IN RE THE MATTER OF THE APPLICATION OF THE EAGLE VALLEY TV METROPOLITAN DISTRICT SERVICE PLAN AS AMENDED DECISION WHEREAS, the petitioners and proponents of the proposed Eagle Valley TV Metropolitan District, Eagle County, Colorado (hereinafter referred to as the "district ") submitted a service plan for a proposed Eagle Valley TV Metropolitan District on March 2, 1989, and a letter containing two amendments to the service plan, dated May 4, 1989, referred together to hereinafter as the Service Plan as amended, attached hereto as Exhibit A and incorporated herein, to (i) provide for the establishment and maintenance of television relay and translator facilities and (ii) to provide for the elimination and control of .mosquitoes; and WHEREAS, Pursuant to 5 32 -1 -108, C. R. S., notice of the hearing was duly published in the Eagle Valley Enterprise on March 16, March 23, and March 30, 1989, as required by law, and Notice was forwarded to the petitioners, to the division of Local Government in the Department of Local affairs, and to the governing body of each municipality and special district which has levied an ad valorem ta.� :within the next preceding tax near and Which has boundaries within a radius of three (3) miles of the proposed district; and WHEREAS, the Board of County Commissioners held public meetings after thirty (30) days of the filing of the Service Plan, on April 10, 1989, and on May 2, 1989; and WHEREAS, Pursuant to 5 32 -1 -204 (1.5), C.R,S., evidence was presented that the Petitioners had mailed postcard notification of the hearing to property owners within the proposed district boundaries as listed on the records of the County Assessor; and ;WHEREAS, Pursuant. to 532 -1 -204, C.R.S. the Board has col ?sidared the recommendation for approval of the Eagle County Planning Commission made at its regular meeting held April 5, 1989; and WHEREAS, several property owners filed a timely request for exclusion from the district pursuant to 5 32 -1 -203, C.R.S.; and W WHEREAS, the Board has considered the Service Plan as amended, and all other testimony and evidence presented at the hearings. FINDINGS NOW, THEREFORE, based on the testimony and evidence presented at the hearings, the Board of County Commissioners of the County of Eagle, State of Colorado, finds as follows with regard to the Service Plan as amended for the Eagle Valley TV Metropolitan District: SECTION 1. The Board does hereby determine that all of the requirements of the Act 'relating to the filing of the Service Plan as amended for the proposed district have been fulfilled and that notice of hearing was given in the time and manner required by law. SECTION 2. A legal question exists, as to whether the Eagle Valley TV Metropolitan District, if organized, would in part, provide the same service as three existing metropolitan districts, in conflict wit'_ 5 32 -1 -107, C.R.S. The following existing metropolitan districts seek exclusion of the property within their boundaries on the ground that they each are authorized to provide TV transmission service: Beaver Creek Metropolitan District: In a letter dated March 31, 1989, Beaver Creek Metropolitan District claims that the district "now provides television transmission services within its boundaries, and has legally preempted the provision of this service by any other special district." The Beaver Creek Metropolitan District Service Plan as approved, page 15, states that: "A TV relay and translator system is proposed to serve the Beaver Creek Metropolitan District. This will consist of a receiving antenna at Avon which will accept aerial signals from the Eagle Valley TV public transmitter at Castle Peak, 20 miles to the west. This signal will then be amplified, translated and relayed through a buried coaxial TV cable installed alongside the telephone cables within the project. Taps will be made as appropriate to the various residential and commercial users." -2- Arrowhead Metropolitan District: in a letter dated March 29. 1989, the Arrowhead Metropolitan District claims that its "Service Plan provides for the provision of television relay and translator services," and "all of the residents Of Arrowhead Metropolitan District have received television transmission services at this time. " No claim is made that the district actually provides the television service. The Arrowhead Metropolitan District Service Plan as approved, page 6, states that: "The Arrowhead Metropolitan District will provide coordination and financing for television transmission. The system will provide cable transmission or TV Translator Stations extending television signals from Castle Peak to all properties within the development." "Either system will provide quality television reception to the area, and eliminate the need for outside antennas. The installation of these facilities will enhance property values of the area, but would be impossible to provide through a nongovernmental entity." 3. Berry Creek Metropolitan District: In a letter dated March 29, 1989, the Berry Creek Metropolitan District claims that "Berry Creek currently exercises its TV relay and translation service power via contract with Cablevision Associates." The Berry Creek Metropolitan District Service Plan as approved, Pages 13 and 14, states that: "Initial investigation indicates that television reception may be good within the Berry Creek Metropolitan District without the provision of additional facilities. It does not appear that TV cable will be necessary. The Berry Creek Metropolitan District is prepared and has arranged for the financing of TV Translator Stations extending television signals from Castle Peak to a translator station which will beam the signals to all properties within the development." "This system, if required, will provide above average television reception to the area and eliminate the need for outside antennas and television cable problems. The installation of these facilities will enhance the property values of the area, but wouldbe impossible to provide through anon - governmental entity. Accordingly, the Berry Creek Metropolitan District is prepared to provide the coordination and financing." -3- SECTION 3. in addressing the issue set forth in Section 2 herein above, if the court finds that the proposed district would not provide overlapping service_ within the existing districts, then, pursuant to § 32 -1 -203 (2), C.R.S., the Board hereby finds and determines that: A. There is sufficient existing and projected need for organized service in the area to be served by the proposed district: B. The existing service in the area to be served by the proposed district is not adequate for present and projected needs; C. The proposed special district is capable of providing economical and sufficient service to the area within its proposed boundaries; D. The area to be included in the proposed district has, or will have, the