FIRST AMENDMENT TO AGREEMENT BETWEEN
EAGLE COUNTY, COLORADO
AND
THE ROARING FORK SCHOOL DISTRICT
THIS FIRST AMENDMENT ("First Amendment") is effective as of 3/20/2023 by and
between Roaring Fork School District -Basalt Elementary a Colorado Public School District
(hereinafter "Consultant" or "Contractor") and Eagle County, Colorado, a body corporate and
politic (hereinafter "County").
RECITALS
WHEREAS, County and Contractor entered into an agreement dated the 13th day of January
2023 for certain Services (Original Agreement C23-017); and
WHEREAS, the County desires to have the Contractor perform additional Services as set forth
below;
FIRST AMENDMENT
NOW THEREFORE, in consideration of the foregoing and the mutual rights and obligations as
set forth below, the parties agree as follows:
1. The Original Agreement shall be amended to include additional Services as described in
Exhibit 1, which is attached hereto and incorporated herein by reference.
2. Capitalized terms in this First Amendment will have the same meaning as in the Original
Agreement. To the extent that the terms and provisions of the First Amendment conflict
with, modify or supplement portions of the Original Agreement, the terms and provisions
contained in this First Amendment shall govern and control the rights and obligations of
the parties.
3. Except as expressly altered, modified, and changed in this First Amendment, all terms
and provisions of the Original Agreement shall remain in full force and effect and are
hereby ratified and confirmed in all respects as of the date hereof.
4. This First Amendment shall be binding on the parties hereto, their heirs, executors,
successors, and assigns.

Background
The Eagle County Early Head Start (EHS) program and the Roaring Fork School District agree to
increase the number of EHS children served at Basalt Elementary School Early Childhood Program from
4 to 5. The additional child care slot will be available to EHS to enroll beginning March 1, 2023.
Early Head Start will help enroll families in the Colorado Child Care Assistance Program (CCAP) as the
CCAP program also requires families to participate actively in program requirements. Using a blended
funding model for EHS services across the center -based program option will allow the program to serve
more families. As such, the updated billing processes are outlined below.
Payment and Fee Schedule: The contractor shall be compensated for the performance of assigned
services as follows:
The county agrees to pay to Contractor for up to 5 full-time child-care slots starting March 1,
2023. The county will only compensate the Contractor for spaces occupied by an EHS-enrolled
child each month up to the CCAP published daily tuition rate.
a. The contractor will receive an EHS statement of enrollment and CCAP status at the end
of each month for review and to help inform billing expectations.
b. Children enrolled in the Colorado Child Care Assistance Program (CCAP) will first be
billed to CCAP for registration fees and daily tuition.
c. EHS will pay additional fees not paid for by CCAP, including non -covered tuition, parent
fees, material fees, late fees, etc., to ensure families are not charged for any services
while enrolled in EHS.
d. If a manual claim to CCAP is not paid within 90 days of the month when care was
provided or if the manual claim is denied for a reason beyond what is eligible to be paid
by CCAP (see section c. above), EHS will be billed to ensure the center receives the full -
daily rate for services provided. The contractor will provide documentation of the CCAP
payment denial to receive the EHS payment.
e. EHS will pay a daily tuition rate for up to 12 holidays and four teacher training days
based on the monthly tuition rate of $1,500 per child.
f. EHS will not pay tuition for week-long closures or summer vacations when childcare
services are unavailable to EHS families.
g. Said child care tuition payments may be at most $30,000.
h. The contractor must comply with all CCAP program rules and maintain an active fiscal
agreement with Eagle County.
