HomeMy WebLinkAboutMinutes 04/18/2023 PUBLIC HEARING April 18, 2023 Present: Matt Scherr Chairman Pro-Tem Jeanne McQueeney Commissioner Jeff Shroll County Manager Jill Klosterman Chief Financial Officer Matt Peterson Assistant County Attorney Kathy Scriver Deputy Clerk to the Board Absent: Kathy Chandler-Henry Chairman This being a scheduled Public Hearing,the following items were presented to the Board of County Commissioners for their consideration: Chairman Pro-Tem Scherr noted that Chairman Chandler-Henry was not in attendance as she was off representing Eagle County at a Water District meeting. Constituent Input Chairman Pro-Tem Scherr opened constituent input. Chris Neuswanger, a Singletree resident, stated that he shared the goal of building more affordable housing but expressed concern for the 20 modular units proposed for Freedom Park. He believed that the Edwards infrastructure was maxed out but holding its own. There were currently nine proposed projects in the Edwards area which could add over another 1000 new units to Edwards. Of all those projects,only two of them proposed minimal infrastructure improvements. Freedom Park was one of most overused parks in the County and it had gotten so crowded that he and his wife no longer go there. The traffic on Miller Ranch Road in the morning and end of the day was gridlocked and becoming more.hazardous for pedestrians. He requested that the board hit the pause button and discuss the infrastructure impacts and how it could be addressed. The Edwards Area Community Plan and Future Land Use Map indicate that there could be some government service buildings built on the Freedom Park property but there was no mention of housing. The PUD Agreement clearly stated that the tract was for recreation only and any changes to the agreement should follow the intent of the PUD Agreement. Chairman Pro-Tern Scherr closed constituent input, Commissioner Updates Commissioner McQueeney recognized the 14 graduates of the Family Leadership Training Institute. Over one hundred people had gone through the program. Through their work on their community projects,they were making a difference in the community. Chairman Pro-Tern Scherr also congratulated the graduates and thanked Glenda Wentworth, CSU Supervisor/CSU Extension, and her team for making it possible. 1 04/18/2023 County Manager Updates Jeff Shroll reminded folks about the upcoming I-70 Cleanup on May 5th. There were a lot of ways to get involved. Consent Agenda 1. Resolution 2023-022 Order of Cancellation of Certain Uncollectible Taxes Anissa Berge&Teak Simonton, Treasurer's Office 2. Resolution 2023-023 Approving the Consolidated Special Use Permit(SUP) for FK Holdings ADU Eagle County File No.ZS-009269-2022 6. March 2023 Payment Report Jill Klosterman,Finance 7. Treasurer and Public Trustee Quarterly Reports Anissa Berge&Teak Simonton,Treasurer's Office Teak Simonton,Eagle County Treasurer, commented on Item#7 stating that her office was required by law to present a quarterly interest report. The good news about inflation was as the feds continued to raise interest rates,the opportunities for short and medium term interest were greatly increased. At this time the county was getting a 4.8%rate from local government investment pools. They had put more of the fund balances into six,nine, and twelve month term deposits with a state local government investment pool. The budget has greatly exceeded. She estimated that the county was receiving$1300 a day for every million dollars. Joanna Kerwin of Edwards commented on Items#2 and 3,the easement for the lighting project in Edwards. She was excited about the project and hoped the board would approve the items. It was something the Metro District had been working on for a long time. She also commented on Item#4,the proposed module units and shared the same concerns as Chris Neuswanger with regard to decisions being made without any public input. She agreed with the need for housing but thought the parcel was designated for government buildings or recreation. Kris Miller,Homestead resident, also commented on Items#2 and#3 and was pleased that the lighting project was moving forward. She also commented on Item#4 and stated that she diligently tried to attend these meetings and recalled a conversation about a county facility being built on the site in front of the Field House for the purpose of a secured election area and some other county offices. She didn't recall any conversations regarding residential units. She expressed concern for water and asked that the commissioners spend more time in Edwards during peak traffic hours and experience the current traffic situation. She suggested that the purchase 2 04/18/2023 order be written to be 100%refundable or put the brakes on to have the opportunity to hear from the people who would be directly affected by the potential acquisition and buildout. Commissioner McQueeney recalled the conversations had always included housing. Jill Klosterman,Chief Financial Officer stated that back in July they shared three different options for the property, all of which included a small housing portion. After working with the architect on the building, there was space available. They could add more parking or add some housing units. The beauty of the modular units was that if they didn't work on this site,they were modular and could be moved. The deposit was about$180,000 which was budgeted as part of the due diligence for the project. Commissioner McQueeney moved to approve the Consent Agenda for April 18,2023 as presented. Chairman Pro-Tern Scherr seconded the motion. Of the two voting commissioners, the vote was declared unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Board of County Commissioners and reconvene as the Eagle County Housing and Development Authority. Chairman Pro-Tern Scherr seconded the motion. Of the two voting commissioners, the vote was unanimous. Eagle County Housing and Development Authority 1. Intergovernmental Agreement Between Eagle County Housing and Development Authority and the Town of Eagle Meghan Scallen&Kim Bell Williams,Housing Executive Summary: The Eagle County Housing and Development Authority, through