financial ability to discharge the proposed indebtedness on a reasonable basis. Pursuant to § 32 -1 -203 (2.51, C.P..S., the Board, specifically with regard to the proposed Service Plan as amended, hereby finds and determines that: A. Adequate service is not , or will not be, available to the area through the county, other existing municipal quasi - municipal corporations, including existing special districts, within a reasonable time and on a comparable basis; B. The facility and service standards of the proposed special district are compatible with the facility and service standards of the County and each municipality which is an interested party under § 32- 1- 204(1), C.R.S.; C'. The proposal is in substantial compliance with a master plan adopted pursuant to § 32 -28 -106, C.R.S.; D. The proposal is in compliance with any duly adopted county, regional, or state long -range water quality management plan for the area; E. The creation of the proposed special district will be in the best interests of the area proposed to be served. Said findings being limited to the service plan as presented. -4- Section 4. The following property owners entered a timely request for exclusion of their property from the district on the grounds stated, pursuant to 5 32 -1 -203, C.R.S.: 1. Austin and Annie Gibbons, 320 Strom Circle, Gypsum: Owners allege that the property will not receive signals from the proposed translators, and are opposed to the mosquito control. 2. .Rill and Charlotte Gordan, 137 Park Street, Gypsum: owners allege that the property will not receive signals from the proposed translators, and are opposed to the mosquito control. 3. Perly Bertrock, 217 Cedar Drive, Gypsum: Owner alleges that the property will not receive signals from the proposed translators, and is opposed to the mosquito control. 4. Antonius Van Beek, 255 Park Street, Gypsum: Owner alleges the that property will not receive signals from the proposed translators, and is opposed to the mosquito control. 5. Chris and Virginia Leniger, 501 Park View Lane, Gypsum: Owners allege that the property will not receive signals from the proposed translators, and are opposed to the mosquito control. 6. Laverne Mitchell, 90 Delane Court, Gypsum: Owner is opposed to mosquito control. 7. A.L. Rob 4 doux, 778 Valley Road, Gypsum: Owner alleges that the property will not receive signals from the proposed translators, and is opposed to the mosquito control. 8. Gary and Carol walker, 607 Price Lane, Gypsum: Owners allege that the property will not receive signals from the proposed translators, and are opposed to the mosquito control. 9. Norman and Barbara Gustafson, 705 Valley Road,#11, Gypsum: owners allege that the property will not receive signals from the proposed translators, and are opposed to the mosquito control. -3- 10. Gary and Linda Feucht, 15440 Highway 6, Eagle, and 710 Castle Drive: Owners allege that the properties will not receive signals from the proposed translators, and are opposed to the mosquito control. 11. John Sternig, 977 Highway 6 and 24, Gypsum: Owner alleges that the property will not receive signals from the proposed translators, and is opposed to the mosquito control. 12. Leonard and Marie Owners allege that from the proposed mosquito control. Sinclair, 231 Cedar Drive, Gypsum: the property will not receive signals translators, and are opposed to the SECTION 5. The Petitioners of the proposed special district failed to meet their burden of proving that the exclusion_ of such property in Section 4 is not in the best interest of the proposed special district. SECTION 6. The Town of Mail has authorized a vote by its citizens to determine if the town should be included or excluded in the district. SECTION 7. The cost of defining precise boundaries for areas to receive service from the proposed district and the cost of surveying said boundaries is prohibitive. The Service Plan as amended establishes a _Procedure for exclusion of property subsequent to the formation of the district, in addition to the procedure established by the Colorado Legislature pursuant to f 32 -1 -203, C.R.S. The Board's finding that the proposed district is capable of providing economical and sufficient service to the areas within its proposed boundaries is premised on the ability of a property owner unable to receive service being excluded subsequent to formation and to receive a refund of taxes paid. -6- 3 I SECTION E. The Board is in receipt of requests for the exclusion of property owned by the Town of Vail and Dan Corcoran. The Town of Vail has withdrawn their request for exclusion, and Dan Corcoran has filed an untimely request. SECTION 9. The district board shall provide operation and maintenance for its facilities in the manner which is most cost effective for the citizens in the district b_,= using either in house or contract service. SECTION 10. Further modification or amendment to the Service Plan as amended may materially affect the basis for the Board's findings. BE IT FURTHER RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO: THAT, the Board approves the Service Plan as amended, but subject to the following: A. The valuation of the service plan not be reduced by greater than 10% by withdrawal of property from the plan by the proponent, including withdrawal by the Town of Vail after election, or by action of the district court excluding_ property or districts on legal or equitable grounds. B. The procedure for exclusion of properties not receiving service within three years not be found contrary to law by a court of competent jurisdiction. C. If the event contemplated in either A or B hereinabove occurs, the service plan_ as amended by the occurrence is deemed different from the s=r ice plan approved hereby and shall require a new hearing approval prior to further action. THAT, the Property, as listed in Section 3, whose owners made a timely request for exclusion from the district shall be excluded. Due to such exclusion, said owners shall not be entitled to vote in any subsequent election related to the organization or operationn of the district. THAT, the request to exclude property owned by Dan Corcoran is hereby denied, due to an untimely filing of the petition. THAT, the Board of County Commissioners, pursuant to a 32 -1- x07, C.R.S., request the Eagle Valley TV Metropolitan District, if formed, to file a special district annual report. -7- The Board finds, determines, and declares that this Resolution is in the best interests of the health, safety and welfare of the County of Eagle, State of Colorado. The Board of Directors will solicit bids from private contractors for the operation and maintenance of the television translator system. 