HomeMy WebLinkAboutR89-068 county clerk as interim depository for survey platsCommissioner 0-1 7 S moved adoption of the following Resolution: BOARD OF COUNTY COMMISSIONERS COUNTY OF EAGLE, STATE OF COLORADO RESOLUTION NO. 89- DESIGNATING THE COUNTY CLERKS OFFICE AS THE INTERIM DEPOSITORY FOR SURVEY PLATS AND DESIGNATING THE COUNTY SURVEYOR TO CREATE AND MAINTAIN A SURVEY PLAT RECORDS AND INDEX SYSTEM WHEREAS, pursuant to Section 38 -51 -107, C.R.S., the Board of County Commissioners of the County of Eagle, State of Colorado (hereinafter the "Board ") shall designate a public office as a depository for certain survey plats; and WHEREAS, the Board shall also designate the county surveyor to create and maintain a survey plat records file and index system for the plats; and WHEREAS, said survey plat records file and index system shall be operational prior to July 1, 1989; and NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board hereby designates the Eagle County Clerk and Recorders. Office as a depository for survey plats prepared by a professional land surveyor who sets a monument or accepts a monument not of record and as required pursuant to Section 39 -51- 107, C.R.S. THAT, the Clerk and Recorder shall serve as such depository for an interim period only and until the Board makes a further designation by Resolution. THAT, the County Surveyor is hereby designated to create and maintain a survey plat records and index system for plats filed in accordance with this resolution. Said system shall be operational prior to July 1, 1989. THAT, plats filed within the system shall conform to the requirements set forth in Sections 38 -51 -107 and 38- 51- 107(2)(b), C.R.S. THAT, the system shall ensure that: 1. Each plat deposited shall be given a reception number or a book and page number, or both, which shall be set forth on the plat; j 2. Surveyed lands located within the Unites States rectangular survey system shall be indexed by section, township, range, and principal meridian. Grant lands and unsurveyed lands shall be indexed by the system of indexing the County Assessor already has in place; 3. Survey plats submitted for depositing shall be indexed in a timely manner, but in no case shall indexing exceed ten working days from the date the survey plat was deposited; ?. Each plat submitted for depositing in accordance with this section shall bear original signatures and seals and shall be made of a dimensionally stable polyester shedt such as cronar or mylar or other product or equal quality, three mils or greater in thickness with nonfading permanent print. The dimensions of each plat shall be as specified by county requirements but shall be not less than eighteen inches in width by twenty -four in length or not more than twenty -four inches in width by thirty -six inches in length and shall have a minimum of two -inch margin on the left (width) side and a minimum of one -half inch margins at the top, bottom, and right side of the plat. THAT, the fee for depositing plats in accordance with this resolution shall be in an amount equal to the amount of the fee collected for the recording of subdivision plats, as established by Section 30- 1- 103(2)(f), C.R.S. THAT, the fee for the county surveyor for indexing and maintaining the plats shall be in an amount equal to the fee collected for the recording of subdivision plats as established in Section 30- 1- 103(2)(f), C.R.S. THAT, plats shall be deposited in accordance with this section for the sole purpose of recording information on surveying monumentation in—order to provide survey data for subsequent land surveys and shall neither be construed as affecting, in any manner whatsoever, the description of the subdivision, line, or corner contained in the official plats and field notes filed and of record nor as subdividing property. No plat deposited in accordance with this section shall constitute notice pursuant to Section 38 -35 -109, C.R.S. Subdivision plats whirl: create parcels of land of thirty - five acres or more must be filed in the clerk and recorder's office wherein the property is located pursuant to Section 35 -35 -109, C.F.S. 2 THAT, this resolution is necessary for the health, safety, and welfare of the inhabitants of the County of Eagle, State of Colorado. MOVED, READ AND ADOPTED by the Board of County Commissioners of the County of Eagle, State of Colorado, at its regular meeting held the day of June, 1989.
