PETITION FOR EXCLUSION OF LAND
TO: BERRY CREEK METROPOLITAN DISTRICT
EAGLE COUNTY COLORADO
The undersigned Petitioner, Eagle County, acting by and through its Board of County
Commissioners, hereby respectfully peition the Berry Creek Metropolitan District (the "District"))
acting by and through its Board of Directors, for exclusion of real property further described as Lots
1 through 7 inclusive and Lots 48 through 64 inclusive of Tract D of the Berry Creek 5th/Miller
Ranch PUD as further depicted on Exhibit "A" and incorporated herein (the "Property").
Exclusion from the District is sought pursuant to § 32-1-501, et al., C.R.S.
The Petitioners represent that they are the owner of the Property and represent one hundred
percent (100%) of the real property capable of being served with the facilities and services of the
District. The Petitioners also represent that no other person, persons, entity or entities own an
interest therein except as beneficial holders of encumbrances.
The undersigned hereby consent that the Property be excluded from the District and that an
Order may be entered in Eagle County District Court for the exclusion of the Property from the
District. The Petitioners acknowledge that the Property may be liable for assessments or other
obligations still owing to the District.
This Petitioners agree to pay the fees, pursuant to § 32-1-501(1), a sufficient sum to pay all
costs of the exclusion proceedings.
WHEREFORE, the Petitioners hereby request that the Board of Directors, pursuant to §32-
1-501 et al., grant this Petition for the exclusion of the Property from the District.