The Valley Home Store, has been a strong collaborative partner with the Town of Eagle since 2009 to provide housing services for the town's Local Employee Resident Program(LERP). The LERP program has a growing inventory of deed restricted for sale properties located within the town of Eagle, and is looking to expand the program through new inventory in the coming year. The Valley Home Store shall provide a variety of housing related services to include re-sale, compliance, administration and education for the public on behalf of the Town of Eagle. Ms. Scallen with Eagle County Housing presented the updated agreement with the Town of Eagle. The new IGA had a three year term and would bring in$3,750 for management services in 2023. The fee would increase to $7,500 in 2024 because there was a much larger scope of work included in the agreement. The Town of Eagle had been committed to housing, and it had been fun to work with them. Commissioner McQueeney moved to approve the Intergovernmental Agreement Between Eagle County Housing and Development Authority and the Town of Eagle. Chairman Pro-Tern Scherr seconded the motion. Of the two voting commissioners,the vote was declared unanimous. 2. Agreement for Professional Services between Eagle County Housing and Development Authority and PlaceMate, Inc. to operated the Rent Local program as a part of the Bold Housing Moves Monica Brutout&Kim Bell Williams,Housing Executive Summary: In 2021 to 2022,the Eagle County Housing and Development Authority launched new housing programs that would support renters,home buyers and home owners with increasing the stock of local 3 04/18/2023 resident housing. Those programs are known collectively as the Bold Housing Moves (boldhousingmoves.com). Within the Bold Housing Moves,the Rent Local program was designed to incentivize short term rentals and vacant homes to return to the local resident rental market. ECHDA has identified a partner who has experience with this program in seven other resort markets called PlaceMate, Inc. PlaceMate, as a contractor for ECHDA, will design the Rent Local program for a re-launch on June 1, 2023,while ramping up the marketing, outreach, and engagement for the program. The services to manage the Rent Local program will be provided to ECHDA with the program's goal of 38 total units by December 31,2023. More information was available at housingeaglecounty.com. Ms. Brutout, Housing Program Manager, stated that the PlaceMate was a third party company. They would manage owners and tenants to make sure they were eligible for certain housing programs and assist in listing of properties, tenant matching,marketing, customer service,reporting and compliance. They were hoping for a contract date that began May 1st. Patti Liermann with Eagle Couny Housing added that starting with the June 1st relaunch they were looking at $7,500 a month with PlaceMate to run the program, and at that time, all the information on the website would be updated and PlaceMate would be the point of contact for inquiries. Commissioner McQueeney moved to approve the Agreement for Professional Services between Eagle County Housing and Development Authority and PlaceMate,Inc. to operate the Rent Local program as a part of the Bold Housing Moves. Chairman Pro-Tern Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous. Commissioner McQueeney moved to adjourn as the Eagle County Housing and Development Authority and reconvene as the Eagle County Airport Terminal Board. Chairman Pro-Tern Scherr seconded the motion. Of the two voting commissioners,the vote was unanimous. Planning File - Eagle County Room 1. Public Hearing For DOTSERO 301 Stephens ZS-9259-2022 Vince Hooper,Community Development Mr. Hooper, Eagle County Staff Planner,presented the application for a consolidated Special Use Permit. The applicant wished to install four high speed internet antennas. It was required to be a special use permit because Two Rivers PUD required the process. Staff sent the application out for referral and provided public notice. There had been no public comments provided to staff The parcel size was 2.2 acres. The lot had a single family dwelling unit on it. The antennas would be installed on the exterior of the building. He showed photos of what the antennas looked like and the location of the antennas. The Planning Commission reviewed the application on March 1st, and at that time, staff was recommending approval with three conditions. Condition number two required the applicant to secure approval of Two Rivers Village HOA,however the HOA no longer existed. Staff reached out to Mike Pearson, the owner of Two Rivers Village Center,and he provided a letter of approval in place of the HOA. Condition number two was no longer needed and had been satisfied. The existing home was situated on Lot 5, Two Rivers Estates. One referral comment had been received from the Gypsum Fire Protection District which requested that the utility room be properly labeled per the Fire Code. He reviewed the standards of approval and indicated that the application met all the standards for a special use permit with two conditions. 4 04/18/2023 Chairman Pro-Tern Scherr opened and closed public comment, as there was none. Matt Peterson,Assistant Eagle County Attorney, stated that the Two Rivers PUD guide required the Board of County Commissioners to review the application as a Special Use Permit because it referred back to the County Land Use Regulations (LUR), and the LUR required review of the file as a Special Use Permit. He added that staff had done the best they could trying to comply with the additional HOA requirement and had met the intent of the PUD guild to the best of their ability. Commissioner McQueeney believed the application did not raise any concerns for her and Mr. Hooper was thorough in reviewing the standards. Chairman Pro-Tern Scherr concurred with Commissioner McQueeney's comments. Commissioner McQueeney moved to approve file No.ZS 009259-2022 incorporating staff's findings and recommended conditions,because this application, as conditioned, meets the standards for approval of a Special Use Permit. Chairman Pro-Tern Scherr seconded the motion.