2. If no adequate signal is received by any taxpayer in the district during the first three years of the district's existence, then such taxpayer may apply for and receive a full refund of any taxes paid and for exclusion from the district. The determination of ad?E!guacy of the signal shall be made exclusively by the district's engineer. Any application for refund and exclusion must be submitted during a sir, month period beginning three years and one day after the formation of the district. Failure to apply during that period of time shall forever prohibit an automatic granting of a tax refund and exclusion from the district. Payment of any refund shall be made by the district within ninety days of determination by the district board that the signal is inadequate. The board shall be obligated to provide public notice within the district of the six month refund and exclusion application period. Failure of the board to provide timely notice shall cause the six month application period to be extended to a time six months after the last publication notice. The formation of the District will provide for the availability of television signals for Denver channels 2, 4, 6, 7 and 9 to residents of the District, and will enable residents of the District to receive the benefits of centralized mosquito control services. The boundaries of the District will generally encompass the area along I -70 and the Eagle River from Gypsum to East Vail, and the Minturn and Red Cliff communi- ties. The boundaries of the District overlap the following metropolitan dis- tricts: Cascade Village, Eagle Vail, Avon, Beaver Creek, Berry Creek, Arrowhead, Bellyache Ridge, and Edwards. Although the Arrowhead, Berry Creek and Bellyache Ridge metropolitan districts` service plans authorize those districts to provide for the establishment and maintenance of television relay and translator facilities, at the present time they are not providing such services. Beaver Creek Metropolitan District provides caole television services but does not provide over -the -air television signal reception at the present time. Edwards Metropolitan District is currently providing mosquito control related services but has consented to allow the District to provide such services. Organizational, Structure and Funding of Eagle County _J. Translator Committee During early 198 8, a group of citizens who were interested in proviaing an over - the -air T.V. set translator system approached the Eagle County commissioners with a request for Eagle County to provide funding for a prelitainary engineering feasibility study for a T.V. translator system. The Eagle County commissioners appropriated up to $10,000 in matching funds for such a study. Matching funds were provided from the following entities: C Town of Vail $2,500 Town of Avon 2,500 Town of Minturn 1,000 Town of Eagle 250 Avon Metropolitan District 1,000 Edwards Metropolitan District 250 Arrowhead Metropolitan District 250 Berry Creek Metropolitan District 250 Lake Creek Meadows Homeowners Association 250 Total $8,250 Representatives of the contributing entities and a representative from the Eagle Valley T.V. Corporation formed the Eagle County T.V. Translator Committee and retained Hartech, Inc. to prepare an engineering feasibility study for an amount not to exceed $16,000. During September, 1988, the members of the Eagle County T. V. Translator Committee adopted the following mission statement: To develop a business plan for the construction, operation, and tax based funding of a five (5) channel television translator system to serve the majority of Eagle County residents and businesses along the I -70 /Eagle River /Colorado River corridors. Upon completion of a favorable engineering feasioility study in December, 1988, the Eagle County T.V. Translator Committee studied various methods of funding and implementing a T.V. translator system. Based upon input from various sources, it was decided that the formation of a metropolitan district was the most desirable way to proceed with the construc- tion, operations and funding of a T.V. translator system. In December, 1988, the Eagle County T.V. Translator Committee began soliciting for additional funds that would be required for the formation of a metropolitan district. Funds were received from the following entities: The Lodge at Vail $1,000 The Westin Hotel 2,000 Lions Square Lodge 500 Manor Vail Lodge 1,000 Mountain Haus Condos & Lodge 500 Samba Run Resorts 500 The Marriot Mark Resorts 2,000 Appollo Park Lodge 500 Antlers at Lionshead 500 Montaneros Condominums 500 Christie Lodge 2,000 Braver Creek West 1,000 Town of Eagle 500 Town of i inturn 500 Town of Avon 12,500 Town of Red Cliff 200 C Total $25,700 Shortly after the above pledges were made, the representative from Eagle County resigned from the Eagle County T.V. Translator Committee and was replaced by two members from the Vail and Avon lodging communities. 2 PURPOSE Pursuant to the requirements of the Special District Control Act, section 32 -1 -202 (2)CRS et. seg. Colorado Revised Statutes, this Service Plan contains the following: A description of the proposed services to be provided by the District; 2. A financial plan showing how the proposed services are to be financed, including the proposed operating revenue derived from property taxes for the first budget year of the District, which shall not be mater- ially exceeded except as authorized pursuant to section 32 -1 -207 or 29- 1- 302CRS; 3. A preliminary engineering survey showing how the proposed services are to be provided; 4. A map of the District boundaries and an estimate of the population and valuation for assessment of the District; 5. A general description of the facilities to be constructed and the standards of such construction, including a statement of how the facility and service standards of the District are compatible with facility and service standards of any county within which all or any portion of the District is to be located, and of municipalities and special districts which are interested parties pursuant to section 32- 1- 204(1)CRS; 6. A general description of the estimated cost of acquiring land, engineering services, legal services, administrative services, initial proposed indebtedness and estimated proposed maximum. interest races and discounts, and ether major expenses related to the organization and initial operation of the District. A description of any arrangement or proposed agreement with any poti- tical subdivision for the performance of any services between the District and such other political subdivision and, if the form of contract to be used is available, it shall be attached to the service plan. 3 NEED FOR SERVICES T.V. Relay and Translator Svstem Facilities The Colorado General Assembly recognized the need for television rela, and translator facilities to provide access to television reception as early as 1960 and adopted statutes to authorize a variety of local governments to provide such facilities. Because of the nature of the terrain within the boundaries of the District, it is not possible for