HomeMy WebLinkAboutECAT C05-032 Concessions International0.106- 067- -- .10 FIRST AMENDMENT TO THE STORAGE ROOM LEASE BETWEEN EAGLE COUNTY AIR TERMINAL CORPORATION AND CONCESSIONS INTERNATIONAL, LLC THIS FIRST AMENDMENT (hereinafter "First Amendment") to the Storage Room Lease is made this day of , 2005, by and between Eagle County Air Terminal Corporation, a not for profit coaoration (hereinafter "ECAT") and Concessions International, LLC; a Georgia Limited Liability Company (hereinafter "Concessions International"). ECAT and Concessions International are collectively referred to as the "Parties." WITNESSETH WHEREAS, on April 9, 2002, ECAT and Concessions International entered into a Storage Room Lease in which ECAT leased certain space within the Eagle County Regional Airport Terminal to Concessions International for the purpose of storage and office space (hereinafter "Storage Room Lease"); and WHEREAS, Section 19(J) of the Storage Room Lease provides that "all amendments to this Lease must be made in writing"; and WHEREAS, the Parties now desire to amend certain terms of the Storage Room Lease to reflect a new square footage for the leased premises and a new square foot rental charge. AGREEMENT NOW, THEREFORE, in consideration of the mutual promises set forth herein and in the Storage Room Lease, the Parties agree as follows: 1. SECTION THREE: RENTALS AND CHARGES. Section 3.0 is hereby amended to read as follows: "Lessee shall pay to Lessor a monthly rental charge of $14.00/square foot per year for the 300 square feet of leased storage and office space (which equates to $4,200.00 per year or $350.00 per month) payable in advance, and due on the first day of each month at Eagle County Air Terminal Corporation c/o Eagle County Airport Manager, P.O. Bog 850, Eagle, CO 81631. The first payment is due upon execution of this Lease Agreement. If the first payment of rent is due on other than the first day of the month, the first month's rent shall be prorated." 2. This First Amendment and the terms hereof shall be effective as of December 16, 2004. *VW '`► 3. The Parties agree that, except as expressly altered, modified and changed in this First Amendment, all terms and provisions of the Storage Room Lease shall remain in full force and effect, and hereby are ratified and confirmed in all respects as of the date hereof. 4. If any conflict exists between the provisions of this First Amendment and the Storage Room Lease, the provisions of this First Amendment shall control. 5. This First Amendment shall be binding on the Parties hereto, their heirs, executors, successors, and assigns.
