HomeMy WebLinkAboutC02-252 IGA Regional Public Health Preparedness ProjectINTERGOVERNMENTAL AGREEMENT BETWEEN THE COUNTY OF EAGLE, STATE OF COLORADO AND THE COUNTY OF GARFIELD, STATE OF COLORADO AND THE COUNTY OF GRAND, STATE OF COLORADO AND THE COUNTY OF JACKSON, STATE OF COLORADO AND THE COUNTY OF MOFFAT, STATE OF COLORADO AND THE COUNTY OF PITKIN, STATE OF COLORADO AND THE COUNTY OF RIO BLANCO, STATE OF COLORADO AND THE COUNTY OF ROUTT, STATE OF COLORADO AND THE COUNTY OF SUMMIT, ' STATE OF COLORADO CONCERNING A REGIONAL PUBLIC HEALTH PREPAREDNESS PROJECT THIS INTERGOVERNMENTAL AGREEMENT, (IGA), is made and entered into by and between the Board of County Commissioners of Eagle County, State of Colorado, a body corporate and politic ("Eagle County"); and Board of County Commissioners of Garfield County, State of Colorado, a body corporate and politic ("Garfield County"); and Board of County Commissioners of Grand County, a body corporate and politic ("Grand County"); and Board of County Commissioners of Jackson County, a body corporate and politic ("Jackson County"); and Board of County Commissioners of Moffat County, a body corporate and politic ("Moffat County"); and Board of County Commissioners of Pitkin County, State of Colorado, a body corporate and politic ("Pitkin County"); and the Board of County Commissioners of Rio Blanco County, State of Colorado, a body corporate and politic ("Rio Blanco County") and the Board of County Commissioners of Routt County, State of Colorado, a body corporate and politic ("Routt County"), and the Board of County Commissioners of Summit County, State of Colorado, a body corporate and politic ("Summit County"). The nine counties party to this IGA are also referred to as "These Counties" in this IGA. WITNESSETH: WHEREAS These Counties desire to enter into an Intergovernmental Agreement for the purpose of jointly planning and conducting a regional public health preparedness program; and WHEREAS These Counties have been designated by the Colorado Department of Public Health and Environment as a contiguous region to cooperatively implement programs of public health preparedness as part of the State of Colorado plan for Public Health Preparedness and Response for Bioterrorism; and WHEREAS, Federal funding has been identified to support regional preparedness planning and readiness assessment and development of surveillance and epidemiology capacity in These Counties, IN CONSIDERATION OF the mutual covenants and conditions contained herein, These Counties agree as follows: 1. SCOPE A. These Counties, also referred to as participating counties or county, propose to engage in activities to (1) assess the current capacity of public health leadership and develop, enhance and maintain the leadership, expertise and workforce necessary to address bioterrorism, other outbreaks of disease, and other public health emergencies in the participating counties; (2) develop and test coordinated preparedness and response plans in the participating counties; (3) develop, enhance, support and test the epidemiologic infrastructure to rapidly detect and effectively investigate a terrorist event and respond to and control the consequences of a terrorist event throughout the participating counties; (4) respond to other naturally occurring disease outbreaks and public health threats throughout the participating counties; and, (5) strengthen working links between responding areas of public health, environmental health, health care providers, law enforcement, and emergency responders in These Counties. B. The strategies employed to conduct this regional public health preparedness project include: i. Designation of a single County as the host county to serve as fiscal agent and administrative authority for the conduct of the regional public health preparedness plan. The Host County will be responsible for submitting plans and reports to the Boards of County Commissioners of These Counties and to the Colorado Department of Public Health & Environment for the implementation of the regional public health preparedness plan. ii. Creation of a regional advisory board which will meet a minimum of four times a year to provide direction and oversight to the Host County in the development and implementation of the regional public health preparedness program. Each County Board of Commissioners will appoint a minimum of two representatives to the regional board. iii. Coordinating access to state and federal funding sources; and leveraging local funding in combination with State and Federal funding resources. Identification and development of additional regional and funding partnerships that will support the goals and activities developed under this IGA. The administrative and financial structure to support regional public health preparedness activities under this intergovernmental agreement is set forth in Section 2 : Counties' Duties. Other public health preparedness projects undertaken by These Counties as part of this intergovernmental 2 1qw/ 1w� agreement which require coordinated planning and/or shared funding, will be set forth and entered into as multi -county memorandums of understanding. 2. COUNTIES' DUTIES A. These Counties will adopt resolutions in their county approving this IGA. B. Summit County agrees to serve as the fiscal and administrative agent vis-a-vis the Colorado Department of Public Health and Environment for These Counties. Summit County shall also serve as the Host County for the Regional Public Health Preparedness Project. Summit County agrees to employ a regional health planner and regional epidemiologist dedicated to the accomplishment of goals and activities developed under this IGA. C. These Counties will enter into an annual memorandum of understanding to endorse the annual work plan and budget, including provisions for additional services deemed necessary and advisable by These Counties. In the event agreement cannot be reached with respect to the annual memorandum of understanding, any participating county may elect to terminate its involvement in the regional public health preparedness project through provisions under section 5.C. of this agreement. 3. NOTICE Any notice required hereunder shall be given in writing by registered or certified mail, return receipt requested, which shall be addressed as follows: EAGLE COUNTY: Eagle County c/o Eagle County Attorney P.O. Funding for this program will include a contract for public health preparedness between the State of Colorado Department of Public Health and Environment and Summit County. 5. MISCELLANEOUS A. This IGA is solely for the benefit of These Counties and shall not be relied upon by any third party as the basis of any claim, lawsuit, or complaint, B. The invalidity or unenforceability of any provision of this IGA shall not affect the other provisions hereof, and this IGA shall be construed as if such invalid or unenforceable provision were omitted. C. Notwithstanding anything'to the contrary contained in this IGA, none of These Counties shall have any obligation under this IGA, nor shall any payment be made to any operating, administrative or fiscal agent in respect of any period after August 30th of each calendar year during the term of this IGA, without an appropriation therefor by the respective counties in accordance with a County Budget adopted by the Board of County Commissioners of said County in compliance with the provisions of Article 25 of Title 30, C.R.S., as amended, Article 1 of Title 29, C.R.S., as amended, and the TABOR Amendment to the Colorado Constitution, Article 10, Section 20. 0 L� D. In the event that any of These Counties elect to terminate their participation under this Agreement, such county shall provide all other participating counties thirty (30) days notice pursuant to Section 3, of their intent to terminate. The terminating county shall be responsible for its share of costs agreed to in any memorandum of understanding until the end of the thirty 30 day notification period. IN WITNESS WHEREOF, These Counties have executed this Amended IGA to be effective on September 1, 2002, no matter the date of execution by each county.