residents of the District to receive over -the -air T.V. signals from regional broadcast facilities. Consequently, residents of the District are limited to T.V. subscriber services such as cable T.V. or satellite dishes. in the event that residents of the District are unable tc• pay for cable T.V. service or satellite dishes, they are precluded from receiving T.V. signals. The formation of the District will enable residents of the District to receive T.V. signals at low costs. Several areas within the boundaries of the District (i.e., the communities of Eagle, Minturn, and Red Cliff) are currently unable to adequately operate and maintain their existing limited T.V. signal facilities. The formation of the District will not only provide for the upgrading of existing limited T.V. signal facilities but will also provide for a stable source of funding for the perma- nent operation and maintenance of such facilities. The Eagle County T.V. Translator Committee believes that the formation of the District will provide the following specific needs that are not being presently met: • Over -the -air T.V. reception will be made available to residents of the District. • Improved and expanded T.V. reception will be provided by incorporat;ng existing public and private T.V. translator systems into the Distrlgt`s systems. o T.V. reception will be provided to areas not presently covered ay existing cable T.V. systems. C o An alternative T.V. reception will be provided to areas presently provided T.V. service only by T.V. cable systems. o An alternative to cable service for low and moderate income households and seasonal employees will be provided. o One public entity will be able to provide for the coordinated development of T.V. translator systems within the boundaries of the District. Elimination and Control of Mosquitos Several communities within the boundaries of the District, such as Red Cliff, Minturn, Beaver Creek, Vail, Eagle Vail, Avon, Edwards, and Lake Creek, are located adjacent to rivers, streams, and lakes. At certain times during the year mosquitos can become a health hazard. At the present time, there is no centralized entity that is responsible for the elimination and control of mosquitos within the boundaries the District. . Upon formation of the District, residents of the District will receive the benefit of having one municipal entity who is clearly responsible for the elimination and control of mosquitos within the boundaries of the District. DES CRIPTION OF PROPOSED SERVICES The District intends to provide for the acquisition, construction, completion, installation and /or operation ana maintenance of televison relay and translator facilities, together with all necessary, incidental and appurtenant facilities, land and easements, anc all necessary extensions of and improvement to said facilities within and without the boundaries of the District. Immediately upon formation of the District, the directors of the District will attempt to accomplish the following objectives with respect to establishing and maintaining a television relay and translator facility system: 1. (1989) Obtain (i) general obligation bond authorization or (ii) enter into a municipal lease agreement to provide funding for phase 1 construction projects. 2. (1989) Execute T.V. translator equipment and license dedication agree- ments with the following entities which have agreed to transfer such equipment and licenses to the District. - Eagle Valley T.V. Corporation - Town of Minturn - Town of Red Cliff - Town of Avon 2. (1989) Finalize T.V. translator site engineering evaluations for the Eagle (Castle Peak), Dowds, Min•turn, Red Cliff, East Vail, and Lake Creek sites. 4. (198:9) File required license application and license transfers with the Feceral Communication Commission. 5. (1989) Obtain appropriate permits ana licenses for required site development from various entities. 6. (1989) Prepare specifications and bid documents for equipment and facilities as described in the "Preliminary Engineering/ /Standards of Construction /Description of Facilities and Cost Estimate_ section cf this Service Plan. 8. (1989) Award construction bids. 9. (1989/1990) Begin operation of the system. The District also intends to provide for a system that will eliminate and /or control mosquitos. It is expected that such a system will include spraying of approved pesticides in problem areas such as standing bodies of water, including marshes and riparian areas. 5 DISTRICT BOUNDARIES/MAP C The area to be served by the District generally encompasses the area along I -70 and the Eagle River from Gypsum to East Vail, and the communities of Red Cliff and Minturn. Preliminary Engineering Survey and Technical Feasihili v Stud. Mr. James W. Hart, P.E., president of Hartech, Inc., Telecommunications and Consulting Engineers, and Mr. Neil Van Gaalen, licensed broadcast engineer, nave prepared detailed engineering and technical feasibility studies relating to the District's required televiscn relay and translator facilities and have determined (i) that the proposed television relay and translator facilities within the District are technically feasible and (ii) that the standards by which the facilities are to be constructed are compatible with the facilities of other jurisdictions as prescribed by the Federal Communications Commission. Exhibit E sets forth the technical feasibility study as prepared by Hartech, Inc. Exhibit F presents two letters from Neil Van Gaalen relating to the technical feasibility of the television relay and translator facilities proposed to be constructed by the District. Description of Facilities and Estimated Costs A description of the facilities and the cost of such facilities to be constructed or installed are presented in the following paragraphs and are based on information provided by Mr. Neil Van Gaalen as presentee in Exhibit F. Table V sets forth a detailed financial plan that has been prepared by Stan Bernstein and Associates, Inc. Financial Planners and Consultants for Local Governments, Municipal Bond Underwriters, and Real Estate Developers showing how the District's proposed facilities and services are to be financed, including the estimated costs of engineering, legal, administrative services, capital costs and related debt service, and other costs relating to the organization and initial operation of the District. The financial plan clearly demonstrates that the District will have the ability to finance the facilities identified herein, and will be capable of discharging its proposed bonded indebtedness or make its annual lease payments on a reasonable basis. The financial plan assumes that the District will initially begin collecting property tax revenues, expected to initially be generated by a mill levy of 0.60 mills, during 1990. The financing plan indicates that the District's mill levy could begin to decrease by 1996 as