the following Resolution:
COUNTY OF EAGLE, STATE OF COLORADO
RESOLUTION NO. 89 - 4L
RESOLUTION DENYING RUDER MINOR PUD
WHEREAS, the Board of County Commissioners (hereinafter "the
County ") , has reviewed an application received on November 28, 1988,
for the development of Ruder minor PUD from R & S Ranch
File No. PD- 277 -88 S /P , (hereinafter referre to as "App icant ");
and
WHEREAS, based on the evidence, testimony, exhibits, study of
the Edwards sub -Area Master Plan, comments of the Eagle County
Department of Community Development, comments of public officials
and agencies, the recommendation of the Eagle County Planning
Commission, and comments from all interested parties, the Board finds
as follows:
1. The proposal does not comply with the Edwards Sub -Area
Master Plan, Sections II, 2 and IV A2.
2. The proposal does not comply with the Eagle County Master
Plan; specifically:
a. The project encourages commercial development outside
of identified community centers.
b. The project proposes development which negatively
visually and physically impacts the scenic and
agricultural lands that characterize Eagle County.
3. The project does not have a legal source of water for the
proposed number of units.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF THE COUNTY OF EAGLE, STATE OF COLORADO:
THAT, the application of P. & S Ranch Co., Inc., File No:
PD - 277 - SIR for approval of a Zone Change an — Minor PUD in the
following described unincorporated area of Eagle County be disapproved:
Lot 4 of Section 6, T5S, R82W.

THAT, the Board of County Commissioners directs the Department
of Community Development to provide a copy of this Resolution to
the Applicant.
MOVED, READ AND ADOPTED by the Board of Countv Commissioners
of the County of Eagle, State of Colorado, at its regular meeting
