BOARD OF COUNTY COMMISSIONERS
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 89-
AUTHORIZING THE DISTRICT ATTORNEY FOR
THE FIFTH JUDICIAL DISTRICT TO KEEP
AND CONTROL UNSPENT REVENUE FROM THE 1988 BUDGET
WHEREAS, the District Attorney, Peter F. Michaelson, in and
for the Fifth Judicial District, State of Colorado (hereinafter the
"District Attorney ") , on or about March 15, 1989, has delivered to
the Board of County Commissioners of the County of Eagle, state of
Colorado (hereinafter the "Board "), a final budget request for
fiscal year 1989; and
WHEREAS, the proposed budget does not exceed the proposed
revenue share of this county approved by this Board previously; and
WHEREAS, pursuant to Section 20 -1 -302, C.R.S., the District
Attorney shall be entitled to collect and receive at the end of
each month, of and from the respective counties in his judicial
district, the necessary expenses of maintaining an office for the
transaction of his official business; and
WHEREAS, the District Attorney has also requested authority
to hold excess and unspent monies in an amount of $13,730.00
derived and remaining from the 1988 budget; and
WHEREAS, the District Attorney desires to spend the revenue
to purchase a computer system that would link together the counties
of the fifth judicial district, those being Clear Creek County,
Eagle County, Lake County, and Summit County; and
WHEREAS, the purposes for which the District Attorney seeks
to spend this revenue is found to be necessary and proper for the
continuing operation of his office during fiscal year 1989; and
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the Board hereby approves the District Attorney's final
budget; however the Board does not specifically approve the step
payroll plan and the five -year salary schedule included in the
introduction to the budget.

THAT, the Board hereby gives the District Attorney authority
to keep and control the remaining unspent monies from 1988 for the
purpose of capital improvement during the fiscal year 1989, and to
report, by audit or otherwise, the expenditures made hereby.
THAT, this resolution is necessary for the health, safety, and
welfare of the citizens of Eagle County.
MOVED, READ AND ADOPTED by the Board of County Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
held the day of °77 1 1 q , 1989.