a result of the decline in the District's annual debt service requirements or lease payments. It has been assumed that the District will finance its capital improvement requirements as previously set forth in Table II, by either (i) entering into municipal lease purchase agreements or (ii) by issuing general obligation bonds authorized by voters residing within the District's boundaries. Table V —A assumes municipal lease arrangements or general obligation bond issues during 1989 and 1990. The 1989 financing in amount of $580,000 includes one year's capitalized interest and a 5% discount for legal and financing costs. The 1990 financing in amount of $280,000 assumes a 5% discount and no capitalized interest. It is assumed that the term of the lease or the general obligation bonds will be seven years and the interest rate will be 8.5 %. We made extensive calculations to determine the FCC grade A and B coverage areas using USGS topoeraphic data for present translators, and added three new potential sites for improved county coverage. We looked without sucess into the possibility of consolidating sites. We suggest that seven of the existing translator sites be retained and upgraded. We also recommend the addtion of two new sites. At the November 3rd Translator Committee meeting we were asked to look at the BLI °i radio site northwest of the present Eagle (Castle Peak) site as an alternate site; we performed the analysis and found the improvement to be maruinal. At the meeting, we also were asked to look for a site which might cover the new Lake Creek home area. We found a site which may fill that need if available. Considerable upgrading will be required including the addition of from one to four new translators at many of the sites to have a five station system. We also discovered that there were some stations in use that do not appear in the FCC data base. We recommend that these stations be licensed before system integration. We briefly examined the signal feed systems to various translators and made some recommendations. We plotted the path profiles so you may more easily understand our observations. A cost analysis was made. Our estimated capital investment to upgrade the present sites and construct two new sites is $486,400; and the maintenance and operating costs are estimated to be $84,220 annually. I5 f`_ EAG COUN TELEV T RANSLATOR STUDY Scope of Study The Town of Avon engaged HARTECH, INC. to: (1) Determine the locations of existng TV translator stations of record servicing Earle County residents and to make a hardware inventory list, where possible, of present stations. (2) Identify new potential sites to cover additional areas of the county. (3) Determine the service areas (FCC specified A and B grade signals) of present and potential translators based upon transmitter effective radiated powers, antenna characteristics, and county topography. (4) flake recommendations to consolidate sites where feasible. (5) Briefly examine signal importation from Sunlight Peak as a substitute for the Kremmlinc (Radium) translator site. [We also looked at feeds for new translators proposed within this study.] (6) Estimate the cost of acquiring: licenses and required capital equipment for implementing a county system of updated present and new sites. (7) Estimate the annual operating and maintenance costs for a county owned system. Section 1 - Existing Stations of Record A list of television stations of record within 43 miles of Avon was obtained from the FCC data base. Originally this was obtained in July and it was updated in November. The November listing; is shown as Exhibit 1. An enumeration of television translator stations within Eagle County or servicing county residents was extracted from the data base and is C shown in Exhibit 2. [ "Job Poo." in Exhibit 2 refers to our internal computer records only.] He obtained the copies of FCC license applications and updated modifications from local sources and from the FCC files. These were utilized to obtain the basic technical parameters of the stations. As part of the study process Norman Wood, Avon Town Engineer, escorted Jim Hart to sites at Ninturn, Eagle (Castle Peak), Avon (Bellyache Ridge), and Vail (Upper Dowd - possible future site). We also went to Redcliff but did not go to the translator site. For additional information, HARTECH contacted Neil Van Gaalen who was responsible for license preparation for some of the stations and George Collett who services some of the translators within the county. Referring to Exhibit 2, twenty -eight TV translator stations were S -Z identified to be located within the county. Of the 2E, 21 stations cover toms within the county, seven cover towns in other counties. We also found two stations located in Routt County covering {McCoy and Bond. The stations studied were at nine different sites; some stations were at different locations within the site areas. We also found from George Collett that K02BS at Derby Mesa has been out of service for several years, and that the Sweetwater translators cover Garfield County and are serviced by Garfield personnel. UHF channels 65 and 51 at Eagle (Castle Peak) were found to be out of service; channels 57 and 59 are operating there. There are no FCC license records of channels 57 and 55. There may be other stations which need to be licensed within the county. We urge you to make sure any stations you place into your county system be properly licensed prior to commencing actual operation. When we received the November FCC data base, we found one Low Power TV application for channel 21 at Upper Dowd and five applicants vying for channel 42, some located at Upper Dowd. We made a number of observations regarding the present translator sites which we visited: (1) The shelters appear to be badly weathered and may not be structurally sound enough to be useful for the long term. We recommend that co- located stations be Consolidated into single shelters. (2) In general, the equipment at Eagle and Mlinturn looked relatively new; probably purchased within the last several years. (3) The antennas at Eagle and at Redcliff are housed within the shelter structures, and are probably not mechanically sound enough to withstand the outside environment if the present wooden shelters are replaced with smaller metal, concrete, or fiberglass shelters. New externally mounted antennas will then be required. We did not physically inspect the other six sites. George Collett indicated that the equipment at Derby Mesa and at the McCoy sites is also relatively new. An equipment inventory of the present stations is shown in Exhibit 3. Information for this exhibit was obtained from the license applications and updates; and from personal observations from site visits as well as data from George Collett. You should replace most of the old equipment shelters immediately; improve the AC wiring to conform with code; and