Commissioners of the County of Eagle, State of Colorado,
on August 29, 1989; and
WHEREAS, based on the evidence, testimony, exhibits,
study of the Master Plan for the unincorporated areas of Eagle
County, comments of the Eagle County Department of Community
Development, comments of public officials and agencies, the
recommendation of the Eagle County Planning Commission, and
comments from all interested parties, the Board of County
Commissioners of „the County of Eagle, State of Colorado, finds as
follows:
1. That proper publication and public notice was
provided as required by law for the hearing before
the Planning Commission and the Board of County
Commissioners.
2. That the proposed zoning is not in compliance with
the recommendations set forth in the Master Plan for
the unincorporated area of the County.
3. That the proposed land use will not be compatible
with existing and permitted land use in all
directions.
4. That the area in question does not possess the
geological, physical or environmental
conditions compatible with the characteristics of
the use requested.
5. That the disadvantages of the use requested outweigh
the advantages.
6. The area for which rezoning is requested has not
changed to such a degree that it is in the public
interest to encourage a new use or density in the
area.
7. That the proposed rezoning is not necessary in order
to provide land for a demonstrated community need.
8. That for the above - stated and other reasons, the
proposed zoning is not in the best interest of the
health, safety, convenience, order, prosperity and
welfare of the citizens of Eagle County.
NOW, THEREFORE, BE IT RESOLVED by the Board of County
Commissioners of the County of Eagle, State of Colorado:
That the petition of Randy and Wendy Glassier, File Number
PD- 234 -89, for a zoning amendment to change from Resource Zone
District to Agricultural Limited Zone District be and is hereby
denied relative to the following described property located in
the unincorporated territory of Eagle. County:
A parcel of land located in Tract 42 of Sections 3
and 4, Township 8 South, Range 87 West of the Sixth
Principal Meridian, Eagle County, Colorado according
to the Independent Resurvey of said Township and
Range as approved on August 25 1927; said parcel,
with all bearings contained herein based on a
bearing of 5.03 "45121 "W. between the Witness Corner
to Corner No. 9 of said Tract 42, a brass cap
as
monument, being more particularly
follows:
Beginning at the true position for Corner No. 9 of
said Tract 42; thence along the Easterly Boundary
line of said Tract 42 5.0311451211W. 1058.00 feet;
thence departing said Easterly boundary
N.55 "14116 "W. 1216.57 feet; thence N.00 "10'05 "W.
340.00 feet to a point on the Northerly Boundary
line of said Tract 42;; thence along said Northerly
Boundary line N.881149104"E. 1069.97 feet to the
point of beginning.
Said parcel contains 16.838 acres, more or less.