replace about 50% of the translators anti antennas within the first few years of ownership. This is covered in more detail in Section 6. The receiving antenna models are not stated in Exhibit 3 because they are not indicated on the license applications. LIN Section 2 - Pote Ne w Sites It is unfortunate that there are already seven sites (eliminating Sweetwater which belon }s to Garfield County and Dotsero that appears not C to cover Dotsero) which most likely must be integrated into the county system, and that additional sites are required to cover the eastern part of the county. The new sites studied are shown on page 2 of Exhibit 2. An excellent site to cover from Edwards to East Vail along the I -70 valley is Upper Dowd where KVMT has its transmitter. As stated above, there are already applicants for two channels (21 and 42) for LPTV at this site. Frequency coordination at this site may be difficult for the licensing of five new translators. We tentatively designed this site to incorporate 100 watt UIiF translators fed by U�;F transponders from Avon. We looked at using both omnidirectional antennas and at using; Scala paraflectors PF- 45OLI aimed east and west along I -70. The use of directional paraflectors is recommended and our exhibits are based on them. C At the November TV committee meeting we were asked to check out the the BLM site northeast of the Castle Peak site as a replacement for the :resent Eagle site. It was assumed for this study that 100 watt UHF translators would be used at the 2Lii site so it could be compared with the present site. Our observations about this site are covered later in this report. During our field visit and at the November TV meeting we were asked about the possible coverage of the "Lake Creek" area. We found an excellent hill which might be- used to house 1 ,Matt translators using 5 element yagi transmitting antennas to cover the Lake Creek area. The hill is indicated on the USGS site map (Exhibit 6) provided. It appears that the translators could be easily fed frog; the Upper Dowd site. No other potential new sites could be found for investii Secti 3 The ueographic coordina those listed in Exhibit 1, checked against geographic construction permits for the - Service Coveracie Areas tes of the sites used in this study were the FCC engineering data base. They were coordinates listed in the applications for respective translators. The topographic terrain elevation data was extracted to a distance of thirty miles along: 72 radials spaced in five decree increments around each station starting at true north. Elevation data was taken at 0.2 mile increments along each radial. The data base used was the National Geophysical Data Center (NGDC) 30- second point elevation; this is the sane data base as used by the FCC. The elevation of the site, the center of radiation above Ground level, the assigned frequency, and the effective radiated power were verified from as many sources as possible - some visits, reaps, license applications, and so forth. Flhen a directional antenna was used or proposed, the particular radiation characterisitics of the specific types of antennas were -4- secured from antenna manufacturers and erpIoyed in our prediction modeling. Tabular patterns for all sites using directional antennas are shown in Exhibit 4. The received field strength was then calculated at one rile intervals on each of the 72 radials starting at the transmitting antenna location. In accordance with standards of good engineering practice (and FCC methodoloyy), the receiving antenna was specified to be 30 feet above ground level. The free space field strength was calculated at each point and then attenuated by the shadow loss that occurs as a result of terrain that penetrates the first Fresnel zone. Two or more obstructions that occurred on a path that are within 0.5 miles were treated as a single obstruction and the worst case loss was used in assessing the particular obstruction loss. Once the fields were calculated at approximately 2160 locations C around each transmitting antenna, the locations of the pertinent grade A and grade B contours were calculated seeking the first location removed from the transmitting site where the field reached the prescribed values. The grade A and B contour distances were then plotted using the calculated points on each of the 72 azimuths around each translator evaluated. Contour values for field intensity (dBu /meter) are specified by the FCC in the Rules and Regulations Section 73.683. The contour values are: Grade A Grade B Channels 2 - 6 (68u) (dBu Channels 7 - 13 71 56 Channels 14 - 69 74 64 While the numbers vary for all three bands, the grade A and B signals within either contour grade represent similar picture quality. Exhibit 5 (Report Vol. 2) consists of tabular data for the contours calculated at the translator stations at each site. The contour overlays C discussed below are based upon these figures. Exhibit 6 is the 1:100,000 scale map with the twenty service coverage contour overlays. !There there was a cluster of VHF or UHF translators with identical power and antenna types, one set of contours was calculated to provide the coverage for each cluster of translators. An example of this is the Minturn site which has three identical VHF translators and antennas - only one set of contours was made since the coverage patterns are essentially the same. We made a number of observations regarding the various translator coverages. We suggest that you use the map and overlays as you go through our comments to understand, and concur or disagree with us. Our observations and comments are: (1) The Eagle site at Castle Peak does not cover the Town of Eagle very well and has only limited coverage of parts of I -70. Intervening terrain -5- produces substantive grazing. and therefore adversely affects the reception in Eaole. (2) We checked the BLfi site located northeast of Castle Peak to see if it micht give better coverace to the valley. We found that it does not do much better than the present Castle Peak location, and we believe it would riot be worthwhile relocating the Castle Peak translators to this site. (3) The Hinturn site gives the Minturn channels excellent coverace in the town and up and down the valley. No changes are recommended. (4) The Sweetwater channel 13 probably interferes with adjacent channel 12 at the Dotsero site. (Also see note 5.) (5) The Dotsero coverage appears to be a very small area. We checked our C calculations several times to make sure we had riot made an error. The coverage appears not to include Dotsero. Consideration should be given to eliminate this site from the system or to relocate the site to be near the community. Consideration should also be given to changing the frequency from channel 12 to minimize potential interference with K13110 at Sweetwater. (6) There are three different locations indicated for the Derby resa Stations (with K02BS no longer in service). The site for K05BJ appears to have superior coverage to the other two sites. (7) It is our understanding that the only function of the Ptarmigan translators is to feed the Redcliff translators. The Ptarmigan station applications indicate the antennas are not directed perfectly. If Redcliff is the only target and the antennas are not directed toward the Radcliff translators, we recommend that they be properly redirected. Similarly, the Redcliff antennas should be looking directly at the town. The Redcliff translators appear to cover the town well. (B) iicCoy appears to be well covered, but Bond does riot by the Bond- i•cCoy translators. The terrain south of MjcCoy degrades the reception at Bond. C (9) The new Avon site (Bellyache Ridge) looks like an excellent site to cover much of I -70 west of Vail as well as the Torn of Avon. It will also provide excellent signals for translators at the Upper Dowd site. (10) Upper Dowd is an excellentent site to cover from Edwards to East Vail alono I -70. (11) The Lake Creek site appears to satisfactorily cover the region. This site should be field checked to: (1) make sure it actually covers the area of the new or potentially new housing:, (2) confirm that there is a line of sight between Upper Dowd and the site, and (3) make sure the site is available for use by the county. Section 4 - Site Consolidation -6- We cannot see any reasonable consolidation of the present sites to maintain coverage over several regions within the county because of the roueh county topography. Similarly we see no obvious movement of the northern sites which might improve coverage. Section 5 - Si Importation We sorted out the present feed schemes for the various translators in the system. Exhibit 7 shows feeds to various sites. It also shows the licensee of record for each station. rIe examined the feeds to various translator sites from Sunlight Peak and from the Kremmling (Radium) site as required in the contract. One translator rule is that no more than a three hop chain from the originating station should be used to retransmit television signals. If more than three are used, there is an excellent chance of loosing picture sychronization and introducing high noisc.'Sunlight Peal; will probably remain as an "original" translator station fed directly with microwaved video and audio; Krernmlino is fed from the Denver TV stations and represents one hop. [Dr. St. Clair of Television Technology indicated to us in October that his company is working on some new translator designs that will eliminate the need for the three hop restraint sometime in the future.] Profiles, graphical representations of elevation versus distance between transmission path terminals were made for each feed path examined. The profiles included herein also cover the potential new sites as mentioned above. We have assumed the "bending" of the signal to be 1.307 times the relative earth curvature (as recommended by the National Bureau of Standards for paths located in the Colorado. Mountains). This bending takes place because of refraction of signals from the atmosphere made up of lighter air on top of heavier air at the lower altitudes. It is shorn on our profiles as curved "x" axis lines. To receive usable signals, it is necessary to have clear paths between translators and 0.6 times the first Fresnel zone clearance. This clearance is indicated on the profiles by unoostructed straight lines C between terminals. All the clear paths met the Fresnel clearance criterion. Please look at Exhibit 8 as you read our comments below: (1) Exhibit 8A - Sunlight Peak has an excellent unobstructed path to the Eagle Site at Castle Peak. (2) Exhibit 8B - The path from Krernmling ('Radium) to the Eagle Site is obstructed at the Eagle end. The obstruction is not too large and the defracted signal reaching the channel 7 translator input is degraded but evidently usable. (3) Exhibit 8C - The Sunlight Peak to the new Avon site path also looks satisfactory. (4) Exhibit 8D - Sunlight Peak to Upper Dowd is an obstructed path and Should not be used. �3 -7 (6) Exhibit SE - Avon to Upper Dowd is an excellent unobstructed path. C Avon would make a good feed to Upper Dowd. (7) Exhibit 8F - At the November Eagle County Television Translator Committee meeting, we agreed to examine possible alternate paths to Redcliff. The path from Upper Dowd is blocked and could not be used to feed Redcliff. (8) Exhibit 8G - The path from the new Avon' site to Redcliff is not satisfactory; it is also blocked. (U) Exhibit 8H - The Eagle Site to Upper Dowd is also an unobstrcted path so that Upper Dowd could be fed from Eagle if the Avon site is not developed. (10) Exhibit 8I - There appears to be an excellent path between Upper Dowd and the newly identified Lake Creek site. Any new feeds should be confirmed by field sighting between the end points to confirm that no natural or man -made obstacles are in the paths. In addition the topography information must be abstracted and pertinent path calculations must be made. Simple line -of -sight is by no means entirely satisfactory. Section 6 - Estimated Capital Costs Acquisition of the present (existing) translator stations should be quite reasonable, we believe, because the county will provide the site and station upgrading to assure continued hick reliability levels. In P-Ost cases, we think, the TV associations will probably provide the county with these at no cost. There is an excellent probablility that the present translator equipment will need to be replaced or upgraded within the first five years of operation. To provide a five channel system, you will need to coordinate and license three new stations at Bond- FicCoy, four at the Dotsero site (if C kept), two at i *linturn, and three at Ptarmigan and Redcliff, and update the licensinj at the Eagle site. You will also need to frequency coordinate and license nee sites at Upper Dowd and Lake Creek if you decide to integrate them into your system. It is critical that all existing and proposed frequencies be coordinated at the same time since the selection of any new translator frequencies will preclude the use of many frequencies within the region. We recommend consolidating the five translators at each site into a single shelter at least 8 by 12 feet; and replacing multiple towers with single towers and new antennas. It may, however, be required that the receive antennas need to be isolated from the transmit antennas in which case you may need to provide a second tower spaced away from the transmitting antenna tower. The isolation requirements depend upon the differences in transmit and receive frequencies, the use of rf filters, and the terrain. At Avon and Upper Dowd the owners will most likely provide station equipment space and tower space. j M Exhibit 9 shows estimated unit costs for various equipment from C suppliers. Exhibit 10 is a spreadsheet showing the estimated costs by site for the complete system. Based on our observation of the Eagle site we recommend new shelters, new power heads and A.C. distribution, and towers. For simplicity we have assumed that each translator will have separate transmitting and receiving antennas. In practice you may be able to combine up to several UHF translators on a single antenna depending upon the fregency separations. Similarly you may decide to use log periodic antennas for VHF translators. Single antennas at each band (VIIF and U'r'F) and combiners may also be used on the inputs of the translators. Exhibit 11 is a summary of the capital costs of Exhibit 10. The total estimated cost, if you accept the eight exisitng sites (including Dotsero which you may wish to eliminate and Avon which has not yet been constructed) plus Upper Dowd and Lake Creek will be approximately $4136, 900. Section 7 - Operation and Maintenance Costs Exhibit 12 shows our estimate of operation and maintenance for the total system. We have assumed modest leasing costs for the low power sites, and reasonable leasing costs for the higher power sites. Spare parts are based upon 10% of the cost of new translators; power is based on $30 per month for each set of five low power translators; and we have assumed that you will hire a technician to service the county system at $30,000 including overhead. We have not assumed that the county will purchase any test equipment which may be necessary to service the sites. Please note that the pricing comes from the latest TTC price list (attached). The solar power pricing comes from a quote a year ago for a solar power supply for the Microwave system at Corona Pass and should be reasonably close for budget purposes. I have addressed each site separately and hopefully this will be what you need for this week and I would follow up the latter part of the week with more detailed engineering data to back up this first part. After studying the hartech report I find it contradicts itself on the HAAT (height above average terrain), Mr Ellis states one elevation in exhibit 1 and Jim Hart specifies a different HAAT elevation in exhibits 8, The reason I bring this to your attention is the FCC requires that Grade A and Grade B contours be run using the 50 -50 charts and HAAT the higher the HAAT the larger the area the Grade A and B contours will cover, for a margin of safety I will recheck pertinent contours using the lower elevations in exhibit 1. In the cost break down for each site under the item Misc, This covers such smaller items such as transmission lines, connectors,electric wire, ect. Relative to licensing of the system I believe it would not be possible to obtain licenses for VHF therefor I have specified UHF translators most of the system with the exception being Redcliff. Sincerly `- z 0 XWQ: Neil Van Gaalen A I r� L 54 CASTLE PEAK This is the head end for your system and while it would be ideal to have all of the channels UHF it would no doubt cause public relations problems to change the existing VHF channels to UHF therefore I would suggest you keep your present channel configuration utilizing 3 VHF channels and 2 UHF channels. The suggested changes would be that the 2 present UHF channels be upgraded to 100 watt solid state units and a new Bogner antenna with a 220 degree horizontal radiation pattern and 8 degrees vertical beamwidth at the half power point. For the VHF I would suggest each channel have a separate 1.0 watt amplifier directed at dowd Junction all translators would be equipped with anti distortion circuits. A larger receiving dish would be utilized to improve signal reception from Sunlight Peak. A new masonry building should be constructed to house the equipment. DOWD JUNCTION This site would require 5 new 100 watt solid state translators each translator would have anti distortion circuits installed. Antennas directed toward Vail and Avon would be Scala PR 450U in the direction of Minturn a Scala parapanel would be utilized. The lower Dowd site was selected because it will better serve west Vail. PTARMIGAN The only purpose this site serves is to supply Redcliff translators, other means of supplying Redcliff Translators are planned allowing this discontinued. signals for the signals for the site to be REDCLIFF For a signal input source to serve this site a location on top of the ridge to the northwest of the translator site would be selected that will allow line of site reception from Castle Peak. A antenna system would used to receive the signals and transmit them via coaxial cable down the mountain to the Redcliff translator site, Additional translators would be added to make up the full 5 channel package. X I N LAKE CREEK Utilizing the site Hartech selected the service area is small the Ideal equipment would . - be 5 one watt UHF translators these units only require 25 watts of power each for a total of 125 watts wich can easily be supplied with a solar system, Antennas would be parapanels by Scala. EAST VAIL SITE It is my understanding that this site will also use solar power due to the need to transmit in 2 directions, requiring a 50- 50 power split a 1 watt translator would not be enough the suggested equipment would be 10 watt UHF translators, my estimate on solar power needs would be about 300 watts for 5 units. The purpose of this site will be to serve east Vail and parts of west Vail that are shaded from Dowd Junction Site. Antennas would be Scala PR 450 U. MINTURN This site will probably not be needed to serve Minturn as the Dowd Junction will serve Minturn, I would suggest the 3 VHF channels at minturn be left on the air for several months that will allow the public to adapt to the Dowd Site. CASTLE PEAK Please note the attached information on Bogner antennas, the antenna selection has a power gain of 16x with a 100 watt translator this would result in a ERP of 1,600 watts in comparing this with the present setup of 20 watts utilizing a Scala SL- 8 paraslot antenna with a power gain of 10x resulting in a ERP of 200 watts. As you can see this is a significant increase in in effective radiated power with the the Grade A contour being 17.7 miles and the Grade B at 27.7 miles, this should provide very good signal quality through out the Eagle area and to Dowd Junction on UHF. DOWD JUNCTION This calculation utilizes a 33- 33 -33- three way power split with identical power levels and antennas going to Vail and Avon, this shows the Grade -A at 9.9 miles and the Grade -B at17.3 Miles this would be in either direction from Dowd and will provide good signal strength in Avon and Vail. The other 2 sites East; Vail and Lake Creek also look ok for the required service area. I have enjoyed helping you on this project and when the system is installed and in operation it will be a credit to your organization anal -he people of Eagle County.
